I don't know why lawyers expect you to understand the legal process of your case without telling you anything. If I understood how it all works I wouldn't need a lawyer.

Good ones don't expect you to know how the legal process works; unfortunately, we get a lot of clients that think they know more than they do. They try to tell us how to handle a case so we get jaded about it. I'm not saying every client or that it is right but we are imperfect people working in an imperfect system trying to get the best result possible.

My sister hired an attorney to help get the retirement benefits from her ex-husband. This attorney literally played games with her. He didn't file the necessary papers. He used the courts to lie. Now we have file a grievance with the State Bar. He is lying to the the State Bar.His unprofessional misconduct continues. We will fight this vigorously.

No she did not, we filed 3 grievances with the Texas State, the so called investigator, and mind you he had to hire an attorney to defend him. The Texas State Bar sided with the crooked attorney because his father is a Texas Judge. DO NOT TRUST OR BE HOPEFUL OF THE TEXAS STATE BAR.

I had an attorney that treated me the same way. My son was killed in a auto accident that was 100% the other drivers fault. I was under duress . looking back, all I want to do is turn him in to the Bar. Out of principal. He definitely over promised and didn't deliver. In fact, he treated me like I was out of line asking questions about anything regarding the case. He said that the insurance company was only going to pay out 25,000 dollars and me being dumb about it, that's what I agreed to.

I'm having the same problem with my attorney. She would not file and kept requesting more money. She didn't keep me updated on the progress and kept asking for more money. I didn't have any more credit and then my sister got diagnosed with ALS. Now that my sister has passed away and I paid off the lawyer debt, I'm trying again. Lawyer is finding every way to blame me for everything.

Mine does the same shenanigans, and when the hearing I wait months for he is sick, on vacation or tries to settle by lying to me, things I would never agree to. Hiring him made my family law case a thousand times worse filing motions I never know about. I’ll be homeless by the end of it with his nonsense billing. I find out later he is friends with the opposition, and he bills me for calls, when I haven’t even spoken two him in months. At least 2000.00 a month in charges for absolutely abusing my finances, and my child, and even the opposite defendant attorney doing the same. It’s a 50 billion dollar a year industry just in family law. Nobody wins. They kids are damaged, and their future money or memories are now trauma of the court. Straight violations of our constitutional rights in every way.

last week my husband and I went through a terrible problem caused by the lawyers we had hired they forced me and my husband to accept a settlement against our will they threatened us with charging triple the amount if we do not accept the offer that the company had offered until now I'm very shaken by everything we've been through and we don't know how to make this complaint

When my lawyer first viewed my case, he was extremely positive that he can win this case and I will get my chargers dropped. But now my lawyer found out he is close friends with the prosecutor and now everything changed. He’s basically agreeing to everything the state wanted to offer me. Next time I should hire a lawyer that is in a different city. (First time convicted petty theft) no crime record. Under 200 dollars. And I was in medical school working as a teacher. It sucks I spent my savings and wasn’t represented correctly because of friendship.

We hired a lawyer and he told my husband that he would not go to prison the cops set my husband up on a fake girl everything they took from my husband his phone that was the only evidence they had on him got it back after his court the cops said they couldn't find anything on his phone are the secret service couldn't get anything off of his phone either and he was friends with the prosecutor he kept going back and forth to him and yo us I guess he was telling him what to tell us my husband had never been in trouble with the cops in his life he told my husband that he could get 70 years in prison if he didn't sign a plead of 3 years well my husband was scared so was I so he did he has already been in prison 4 years he took $10.000 dollars from us and my husband told him that he wonted to go to court and the girl and the mom be in court to but the lawyer new there was not a girl are mother so that's why he did what he did to my husband. He lied like a dog and he won't answer my phone calls are my letters and that's not right and now my husband has to be a sex offender when he gets out and he never done anything to no girl there the cops name on the paper where the girls name is supposed to be at and it has really messed my kids up and me to IAM disabled can't work about to loose everything we have because of that lieing lawyer we hired I wish I could get some of my money back from him for not doing his job right the lawyer told the cops that he wished he had more easy cases like my husband's case was and the put in the paper of what he got arrested on was old warrants that was a lie they put in the paper also I still have the paper I have it all so I wish I knew what to do and everyone is still getting friends request from him on Facebook and his phone is turned off I have people asking me is my husband out yet I tell them no and they tell me they got a friend request from him I tell them not to receive it cause it maybe the cops trying to set him up they may think he's out by now it really scares me and I don't no what to do my family won't help me

Personality is definitely important. The attorney who helped me with my social security disability claim for my autism was honest about the strengths and weaknesses of my case, didn't promise anything he couldn't deliver on, and told we what he thought my actual chance was of winning was. He also took the time to explain everything in a way that was easy to understand. Autistic people tend to be blunt and to the point, and we typically have a very low patience level for dishonesty of any kind. And because of my social limitations and attention deficit, I need things explained to me slowly and in unambiguous terms. After talking to him for a few minutes, it was clear he was the right attorney for me. And we won the case because of both his skill and our ability to work together. That was especially important during the hearing. My attorney made his opening statement. The judge asked me some questions. And then my attorney was permitted to ask me a series of questions to bring additional evidence to light. To prepare for it, he told me to answer any question honestly but to never volunteer information. I followed his instructions and, in spite of my social awkwardness, was able to do very well during the hearing. As did my attorney. But with another attorney it could have been a disaster.

I seem just fine to you? That's a brilliant medical diagnosis from someone who has never met me before. I think I will run with the opinion of the specialist who spent 6 hours testing me, another psychologist who also examined me, the jobs expert who literally said that there was no job I could do, and the judge who approved my claim. Not to mention the attorney who took my case based on it's legal merits.

@@theloanranger2632 The judge was Daniel S. Campell. Administrative Law Judge. The Vocational Expert was Cyndee Burnett. My attorney was Mark W. Manske. I was originally diagnosed with Autism Spectrum Disorder by Theresa L. Chinnery Ph.D. I was later examined by Thomas J. Speech, Ph.D. at the request of the Social Security Administration. After speaking with me for an hour, he gave a full report which outlined the numerous social limitations I had. I would suggest speaking to Theresa L. Chinnery first. She works at Thedacare Behavior Health in Menasha, WI. and is extremely adept at diagnosing mental disorders. She may be able to assist you with your personal problems.

My son is going through a divorce so he hired an attorney who promptly took his $5,000 and then proceeded to tell him why he was going to lose. He told my son that he had no chance at split custody or full custody, and he told my son because he was self-employed that a judge would automatically assume that he made twice as much as he claimed on his income taxes. My son had videos of his wife exhibiting violent behavior toward him in his attorney said he did not want to see them. He took a few phone calls from his wife's attorney and exchanged a few emails and came to court with him for about an hour one time then he claimed he needed more money. He was absolutely worthless and made me feel as if my son's wife had two attorneys and my son had zero. And the thing is it shouldn't be a complicated divorce because they really didn't have that much in the way of marital property. I feel as if this attorney stole my son's $5,000.

I don't know the terms of the client engagement agreement, but if I were your son, I would review it and a copy of your son's bill. Depending on your state, you might be able to request fee arbitration. Sometimes it looks like an attorney isn't doing something when they are, so it's essential to keep track of the costs with the bills they send. Also, they may require an ever-green retainer which means they haven't used all the funds yet but want to make sure the funds are there for when the attorney needs them. But, again, without knowing more about the situation, it's hard to speculate.

You go to work and when it's pay day government will take your money and do not care how men are living? Having kids in America is not worth it because the system is with the mothers and not the fathers. Women knows this scam and that's why many are getting pregnant just so that they can collect money every two weeks.smh it's a scam and we a know it.

My lawyer said a deposition is needed to see if we can dismiss the case but is refusing to do the deposition. My lawyer hates answering any in depth questions that provide clarity.

There might be a strategic reason why he hasn't done the deposition. I don't know the facts of the case so the best thing to do is continue asking your lawyer why they are doing what they are doing. If you want a second opinion, consult your local Bar association. They might have a referral.

My boyfriend and his dad panic because I came home to my boyfriend house. Who I live with for 13 years. Suddenly my boyfriend claimed I was his exgirlfriend file criminal trespassing and the girl he told me was his cousin, suddenly he tells the cops she's the girl friend and I went to jail over night clueless. I tried to tell my attorney he said I didn't live there. I hired a private detective and discovered the girl was his real estate agent. I told the state they said my attorney did nothing wrong. My boyfriend brought me back to his property tried to bribe me with property and death threats if I said anything. 4 years later their Rich and I got no justice

I hired my first criminal defense attorney for a misdemeanor & 3 months went by without a single offer from the d.a. He was by the hour & I truly think he’s in cahoots with the d.a delaying everything to squeeze more money out of me. He also over-billed me for time spent in court. I was in court with him for literally 5 minutes & he charged me 45 mins & he did the same thing all 5 other court appearances he charged for way more time then he was actually there. He was 25 minutes late to court today and then when he got there we were done 15 mins later and he charged me for 35 mins. It took him almost 3 months to send me an invoice of how many hours he put towards my case but by the time I got it he was way over the retainer fee I paid. 4 days prior when I asked he said he was getting close to using up the retainer money so in only 4 days he supposedly spent 3+ hours on my case that’s still being dragged out. He’s fired & I’m not paying his lying low life a** any more money. Never again. Now I need to find a new lawyer & I’m down $1000. Great.

After my last attorney, I swear I will literally shop around for an attorney if I ever need one again before signing with the first person. I sat down with my attorney, who had no empathy at all, and he didn’t like to explain himself to me regarding anything about my case. The receptionist would always say he would give me a call, but I would wait weeks and weeks, even months, and it wouldn't be anything until I went to his office and demanded to speak to him.

I had a lawyer who was also a chairman of a bank. Now he is a former chairman of the bank and the bank is being investigated by the police. He left importart evidence out at the trial and I got falsely convicted. The case was possible to win. I hate his guts.

I am suffering from Bipolar that has robbed me of work. I found an attorney, told him I'm unemployed, nearly homeless, and got denied. He is willing to take the case, but has asked me to mail documents to him. I don't have any money, not a dime. I'm worried that I won't be able to provide the documents. I don't have transportation, there's no public transportation, and he's about an hour away from me. What should I do? I can't seem to find a mental health service in my area, 211 is useless, and my caseworker is useless. What should I do?

My husband had a bad lawyer and had to let him go- problem is he won’t drop his fees and no other lawyer will take his case because the previous lawyer won’t drop his fee for a ssi hearing in a few weeks / awful

Man, I was very furtunate to find a lawyer who made me feel at ease and took charge while I recover. But I spoke to about 5 from the dozens I researched online extensively before I picked up the phone to make an appointment for a face to face. Good Luck to everyone

My court appointment attorney didn't get the sopenas that I requested, and she pressured me into taking the plea bargain, but she also lied to my face multiple times, she told me not to pay the bills for my wife because it doesn't go towards the child support, but my wife asked her sister to ask me if I could make the payment so I did but at the sacrifice of the child support payment, I also sent proof to my court appointment attorney that I was not the abusive one in my house hold, it was someone else that forced my family to live like prisoners in our own home, but she pushed me to take the plea bargain when I said to her staff member to get the sopenas so that I can go to trial and now I have a criminal record for being there for my children, my wife told her brother that she wasn't pushing for the charges it was the arresting officer, but my lawyer said that it was my wife how do i find that out for sure, also how do I get out of the child support payment since I have been paying the house payment for my children as well as the light bill, and I am now behind in my child support payment as a result, please help me. I am a Disabled American Veteran of the USMC, I can't physically work because of the service connected injuries, and this now criminal record, I have been railroaded in the court room and I am no criminal, I need help with this ASAP please. Right now I'm trying to find the paperwork to motion for the child support payment to be terminated and I will be getting a trust account for my children to do the same purpose. I already have a lawyer to help me with that I just need help to get the criminal record expunged. I also need help with my custody but I think I got one for that but I'm not sure yet

Can I complain about the lawyer if she didn't get the sopenas that I requested, and also I sent her staff the proof that I was not the abusive one in the household my family was forced to live like prisoners in our own home, we couldn't whisper in our own home, I couldn't close my bedroom door, he kicked in the door saying that the door stays open I had to protect my family multiple times

I’m sorry. Criminal defense work is outside of my practice areas. I wouldn’t know the first thing about getting something expunged. I would look for pro bono attorneys in your local area or see if a law school near you put on a legal clinic.

I won a case against Lyft, the rideshare company since April 2021. Now it’s January 2023 and I still haven’t received my check. Every time I call his paralegal, she tells me I’ll get it next month. My lawyer only spoke to me once in 2020 and hasn’t spoken to me since then.

Those are your funds and the attorney owes you at bare minimum an explanation as to why it's taking so long and where the money is. I'd definitely ask the bar for help as well as filing a criminal complaint before you lose out on the option of involving the police. If the attorney has taken the funds, that would be illegal and potentially a felony. The funds are supposed to be kept in a separate account and not used for any other purposes than paying the client. That being said, if the award hasn't yet been paid by the insurance company, the attorney should be explaining that to you and suggesting what court filings need to be made to force the issue.

@@SmallSpoonBrigade I received my settlement finally on January 3rd. But the attorney was very rude. He never returned my calls for three years. I finally had to file a complaint to the firm owner, yet the attorney never called back. It’s called arrogance. I’m glad I finally got my settlement. But I’ll never do business with them again. By the way, the name of the firm is Morgan and Morgan.

I was only told about a retainer fee $500 not $500 an hr to do not much. Been to court 2x on victim restitution case and third one in couple weeks. I provided him the crash report and my insurance. I could litigated with other party been done. Example I had I lady hit my car I called her and insurance and already got reimbursed. So why does he not know what damages are? I had full coverage so surely up to 50k property damage should be adequate. Rule I didn’t need a bad lawyer and could have done this with my insurance and them communicating with the other party.

What about you have been giving a court-appointed attorney who refused to communicate with you? And refused to subpoena records they knew for over 2 months you needed to prove your innocents. To find out that the same lawyer has the same last name as one of the public officers. Of the town. Participating in the behavior, you went public about. The lawyer drew from the case after I demanded she gets the documents! Got a new lawyer who has ties to the person who not only signed an agreement to not hold me account table for the illegal behavior but also terminated me. At my new job. When they won the bid at auction.

I got into a accident and the other party took full responsibility but it's taken a year for them to settle and I got a max amount of 20,000 but the attorney is taken 8,000 and I'm only getting 6,600 back and the rest is going to medical. There is so much more but that's what this issue I have at the moment.

We hired a criminal defense lawyer in Aug 2021 … this is Jan 2023 and case is just now coming to end. They’ve taken $32k…. We hired one certain attorney (so we thought) and now are on the 4th attorney! There was no defense given, they claimed to mail out a copy of the evidence to me and I never received it, the state made an offer so they made one counter offer, was told to take deal or go to trial after stating trial is not a good option then they called requesting $10k more for attorney fees! They refuse to give me our case file (after requesting repeatedly) they will not give us a breakdown of where the money went! COMMUNICATION… try months of no communication from them! They dropped the ball on several issues! There was a paper signed to where court appearances was waived so a court date was missed and incarceration took place! Come to find out if was a mandatory appearance and the lawyer NEVER reached out!!! The lawyer even told judge during arraignment it was on them as to why the date was missed! There’s too much to even address!

I am desperate for advice. I live in GA but had to file lawsuit against my Aunt in Indiana for stealing from my mom who died young at 59 from MS while I lived away. I'm on 5th Atty 8 yrs along because literally every single one has missed deadlines, weren't returning emails or calls and weren't keeping me up to date etc. ! I literally could have sued ALL. My last atty literally got half my case dismissed losing me over $500Kplus! And damages can be proven. The court of Appeals basically says this and local atty confirmed its sue-able. This guy that screwed me passed me off to his friend before I could even digest what he did. This new guy has just missed a big deadline also!! It is a $1.5 Million case involving family business stocks. I am sole heir because my brother died in accident. Lost all my family. Aunt took advantage. I am not a wayward. I am luckily middle class income well enough off on my own but being screwed over and over from out of state. These attys keep taking all my $$ and getting me nowhere. I am literally in tears. Feeling hopeless. How can this be EVERY atty out of 5 bad?? !! It is impossible to find a descent atty in Indiana...let alone one to sue another. Should I go to the judge and tell him what is going on? He sees that this atty just missed deadline and had to appear for request for relief. Everyone sees 5 attys and thinks it me... Unless they look and see all the missed deadlines on dockets x 8yrs. I even have this last guy on recording yelling at me for questioning why. He just left for vacay and left me in hanging with stuff due next week. I feel I need to act while he is gone. Do I alert the judge what is going on and that I feel like I am being forced to drop case due to so many bad attys? There is another $1.5Mill on line. I should NOT have to let my aunt get away with this just because I can't find descent atty.

I would see if there is a free legal clinic in your area. They can give you an unbiased opinion on the case and the next steps. I know this is tough. You shouldn't be treated like that, so I truly hope you can get the help you need.

This was really helpful for me and super reassuring. I have a lawyer right now, first one ever, not only didn't have any of these traits (except one I can mention in a moment) they exceed in all of the errors. The one quality I worry about is rudeness. Lots of the times it could just be that it's related to things I don't know, but I truly think he's rude to people or doesn't know that he is coming across like that. He responds to all of my comments near immediately since I started with him about a year ago. We have yet to work with the judge but one party has settled, and we have a settlement conference vs the other party end of next month. So far he has left me extremely satisfied. I could just have thin skin related to rudeness. Examples are things like "you need to pull yourself together" or telling me I don't know what I'm talking about as a few examples.

I want to start with the first human rights issue of abuse of me, the FBI experimental spraying of LSD in the Lexington Avenue line in Manhattan, NYC when my mom was pregnant with me in the early 1960s, and she traveled on that line. I have not been able to find an attorney so far for other human rights issues of abuse of me, normally attorneys just take a percentage of money from cases won and do not charge for lawsuits. I have a handful of human rights issues over the past decades, and I am now a pre-senior. I have not tried much to find an attorney they do not seem to care, but I am seeking now. Normally, there should be collective lawsuits for human rights abuses, and I do not see that, maybe it occurs sometimes . . .

The attorney was advised to hire an attorney here in Amarillo to defend him. They that attorney hired an investigator which turned out to be on their side. I got rear-ended on a red light, on my bday; the 24th of May, last year. I was going back and forth looking for lawyers. Some only wanted to do the property damage, while others wanted to only do the injury. Its almost been a year and my lawyer got me 1k. She said bc I wasn't going to enough chiro visits. As of rn, I got permanent damaged and I need surgery which I can't get bc I don't have any money for it. My lawyer even has me signing a paper in which I can't sue the young girl, nor her dad, nor the insurance company and I am not even allowed to speak about this w nobody. My car was totaled and I got 400 dollars for it and my back hurts and I feel like I got fucked over. I was w my wife in the car and her lawyer got her 25k for the same accident. How is this possible?

Given the limited information provided, it's hard to say, but bodily injury tends to be worth more than property damage. An unfortunate part of the legal industry is that most attorneys will only take a case with property damage. If I had to guess, and this is only a guess, your wife either had more apparent injuries or a better attorney. Unfortunately, unless there was fraud on the insurance company's or attorney's part, there's not much you can do about it. I'm sorry that happened to you. The justice system needs to be more just.

My lawyer for workers comp only spoke to me when I hired him and then 2.5 years later at a hearing and left his hearing reps to handle everything. He then got upset with me for questioning his charge and wanting a itemized bill to show what he did and then requested to release himself from my case so I had to find a new lawyer. New lawyer isn't very knowledgeable and has sent me a C&R with error 3 times because he doesn't proofread what has been sent to me. I am beyond frustrated. I went a full year with 0 money coming in even after QME report was in my favor.

My former attorney missed a deadline, resulting in a lien placed on my home. I gave him an opportunity to correct the mistake. He continued to bill me for his mistake and then demanded more money before discovering the conversation he had with the opposing attorney. Finally he said the opposing attorney said the deadline was met and the property lien was solely my fault. WTH!! I demanded he get proof from the other attorney, but he didn't like that. He said he and his staff worked on my case, so he said. One big problem if the opposing attorney did admit that he ignored the written request was that my attorney should had informed her she is in violation of the Fair Collection Act and demanded the removal of the lien. This wasn't expressed to me by my attorney he was only trying to deflect responsibility onto me. The bottom line he wasn't hired to defend a property lien. It became a property lien case due to his neglect.

Before the pandemic, when I went to update some information of me on one of my properties--the one I share with a relative, one attorney never got back to me, another attorney left important paperwork of mine in his copy machine that I had to remind him to retrieve. So, I did not utilize them. I called three more attorneys after the pandemic, all had their websites up, but their phones were disconnected. Another said they were not taking cases due to the pandemic even though it is almost over, and she referred me to another attorney that never returned my call. More than four years have passed, and it still has not been taken care of. It is due to the county I live in. When I called an attorney in another county, I was told that I have to use an attorney from the county I reside. I live in Upstate, NY.

Finding an attorney to represent you can be difficult, depending on your case and budget; however, there are legal aid societies and other pro bono assistance programs. I would recommend contacting your local bar association to see if they can refer you to someone.

I had a medical bill of $63,000 about 2 years ago. My lawyer told me he negotiated it down to $5,000 and paid in full. Then just yesterday I get a collections notice saying they want the remaining $58,000? My lawyer said it was negotiated to a lesser amount and paid in full? How does a hospital sell this debt to a third party after it was apparently settled? I'm not paying a dime out of my own pocket because the accident was not even my fault. It was some a-hole with no license and a DUI.

Without knowing more about it, I've had insurance companies bill people even though they've already been paid. It's typically just the right hand not knowing what the left hand is doing, and once I call, it gets taken care of. I'd give the insurance company a call and see what's up with it.

This was a motorcycle accident which I only received a $25,000 settlement for, in which the lawyer had to try get all hospital bills settled for 1/3rd of that (roughly 8,300 to work with for ALL medical bills). The life flight was the largest bill at 63k. The lawyer told me they negotiated it down to $5000 and it was paid and done. The collections notice I just received says something different. It says only a PAYMENT was made for $5,000 and they still need the other 58k. I emailed the case manager and they are working on it right now.

Hi I hired a lawyer for food poisoning, I bought a cantaloupe at BJ’s that they injected something in it and now I am taking pills, the lawyer firm agreed to take my case and then I finally talk to them and first he was rude, 2 he flat out tell me oh don’t put your hopes up you can’t be rich on this case the max you will get is $50000 and he said if agreed I will send the demand . And he was pressuring me. I told him how know why don you make the demand if they comes with amount then we discuss it and refuse. He said he will drop it. Please give me your intake on that.

I think attorneys should get paid only when case is done! That will force them to do things in a more reasonable timely manner. My 2 + year amicable separation would be trimmed down to 6 months. It’s insane how slow some of them are. I get they are swamped and I’m not only client but I’m at my wits end with the slowness. It comes off as lack of empathy.

My atty never checked with the court to make sure everything was on track until i called to inquire that everything was on track.....a couple business days before the court date. Well the guy never got served so the date got pushed back. Also, i believe they had the defendant mailed a notification and THEN sent a server. He wont answer the door. Why would they mail him, tipping him off and THEN send someone over? That only helps the criminal.

I had an attorney not call me back for a YEAR. When I finally spoke to him, he didn't give me any resolution. He just said I didn't go for medical help, when I did. I had a spinal fusion, and fell in a ditch on a in a supermarkets parking lot. I feel he took a settlement, and told me otherwise.

Typically an insurance company and opposing parties makes checks payable to both the attorney and the insured and banks won’t deposit it without both parties signing. You can talk to the insurance company to find out.

I think my divorce lawyer has joined forces with the opposing party. He has been working with them and has been misguiding me and pressuring me to sign over important documents like out of court settlement/divorce and now he wants me to sign over the title of my house before getting my settlement money. The decree says that I will hold the title until money arrives. First, I would say that it’s highly unlikely your divorce attorney has joined forces with the opposing party/counsel. Most attorneys are pretty committed to their side. We like winning. Second, I would address your concerns with your attorney. It’s possible that he hasn’t explained it correctly or that he forgot something. Third, if you don’t feel comfortable doing something, then don’t do it until you do. It’s much harder to unwind something than to not do it in the first place.

I was hit by a semi 2 years ago. The truck driver is at fault, which is stated in my accident report. My neck, shoulder and especially my wrist are damaged. I’ve had countless Injections in my neck, 2 epidural injections, prp injections and finally wrist surgery. My attorney and I have butt heads a couple times in the beginning. As soon as I say I’m looking for another firm, he blows up my phone asking what he can do to fix the situation. Now, we filed a lawsuit and my trial date is in August of 2023. I need a loan so I can survive during this whole process, which the litigation attorney said was not a problem. I moved in with my 77 year old dad out of state, I can’t work because my wrist is still injured, I’ve maxed out credit cards, etc. My main attorney is supposed to set it up for me, but he’s busy working on another law firm in a different state. The litigation attorney is trying his best, it’s been two weeks since I requested the loan, but I’m overall not satisfied with the main attorney. I feel helpless to the point I’m taking depression medication. I’ve never felt this bad in my life. I just wanted an attorney I could trust. That’s what I get for not researching enough and believing reviews on Google.

I'm sorry to hear about what you're going through. While I've never been seriously injured in a car accident, I have dealt with my fair share of insurance companies and medical staff that could seemingly care less about my clients' and my wellbeing. It's entirely possible that it's the loan company that is the delay and not the attorney. The most common complaint attorneys get are that they don't communicate with their clients enough. While that's partially true, the wheels of justice do not turn quickly. So, many times it's that the attorney doesn't have something to report so they don't contact the client to report nothing. When a client signs with me, I send them a welcome letter that outlines my communication policy, so my clients know what to expect and they have realistic expectations. I'm sorry that your attorneys either did not provide their communication policy or do not follow it. I hope you are able to find the relief that you need soon.

The legal malpractice cases I've seen have been "resolved" by the courts by accepting the dumping of the malpractice onto staff or a paralegal. Despite the Canon which places all responsibility for staff screwups on the lawyer.

Can you please help me, my 3 year old arm was broken at daycare. I found this lawyer in Tampa to represent him in the matter. He got 15,000 back for personal injury and then 10,000 back for medpay. I get a call last week saying that they made a mistake with the medpay coverage and that the max was 6700 that they sent a check for. I done sent emails letting them know I need to see copies of the check and the whole file and they have no responded back to me. I know the lawyer took 33% of my son medpay for medical bills but then lied to me that they sent the max benefit which was 6700. That’s not true this is a big daycare and I know the medpay covarge wasn’t 6700 it was 10,000. What can I do because now they with holding his money from me.

Threatened or actually withdraws? Nothing if he or she threatens to withdraw but if he or she actually withdraws you can represent yourself or hire a new attorney. If you choose to represent yourself you need to ask the court for a continuance. Typically though an attorney will not be allowed to withdraw that close to trial.

First of all, I had the audacity to think my situation was rare concerning attorneys dragging ass to get things done. Silly MEEE! This seems to be the "Norm". My attorney was right on time the first part of my case; I was Blessed with a greater settlement than was expected. A ruling was made and my cheating ex was ordered to pay support. He made 1 full month payment and a fourth of the next month. Next month will be a year sense he has not paid anything! We have to return to court because he is in contempt! The problem is the long drawn out time it is taking to return. I know that their have been several court dates open, but I never get any response from my attorney. My ex is getting away with not paying and my attorney has been paid in full! I'm still paying on the loans I took out to pay the attorney! Hell! I'm the only one AIN'T BENEFITING! from the situation!!🤬

THE JUDGE LIED ABOUT MY CARS VALUE EVEN THO I HAD PROOF FROM KBB THE FMV AND THE SELL VALUE THE DEFENDANT ACCCEPTED FAULT ON THE FIRST TRIAL AND THEN TRIED TO BLAME ME ON THE SECOND TRIAL THE WEIRD THING IS THE JUDGE WAS ALSO HELPING HIM AND TRYING TO BLAME ME EVEN THO HE ADMIT FAULT AND I SHOWED THERE WAS A WITNESS STATEMENT

Hi i had knee surgery after accident everything is done we are getting a check of 100k what is the best i can get after billing and attorney fee? And what if he cheats or makes a very low offer can i resist or call state bar?

It depends on the engagement agreement you signed, the expenses that were incurred on your behalf and any medical expenses not covered by insurance. It also depends on when the expenses and attorneys fees are taken into consideration. If the fee is based on the gross rather than the net then you will get less. I’m not sure what you mean by “low offer” because if you’re getting $100k then the negotiating is over and that’s the amount of your recovery. You’re entitled to a breakdown of expenses, fees, etc. and how they are calculated in California. Not sure about other states but here you are. The only time the Bar would step in is if there is fraud or some other malfeasance on the attorneys part not if it’s just an amount you don’t like.

Hi, Thanks for your reply....he said you will get 30k after everything i have signed on releasing documents soon they will get a check for 100k and then he said they will do disbursement. The malfeasance he did is he charged me 2500 hundred dollars to get me a surgery appointment because i missed it couple times before for some reasons i gave him 2500 got an appointment but I think it is unethical and illegal could he do that?

@@akshaykumar555 It's hard to say without seeing all the things I mentioned. As far as outcomes are concerned, if the surgery was necessary for you to receive the money and there was an expense attributable to the surgery that isn't covered by insurance, then yes, it would be reasonable, but I have to emphasize, without more information, my opinion is based on other cases and may not be applicable.

What do I do if a lawyer gives me bad advice? Iike my lawyer told me not to return my daughter to the mother cuz the mother was trying to take her outta state. So, I didn't. But when I went to court the judge charge me with contemp of count and I had to pay there lawyer fees. Also, he told me not to try to see my daughter cuz he talk to the judge and she said to him .. that I'm not ever going to see her cuz she doesn't like me.. I really don't know what to do..

I've been dealing with this sorry insurance company Gary Martin hays for about three years and they won't call me back they want they didn't do what I said they made deals without me I pressured me into taking the other didn't want what can I do about it who can I report them to

My family member has dealt with a lawyer that has been a year. In the beginning the paralegals consently was not getting bacl to them after countless phone calls. She got fired. They started with 3k and now it 28k. Please help

I am sorry to hear that you're having such difficult times with your attorney. It's hard for me to tell you what to do without knowing more about the case; however, I can say you should contact your local Bar association and discuss with them your issues and they will be able to point you in the right direction.

The best advice is: avoid situations where you need a lawyer. From my experience in 2 situations with labor law dealing with shonky employers, its just throwing good money after bad.

Help pls guys. My attorney since 2017 wont return my calls/ email for last 1 month and half and it happens pretty often. She charged us around 13k in 2017 and now it is pretty hard to reach our attorney.

I am sorry to hear they aren't returning your calls and emails. There could be a myriad of reasons. I would call their office and see if you can schedule a phone call. Sometimes they really are just busy. If that doesn't work, I'd recommend contacting your local Bar association to discuss your matter with them. They might be able to offer some insights.

Have there been instances where a personal injury attorney has colluded with an insurance company . Specifically the company for the party that's at fault. In my case there's no issue about culpability, I wasn't driving. I was trying to get in my car when it was hit. There were witnesses as well.

Is it possible? Yes. Is it likely? Probably not. Most plaintiffs' attorneys hate insurance companies. Insurance companies are the enemy. Also, when you consider that personal injury attorneys typically only get paid if they get a favorable settlement, it’s based upon a percentage of the settlement. The client’s interests and the attorneys' interests are aligned at that point. Last of all, we have a duty to our clients. Most attorneys aren’t willing to risk their license to collude with insurance companies whom they hate.

@@ThinkLegal Thank you. The reason I asked is my attorney lied to me. He can't come up with too many more excuses for his non performance in this case. One of which is quote "I haven't been to my office in a week to pick up my mail". No he's not I'll. It's just an excuse. I'm getting hounded by bill collectors for medical expenses. (25k) I have a small retirement income and can't pay them. I don't know why he's dragging his feet. I was done with treatment 5 months ago. I apologize, I'm just in a quandary.

@@biff5856 I’ve learned in life to never mistake malevolence for laziness. Unfortunately, it sounds like the attorney may just be apathetic. While I can’t tell you exactly what’s going on, I’ve found that *most* attorneys are good advocates. Some, unfortunately, are either lazy or inundated with so much work they can’t manage it all and things fall through the cracks. I’m not saying that excuses it, I’m just offering a possible explanation.

@@ThinkLegal thanks for the response. I gave him an out. I asked him if wanted to drop the case (maybe he just doesn't see big enough bucks?) He didn't. I understand the statue of limitations is two years. The incident was 1/11/21. It was egregious negligence on the part of the other party. I'm not a litigious type and don't know how these cases work. I sustained chronic vertigo due to my head injury, plus other complaints .What's not to like?

@@biff5856 has a lawsuit already been filed? If so, the statute of limitations is not an issue. If it hasn’t been filed, you still have many months for it to be filed. It possible he’s building a case and the more evidence the better.

You might have a case for ineffective assistance of counsel. I would consult with a different criminal defense attorney and a legal malpractice attorney. Depending on where you live there might be a legal clinic put on by a law school or legal aid society, they might be able to point you in the right direction. I'm sorry to hear that happened to you and I hope you are able to get the help you need.

Immigration send me the letter for more evidence for my marriage . I got a lawyer month ago .she said $2000 will be the fee I paid her in October. And immigration give the date 6 December. I’m calling her from 1 week everyday the lady ask for the phone number everyday and not call me back no response for anything. She have my paperwork. I said when you can give me the appointment she said the latest I can do is 13 December. And my paperwork have to be there before 6 December. She’s really giving me hard time for o responding. I don’t know what to do ? I really frustrated

Just because an attorney doesn’t respond, doesn’t mean that they aren’t doing what you hired them to do. Depending on the practice, they could be very busy. If they miss the date and do not get a continuance, that’s another thing.

I have a question dealing with a personal injury TbC case traumatic brain injury what's seizures after the accident in the facts is there the medical facts is there the doctors are in place can you get to the mediation settlement the first one and the second one and the defense side the insurance lawyers are trying to lowball and your lawyer is actually coercing you to settle for the low ball and when you don't accept your lawyer has an attitude or gets kind of upset change of behavior attitude first and second mediation settlements because of the low ball at this point you feel like your lawyer is not really in your corner pushing you to to take a low ball but at the same time saying it's too low towards the end of the mediation could this mean that your lawyer is making a side deal with the defense side or he's just trying to get a quick recovery money on his behalf please if you can answer your questions thank you very much

how about if your attorney was in front page of newspaper for ineffective counsel and the client was acquitted at 2nd trial then he past the deadline to file your entire defense evidence for a trial so you couldn't use any of it because he thought he was removed from the case but wasn't

I am going through a divorce and my trial is two weeks away. I got a letter today from my attorney's assistant stating March 31 st will be her last day and she is working for a new law firm April 1 st and will need a new retainer fee going forward with my case. She is young and I do not think she wanted to go to court and she never mentioned she was leaving. I feel she duped me.

Very true about the over promise under deliver. I’ve had several lawyers & the best ones always under promise & over deliver. Better yet the best ones are gonna lead you to water about what you have to do to win, but they can’t make you drink it. You gotta pick up on what they want from you.

I'm late to this, but yes, I second your analysis. It took me awhile to figure this out. I couldn't figure out why I had an attorney that was so highly regarded and respected, yet wasn't doing what I was asking. Every time I met with him, I felt utter confidence in him. I wasn't doing what he thought I should do. He didn't want to come right out and say xyz. It's a balancing act at times. I'm still in the thick of things, but I'm glad I stayed with him. He knows what he's doing and understands the law, I don't. LOL.
