4:24 That mother is right to wait for all traffic to clear before crossing with her child. The new rules are wrong and create dangerous situations. As pedestrians are most vulnerable they should wait until the risk is minimised, meaning until all vehicles have buggered off.

I totally agree. The new rule sucks. It's ok if you're the only road user about, but put other road users in the mix and it's asking for trouble as very few are aware of the new rules. Plus most road users are oblivious to their surroundings at the best of times

@@shm5547 No, it's stopping pedestrians from being injured from poor drivers. You have two lanes that come to a junction. One car in one lane stops to allow a pedestrian to cross, then, as poor drivers do, they will blaze past in the other lane without realising what the car has stopped for, potentially hitting the pedestrian. As stated by @drumajo9598, a lack of awareness of their surroundings.
@Langwigcfijul
@Langwigcfijul 3 месяца назад
@@Robert-yw5ms And? You said pedestrians cause no danger. A car on the road increases the potential for danger, yes, but isn't danger in and of itself. Pedestrians can a do cause danger to road users too. A person who jumps out into the road without looking or thinking is a danger to a road user, or multiple, who just happen to be there at that moment. At junctions, vehicles should have priority. If you want to manage danger, have a dedicated crossing down from a junction where it is way safer for pedestrians to cross. In fact, have a zebra crossing down from there since pedestrians have priority at those crossings.

Highway Code rule 223 should be considered by cyclists as with any other road user. I'm biased though as I used to drive buses. From an environmental perspective, often a reason for cycling; when you help a bus driver you are actually helping social responsible people traveling on the bus to get to where they need to be. Buses are a win-win and when I cycle and help buses out I remember that I have done a journey with the magic number 100 load of passengers on my bus. Imagine having 100 people clogging the road up with cars then ask if the bus is a hindrance? or as I see them from an environmental point of view, allies!

Question about the lorry/cyclist. The rule is "At a junction you should give way to pedestrians crossing or waiting to cross a road into which or from which you are turning.". When the lorry arrived at the junction the cyclist wasn't yet waiting or crossing, so isn't the lorry correct? The crossing point is also between the white bollards, not where the cyclist stops. I'm all for the rule and will follow as a pedestrian, driver or cyclist - but there does seem to be a distinction in the wording that implies the person crossing needs to signal their clear intent to cross, not simply be approaching.
@smilerbob
@smilerbob 3 месяца назад
I beleive H3 and 211 apply here “You should not cut across cyclists, horse riders or horse drawn vehicles going ahead when you are turning into or out of a junction or changing direction or lane, just as you would not turn across the path of another motor vehicle. This applies whether they are using a cycle lane, a cycle track, or riding ahead on the road and you should give way to them. Do not turn at a junction if to do so would cause the cyclist, horse rider or horse drawn vehicle going straight ahead to stop or swerve” As this is a “shared use path” it is technically a cycle track for the purpose of the rule The question is, did the lorry driver know this was shared use and should approached more carefully or was it unmarked and the driver see no pedestrians and continue? Either way, if you haven’t been seen don’t continue into danger 👍
@DrDamn
@DrDamn 3 месяца назад
@@smilerbob I don't think they do as those relate to other situations. There is no path/cycle lane marked *across* the road. It looks like it's simply a junction where pedestrians and cyclists need to cross the road.

Highway code is irrelevant if you haven't been seen. That's why I would always give way to something bigger than me priority or not. If I am walking along a pavement and a car wants to come out of a driveway, I let them. If I want to cross the road at a roundabout exit/side street/busy dual carriageway when I am hopping over the central reservation I wait. Everything has priority over me. (Different matter if I am on the carrigway itself, but not when on the pavement.) Everything bigger than ones self has priority UNLESS the driver has STOPPED and clearly ceded priority to me.

Let's be real, nobody can be looking in two directions at once. If the truck driver is approaching the junction they will most likely be checking the right side first. Then they should look left and continue to check both directions. So, to expect them to be looking out for you personally as soon as you become aware of them is just main character syndrome at work. Put yourself in their place and think about what they are actually doing, not what YOU want them to do. Planning to proceed across a junction without slowing is just a prat move too.

See the first one, if the cargobike didn't go past the van then it wouldn't have lost speed slowing at the side of the bus. @4:31 - Why did the cyclist going straight give way to the oncoming Range Rover turning right? Seemed to just add to the confusion. Hard to tell if the pedestrians had any better chance to cross had the cyclist gone before the RR, though.
@misterflibble9799
@misterflibble9799 3 месяца назад
Well, only the cyclist knows the answer, but my best guess is that they weren't 100% confident that the RR driver wouldn't decide to go just as the cyclist crossed their path. Perhaps the RR driver might not be sure whether the cyclist has decided to give way to them. Perhaps the RR driver gets impatient about the cyclist not getting going quickly enough. Perhaps the RR driver is just selfish/incompetent. In some situations, if there's enough doubt, it's better just to get them on their way and remove the risk, even though you're supposed to have priority over them. I guess it's the same reason the pedestrians decided not to cross, even though the RR should have given them priority.

That's how I see it. At 2:27 you can see the driver has already reached the crossing point before the cyclist has. I see the placement of the crossing point as very deliberate. With the exit of the side road being a wide curve the crossing being where it is ensures that anyone wanting to cross can clearly be seen. Trying to start crossing where the cyclist wants to the view is partially blocked by the fencing meaning they are on the road before the driver would be able to tell.

While it was good riding of the cyclists to stop for the skip lorry surely by definition if the driver of the skip lorry can't see what's on the pavement they need to stop and check rather than just rolling round the corner onto the main road assuming there's nothing lurking behind the A-pillar? They could have stopped short at the junction at which point the A-pillar excuse wouldn't be there any more and they would have seen the cyclist. Otherwise we're just encouraging the "Sorry mate, I didn't see you" rubbish. It was good defensive cycling but complete nutsack driving by the skip lorry driver. Yes, the A pillar was covering the line of sight at the point you've circled it but that's precisely why the skip lorry driver should have stopped slightly further on (but before it got to the junction itself) to check the pavement now it was no longer obscured.

I'm a rather impatient cyclist (I'm working on it thanks to Ashley's videos) but I rarely overtake motor vehicles and always give way to them at junctions despite the recent highway code changes. However I did recently overtake a Mercedes driver after he went through a traffic filter (buses, bikes, emergency services only) then slowed down to 5mph for every speedbump he went over and accelerated to 30 between them. In my defence, no nasty looks, hand signals or shouting at the driver! Last clip - it annoys me when people don't know how to use a roundabout... there was obviously a vehicle coming from the right, if you barge into a roundabout like that you're gonna have a bad time.

When following a group of cyclist , what tends to happen is that when a cyclist usully in the middle of fthe group gets a clear view of a safe place to overake, they will wave you on. You ofcourse have to wait to see for yourself , but will be ready and position yourself for the overtake. Have nothing bad to say about groups of cyclists. On one occasion though as I came over the brow of a hill, there was a group of cyclist approaching me. SOme idiot car was overtaking them forcing me to do an emergency stop. If I hadnt, he would have been forced to move intothem, knock them off their bikes. I think the message about giving way to pedestrians crossing junctions just hasn't sunk in with most drivers. A lot of my local shared use cycle paths have give way lines marked across them at road junctions, which presumably over rides the rule about cyclists having priority and safer than having no road markings at all as in the lorry clip
@ColinSmith2001
@ColinSmith2001 3 месяца назад
In the current path design guidance most crossings would be set up to have priority to the path, and that would be made clear by white lining, coloured surfacing, or continuous footway construction. The old style with giveway lines on the path would not be used for most 30mph roads now but of course still linger on for the next few decades, creating a mixed picture junctions with almost random mixtures of intent and physical markings. And then you get ones like in the video, with no markings and even more open to interpretation. Cyclists and Pedestrians treating every minor crossing as though they have to give way is one option of course, but that goes against the intent of the guidance too. Ask your local roads authority how much of their network meets LTN 1/20 specs if you want some fun 😞
@shm5547
@shm5547 3 месяца назад
yes, those give way lines do override rule H3. They are a bit pointless though, because a driver is unlikely to notice the cycle lane has a give way marking. Also, those markings don't apply to pedestrians, so a jogger wouldn't _have_ to give way - they would technically have priority. The other point is these give way lines only apply to the road you are crossing. If traffic is on the main road and yet to enter the side road, if you emerge onto the side road before the other vehicle turns in, then you have priority. It's all a bit of a mess really.

3:31 The shared path is not marked, or apparently signed in any way, so may not actually be a shared path. Perhaps cyclist is just riding on the footpath. From the lorry's perspective, approaching the junction, he has no indication that he is crossing a cycle path, therefore no indication that he should give way to the cyclist. A cyclist on a footpath is not mentioned in the Highway Code, as the Code assumes road users are complying with its rules. Whilst I would give way to the cyclist, or at least slow earlier, if I'd seen it, that would only be to avoid a conflict, not because it had any priority. If vehicles are to treat this as a cycle path, it should be clearly marked/signed. If it is not a designated shared path, the bell warning to the pedestrians becomes rude and arrogant.

In the second clip, IMO, the cyclist should have given way no matter what vehicle was coming up to the junction. It's all about the timing. The cyclist had plenty of time to stop, as they weren't even at the crossing at the time the lorry arrived. The lorry wouldn't have time to stop, same with a car. Too many people use this law to just randomly step out/cycle out, no matter how close the driver of a car is. Often without looking and having ear buds in. There is absolutely NO way I would have just stepped out/cycled infront of this lorry. If I did, I would regard it my fault if I got hit. I don't want to be the person who is hit by a vehicle because the driver looked away for a second, and just because of priority in law. It's not about the law, it's common sense! Remember always, "STOP. LOOK. LISTEN."

First clip, typical cyclist not wanting to slow or stop for anyone. They could have held back to let the parking vehicle have the road space, but no. Then wants to race the bus, rather than letting it go. Cycling on the pavement, if permitted. Of course the bike should give way to peds and pass them at a slow speed. Also there are peoples houses along there, so someone could step out of their front garden onto the pavement. At the junction, of course the bike should stop and give way to emerging and turning traffic, exactly the same way a ped would do. It seemed 'my viewer applied his brakes at the last possible moment & was intending to just bomb across the junction as we saw him do, a little earlier at 2:14, where he made no attempt to slow, to check for emerging & turning traffic.
@RicardoPetrazzi

In some situations you have to think about what's easiest for everyone, and sometimes, as a pedestrian or cyclist, it's easier to yield your priority to a motor vehicle, purely because it's easier for them to get underway more briskly than you, and that keeps things flowing safely. Some pedestrians and cyclists are cognisant of this and build this in to their responses, even when they technically have priority. Again, it comes back to best flow for everyone and priority is given not taken approach, as well as what is safest in the circumstance. This, is where I beleive the Higwaycode is not clear enough in it's guidance and rules, as there are some rules which should really be situational guidance that people apply logic and common sense to, rather than rigid automaton-like rule following. Sound reasonable?

That shared path is crxp, too many dropped kerbs and uneven surface. Better leave the pedestrians alone. Just use the main road or the sidewalk on the other side if you don't feel safe and its empty. As for the pedestrians at the intersection unless the drivers are coordinated, better for the pedestrians to stay put and for the drivers to keep going than have mixed signals which may result in one driver clobbering the pedestrians.

I had the same thought about 4:10 under the 1.5m rule that was almost certainly an illegal pass, if any of the cyclists had a camera and wanted to make an issue (although this group seemed accommodating to all traffic) you could be facing a fine, which goes to show how daft the rule is on most rural roads where it is physically impossible to give the required 1.5m or 2m for a walker.

The simplest way to ensure this is to teach the child to wait until it is clear. The new H2 rules are way to complicated for small kids and waiting as the HWC says you should May undermine the lesson the parent is trying to instil.

The last clip with the roundabout reminded me of something that happened a few months ago. I was driving around a roundabout as a cyclist approached it. I drove past and he slammed his brakes on to stop. He then started shouting abuse at me for not stopping on the roundabout to let him pull out, even though he had the give way markings. He thought the give way to cyclists also applied when they were pulling out onto roundabouts as well. I then carried on around the roundabout and got a blast on the horn from an Audi who had to slam their brakes on and stop before pulling out onto the roundabout behind me.

@markwilson7013 3 месяца назад
@illegalopinions4082 I get where you're coming from, but to treat bicycles the same as motorised vehicles would kill them overnight in Britain. The increased cost to the DVLA and DVSA would be extreme, which wouldn't be covered by excise duty as most people would just abandon ownership rather than pay, and manufacturers wouldn't be able to afford to make the required homologation costs to get the 'vehicle' on the road. Now if you mean they should just follow the same road rules (as mopeds), without any of the licensing, certification or insurance requirements, then you're already treating them differently, but ignoring that it means cycle lanes and shared use paths can no longer be a thing (probably would make some happy tbf, but would mean cycles would always be on the carriageway with cars and other motorised vehicles). I don't think you'd be even allowed to push your 'vehicle' over a pavement, and certainly not be able to walk it through a pedestrian area. Personally I'd prefer to see VED scrapped (I thought that's where we were going with the introduction of EVs but doesn'tlook like it now) and replace it with a much reduced 'motorised vehicle registration', which only costs what it needs to cover the cost of running the registration scheme, rather than the extra being funnelled into general taxation, as I believe it's this which makes vehicle drivers say they pay a 'road tax' which bicycle riders don't and gives a sense of unfairness and a 'them and us' feeling. For safety, there are places non-motorised vehicles can't go, and for the same reasons, places they can go that motorised vehicles can't, and to change that would increase risk and danger for these road users. All that said, I think it would be useful for Ashley to do a series on what the different road rules are for cyclists compared to motorised vehicles (and maybe some that are the same that people maybe don't realise 😅) and the thinking behind each of them, as I think it would be quite informative to both groups, especially those that often flip between them both.

Yes, you are missing something - it's called Rule H3 (and similarly Rule H2 for pedestrians). You should now treat all junctions with a give way as if they have two give way lines. One that is giving way to the main road and an unmarked give way for the footway/cycle track. Whenever I approach a give way line, I plan to stop a few metres before it, check for any potential crossing pedestrians or cyclists, before then moving up to the marked give way line for the main carriageway.
