Currently had an MRI done, and going to physical therapy, but the problem is persistent, and the light duty they gave me at work, isn't so light duty.

Im 34 now, when I was 18 I got jumped and my collarbone got stomped in half. I work at a tire shop and I get hurt a good bit. Today I got a tire (22inch rim) off a truck and it set the pain off. Just got an X-ray done and they want me to see a specialist again. It gets hurt at least once every week or 2.

Every state law is different, and even where there are similarities in the law local custom and practice can be very nuanced. It’s difficult to say what entitlements you may have according to your state law. In New York State, simply reaching maximum medical improvement, or being classified with a permanent partial disability, does not obligate an insurance company to make a settlement offer, but often times, it is the next logical step in many cases. Regardless of where you live, it helps to speak with an attorney who is well-versed in your state Worker’s Compensation laws to determine if a settlement is a viable option.

I certainly understand your situation although I’m not sure what specific question you’re asking me. The simple fact of the insurance companies fighting it does not mean you do not have a valid claim. You should certainly speak to an attorney who could perhaps help you through the system and quite possibly assist you in obtaining benefits.

The older claim in Alaska is going to stop TTD benefits (just started)due to California TTD. My question is can you receive total disability benefits for different body parts from different states? The answer to that question depends on a lot of factors. What finger did you injure? What is your gross average weekly wage? What is your overall percentage of permanent disability? Total loss of use of an index finger is worth 46 weeks of compensation. Total loss of a thumb is 75 weeks of compensation. Each finger has its own separate value. The hand is also valued differently. Those benefits are payable at the total rate of compensation which is 2/3 of your average weekly wage up to the statutory maximum. Told my supervisor about faulty equipment. Someone came and checked it out. They said someone would fix it. Hadn’t been fixed in weeks. I now am getting surgery next week for a torn ligament in my biceps trying to muscle the equipment. Would the fact they were negligent affect payout?

I almost lost my index finger and middle finger cause it almost got cut off at work, I've been with workers comp for 10months already and still have to see my doctor... My original job fired me for me following through with my restrictions from my doctor. And I did try to work but that only because I never had workers comp money and couldn't live just not working.. Do think I still have a chance for a settlement even if I worked? I have no control on my index tip finger ever agin
I hurt my hip pushing a hand working they denied the claim...been with company 34yrs ...is that normal on the first try...they say they are investigating it...i have xrays too..
I’m sorry to hear about your injury. If they are investigating the claim it is possible, they could accept it after they conduct their investigation. However, if an insurance company feels they have any defense whatsoever as a basis to deny claim they often times will. You should make sure you gather all the evidence in support of your claim. I would also suggest you contact him attorney for help especially if they going to deny your case.

There are many additional factors that contribute to an accurate value assessment. What does your lawyer think of your offer? Has the carrier raised the issue of labor market attachment? Were permanency examinations performed?
