Excellant lecture with vast practical experience of Her Lordship in all her experience as Judicial Officer and Honourable justice. I appeared before Her Lordship in number of Trial Cases and in HIGH COURT Writ Petitions and Crl. Appeal with wonderful verdicts. This lecture is an eye opener in all respects. Thanks to the Honorable Justice and the host.
If there are 3 respondents in DV proceedings including husband, then asset and liability affidavit has to be filed by all the respondents or by just husband.
It was a great lecture. I am having few question can any one clarify my doubt. 1. When CPC is part of domestic violence act, whether Order 6 apply? 2. Whether evidence which were not pleaded is not admissible?

Q1. Why when making acts or laws by researching foreign laws, our law maker ignore gender neutral provisions, for example DV act was made only for women whereas most of the world has it gender neutral Q2: How can you say men don't experience domestic violence or experience very less violence when there is no official agency collecting data for the same? Police don't take complaints of husbands Q3: Why even consider maintenance in DV act when we already had 125 and hma 24, how many weapons do you want to give in hands of women? Q4: Why is DIR report never acknowledged or even verified by judges before granting interim relief in dv cases? Q5: Why is section 340, 344 not used when it's proved that complaint was false Q6. Why don't the Constitutional bodies speak for the least, MISUSE clauses in the Acts meant to protect Women's rights? Q7. In a recent survey by National commission for women it was found 74℅ men are harassed, which they later deleted. Are judges aware of the changes in ground realties that men face far more domestic violence compared to women Q8. Don't you think Narco Analysis test and lie detector test should be made compulsory before framing of charges in court so that no innocent man and his family suffer? Q9:Is child abuse by mother covered under domestic violence? Q10: Where should Sushant Sing Rajput should have complaint if he was facing emotional and financial abuse? Q11: If in 98% of the DV cases men are found innocent..... Then why court don't make the scrutiny parameters stringent to filter these cases upfront? Q12:How is this justified that in almost all cases women ask maintenance even if she is well educated and able bodied Q13: are we not hypocrites..... On one side we talk about women empowerment... And on other side we encourage maintenance?
Sir, Respectfully differ on few points 1. don't you think it is very biased against men ( it seems like every man perpetuates hardships on women ) 2. the Children access is denied to fathers and women ( More lately in Y2K era where they work in all fields and earn equally & men play a equal role in family ) 3. Many women are encouraged with maintenance, i find it contradictory when case runs for 5y how did she survive is it not the judiciary that is costing women than the man 4. Children are used as tools of harassment against fathers. we accept the suffering of women, it is time to you hear the cries of men as well against false cases and adverse selection towards maintenace.
If it is such a Beautiful Law, why not make it Gender Neutral? What's the law to protect Husbands, Mother In Law, Brother, Sister in Law, Sister, Brother In law against Domestic Violence from Wife? The very premise of "Patriarchial" Society where we have had WOMEN Prime Minister, President, Chief Ministers, Judges, Doctors, Engineer, Politicians, respected Teachers, is the biggest lie we have adopted from the Western lieing society? If we really wanted to save families, we should learn from the society which has lesser Divorces isn't it. Western countries have alarming divorce rates. Why are we cheating & misguiding the honest hard working Indian married couples especially wifes. Very soon people will be scared to have a Son, with such rampant man bashing laws.
