I am a 70 years old senior citizen.I have purchased 6 decimals of land in the year 1990 by Rs.45,000.Now I want sell the plot for typical financial crisis. The customer will pay me hardly 5 lakhs.But the circle rate of the plot is now 25 lakhs. Nobody wants to pay more than 5 lakhs for that plot. I am agreed to sale for Rs.5 lakhs. But if I sell it at 5 lakhs, the full amount I will have to pay as capital gain tax. So I have decided to transfer the property through a long term lease agreement or by a mortgage deed with the buyer for Rs.5 lakhs bank transfer. Will it attract any income tax liability from my side? Please give your kind suggestion.

Skjain Mumbai I have inherited a residential flat from my father by virtue of a will which is not registered. I am told that to sell the flat probate of will will be necessary that I don't want as it is costly and time consuming. What are the other options available tome which do not attract exorbitant expenses.

ये भारत है यहा हाई कोर्ट और सुप्रीम कोर्ट governer चाहे ये आदेश कुछ भी करे लेकिन कर्मचारी और उस चिज क बारे मे या तो जानते ही नही या पैसे खाने क लिये फ़्री की चिज कौ 5000 या इससे अधिक का बना देते।ये उपर की मिली भगत का ही जाने अनजाने हिस्सा है।

Power of attorney out side blood is valid only for 1 year in MP. POWER OF ATTORNEY becomes null the moment the excutor dies. Power never transfers any title and the attorney can never recieve any sale consideration. Plz give complete information

you have not mentioned property transfer through - partition deed. where you have to pay stamp duty . In Delhi family settlement is not valid document and authorities demanding partition deed. Please guide on this.

Registration आगे के 75×37ft की registry karai है. पिछे की भूमि में m ही जा सकता हूं. Mool विक्रेता की मृत्यु हो गई है. मेरे पास registry के अतिरिक्त कोई document नहीं है, plz समाधान बतायें

As per my knowledge, u can challenge it on d ground that mother has been coerced,influenced by others to sign it. But u will have to prove such coercion and influence.

उपहार विलेख में यह उल्लेख किया गया है कि बिना किसी प्रतिफल के... लेकिन यह भी उल्लेख किया गया है कि स्टाम्प ड्यूटी और पंजीकरण शुल्क उपहार प्राप्तकर्ता द्वारा भुगतान किया जाएगा। उपहार प्राप्तकर्ता ने दोनों शुल्क का भुगतान किया। क्या इसे दान प्राप्तकर्ता द्वारा भुगतान किया गया प्रतिफल माना जाएगा? उपहार विलेख की वैधता क्या होगी?

I think you have to pay stamp duty depending on your relation with the party to whom you want to transfer. If there is no relation then full stamp duty is payable

Stamp duty law differs from state to state.. In Rajasthan Gift Deed costs less than Sale Deed.. even gift level decides the stamp duty.. same gift from father to son vis-a-vis gift from gift from grandfather to grandson will have different stamp duties..

I am Member of Plotted CHS. I RECOMMENDED MY YOUNGER BROTHER FOR ASSOCIATE MEMBERSHIP. I withdrew my recommendation after some days. However in spite of my withdrawing recommendation he was given associate membership after 4 days just accepting rs.10/ as Entry Fere after 3 yrs, retrospectively...since 3 yrs priorly. On this AMShip as well as Xerox of Father's Will/ FA..he has Filed suit for RTI in said plott. In Cooperative court!? Matter going on for 14 years. Cooperative department reguses to verify AMShip as Matter in court. On this false claim...for RTI bye AM going on in lower court for 14 yrs. Ex parte Ad interim interloculatory injunction ...ct for 3/4 years and then Confirmed. Can duch order remain on force....indefinately.. Due to this COOP CORT ORDER... DISPUTENT ? AM RESTRAINS ME FROM ENTERING MY PROPERTY. Is this going on in Legal way ?

My sister in law passed away 4 years ago and now it cannot be transferred in brothers name as the land where ten years ago received keys the land is still in name of landowner who sold it to builder and we cannot get property card as no one in society has got it as construction done in Gandhinagar ; Gujarat and how did the builder get permission to sell flats without transfer of land in Gandhinagar registration office😢😢
