The piece of music may be in the public domain but the composition/recording itself can be copyrighted. Copyright law is strange like that, but yeh noone should be getting dinged for an excerpt especially as someone could hear it, decide they like it and then go buy it for themselves. Also it seems that the whole thing is already available to listen to on RU-vid anyway.
