as a lawyer myself, I feel all lawyers must be compulsorily made public defenders for a particular period of time. like 1 case every 2 years or so or they won't be accepted as lawyers.

I'm thinking of going into criminal law and I'm not sure whether to be a prosecutor or public defender. Now I see that defenders make less, so... yeah. Mind elaborating on why it should be compulsory? I'd love to hear your insight, and any advice you might be willing to offer.

Aren't law firms required to do a certain number of these cases pro-bono? Doesn't that help the situation?

You mean like how doctors have to do housemanship work at public hospitals? It could work. That way we could have more lawyers and less burden of work per-lawyer. But will this increase the cost of public spending to hire all those lawyers? I mean is it practical? I look up on WHO statistics that in the USA there are about 2.54 doctors for every 1000 patients....so I guess for starters there need to be a study on the efficient ratio of lawyers per population.

there aren't many public defenders out there, it's a huge problem, and the general public needs lawyers. making it compulsory will help the current public defenders develop a good career for themselves, as well as bring in the top notch expensive ones into the system.

Which has started to prove out in California. We have Jails that are no longer packed and I think they are no longer looking at building new prisons.

Eh, I've heard both sides of the story. Just to be a devil's advocate I'll try to provide a reason for the other said. When people were on drugs such as marijuana, crack, etc. they do really stupid things that can cause the death of others. For example, smoking marijuana has caused a couple(s) to forget their babies in the hot car and allow them to die. Sure, alcohol and smoking also kills, but that doesn't mean we should let more become legal. Plus ever heard of those stories of how people have gone broke and homeless from wanting it all for drug money? According to Adam, the prices of illegal drugs are lower than when they were legal, so they must REALLY spend a lot in order to go broke. Hope that made sense and was a good counter. Personally I don't really care since I will never even drink and don't care if Bob down the street decided to do too much drugs (even prescription) and died, as it was his fault.

OK, that's fine... but you are ignoring the actual crimes, and looking to punish as to what you see is the cause. There is already laws on the books that work. Child endangerment/neglect. Various homicide related charges could be imposed in that particular instance. What doesn't work is the pay for play law system, and the fact our corrections departments are literally being rewarded to keep people locked up longer. So by stacking crimes on top of one another including drug charges, gets the defendant more time. Coupled with the fact that many laws have been passed that double your time just for being high while committing the crime. How is that logical, ethical or fair? Have we forgotten that we as a nation have separated ourselves from that kind of barbaric justice? Do we have to define "unreasonable" or just keep it vague so a judge who's having a bad day, coupled with an overworked public defender can make sure to lock up any undesirables and get them off the streets.

Then you punish them for negligence (with the baby thing) not smoking weed. Look at booze. It causes a LOT of car accidents but we punish people for drinking while driving instead of just for drinking.

To those asking about why do people become Public Defenders, here's the deal. Most people become public defenders for 3 reasons. 1. They genuinely wanna help people 2. It looks good on your resume, especially if you have plans to become a Judge or run for office 3. You can't get another job. Of the three, 1. is obviously the rarest. Most people treat this office as a stepping stone. Being a PD would actually be a really great job, if it wasn't for the mountains of work and the crappy pay. PD gives you good exposure for being a lawyer. You get significant real world experience, and find out how the system actually works. However, for most people its not 'worth it'. And sure, private firms have similar work crunch. But tell me. Would you rather come home at 2 AM in a Mercedes, or use the subway? Source: Law Student who grew up around lawyers

Yashendra Shukla My moms a PD, for the most part her and all her friends only work there because there's no better options. Being a Lawyer sounds fancy and all, but it's actually super hard to find a job especially for new lawyers. Most of e ones I know ended up opening their OWN firm. I do know one lawyer in Arizona that loves it though.

Yyyyep. Because "tough on crime" looks good to voters and "funding the defense of people who may or may not have done anything wrong" doesn't, for some reason. When you think about it for a second, of course there's a conflict of interest, and we could change it if enough people paid attention. But that won't happen any time soon.

I think the Court System should implement a policy where all lawyers must do at least one public defender case for every 7 or 8 private cases. Idk though, I'm not educated in law.

You can't really forced people give their best. Forcing lawyers might make public defence worse off, where the lawyer prioritise his/her private clients and give less effort to public clients.

So you would like to steal peoples labor from them and force them to pay for someone else's screw up (defendants or prosecutors). If you do that you will also take reduce their ability to pay their student loans and ability to take care of their families.

In the US we believe survival of the fittest is something to strive for. Why provide healthcare to everyone, if you can’t afford it you deserve to get sick and die. Why provide access to affordable education when we can charge out the ass for it with debts that never go away. Why provide access to fair legal counsel when we can reserve it for rich people. Heck, in Arkansas you have to pay a couple hundred dollars to apply for your free attorney. If you can’t afford it then you can pay the state back with interest.

There was an open letter put out by a public defender- because there's a sort of prejudice that if they were arrested, they're probably guilty, their task is so much harder than that of the prosecution. There was a case where the prosecutor deliberately ignored evidence that didn't fit their story, and the defense simply didn't provide information that they didn't have, which would have made their defendant look guilty (remember: one side was outright lying, one side just didn't know). The prosecutor got a slap on the wrist, and the defender was nearly disbarred

Ciara.Chaya Oh that prejudice is definitely there. The jury suggests tot he judge what they think, and the jury is only made up of everyday folks. We say innocent until proven guilty but most regular people think "well he wouldn't BE here in the FIRST place if he wasn't guilty of SOMETHING."

you've got it wrong this is the US in a nutshell: Govt: we created the problem but are tricking you into thinking it's the companies that created it and we have the solution, just give us more money. Citizens: *pays higher taxes, giving more money under threat of jail time* Big Companies: *gives money to select officials to get loopholes in new cost-hiking laws to exploit* Small companies: *are royally screwed through all of this* Govt: "our solution didn't work but we have a new idea that will we just need more authority so we can *make* it work". Rinse and repeat.

I had to sit in on several trials and cases as part of my high school graduation requirements. It blew my mind though, when I saw the same defender for like thirty different people. Sixty cases that day, and only two defenders. I felt bad for one of the guys too, because he had misunderstood the terms of his client's sentence, and was arguing a moot point for about five minutes. They're way too overworked.

As a Brazilian Public Defender, I have to say that we face some very similar struggles here as well (understaffing, excess of cases etc.). As a difference I'd point that the Public Defender career in Brazil is very hard to join, requires previous practice and it's quite attractive financially, notably in some States. However, the overall funding, especially when compared to the Prosecution costs, is ridiculously low: in the Federal level, for instance, the Public Defense annual budget corresponds to 0,5% of the Prosecution budget. Still, it's a career of many personal achievements and that can truly provide a sense of accomplishment and social relevance.

It's because those lawyers are state paid and private institutions will always make more money because of that. State budgets simply do not have enough money to pay public defenders 100k a year or more

And nowhere in the constitution does it say that attorney needs to be top notch and paid 100k a year or more. You're acting as if the right to an attorney is not given with this system. You'd have to increase taxes immensely to fulfill your insane ideas.

@@Sr_Sinful or cut spending elsewhere. it would also incentivize investigations into potential fraud in the welfare system. Folks not in legally who might be collecting or people able to work but are gaming the system would be cut off saving the funds that can be reallocated to bringing on more public defenders. even with current pay levels, what they really need is more personnel to deal with the caseload

i sat on a jury last year. the lawyer for the defendant was terrible. He failed the defendant and was sent him away for 5 years. If he had a decent lawyer he would be free. I honestly believe that.

It boiled down to she said, he didnt say. You can only vote on the evidence in front of you. So we kinda had to convict. If he took the stand, he would have created doubt and that might have freed him. He can thank his crappy lawyer for that, literal, injustice.

For all you know, the guy was actually guilty and terrible on stand so the lawyer decided against it. Kinda unfair for you to judge without knowing much about the conversation between the lawyer and the defendant.

Im sure that is a reality in many court cases, but for the one I was involved in, all (ALL!) of us jurors made fun of the defendant's lawyer for amateurish tactics and just sucking at his job.

The public defender shortage is crazy. The first thing to ease the workload would be being less hard-on-crime-- make less victimless crimes crimes, and allow the ones that are to have lower sentencing so that there's less on the line. From there... someone suggested below making all lawyers obligated to taking on public defence cases sometimes... of course you'd have to limit that to criminal trial lawyers, not all lawyers, but there's something there. Mostly, though, what needs to be done to fix this in the long run is to put more money in the system. Pay public defenders at least as competitively as public prosecutors. Make more people want to be public defenders, do cases on the state's money rather than the clients.

Legislate private firms to chip in to help. Institute certifications (assuming there aren't any, I don't actually know) that require new lawyers to spend so much time training in public defense.

+Goabnb94 Or we could get rid of a lot of legislature that raises rates of imprisonment and costs of the judicial system (drug laws, prostitution, and gambling for instance). Lawyers already have to pass the bar and go to school, it shouldn't be up to anyone but them where they work. I would be okay with more funds going to public defenders, but taking away the freedom of lawyers forcing them to work as public defenders isn't the right solution and may end up harming the system. Why would you want an inexperienced public defender that doesn't want to be there?

I agree that inexperienced lawyers being forced to be public defenders is a bad idea, because of that. I would support obligation to all lawyers to ease the load of public defence-- but only as a temporary solution while the other more important things are dealt with OR if all the other things are implemented and there's still a lot of strain on the system that needs to be eased, still. Requiring criminal defence lawyers to do a few cases a year would be fair-- I'd give them some incentive to do their best before asking such a thing, of course. Make it a tax deductible or something.

Make the overpaid prosecutors fill in on public defense. Perhaps if they understood what the other side had to deal with, they'd be overcharging less and prosecuting less.

Not to mention that normally a case doesn't go to court unless the prosecution feels that they will most likely win. Prosecutors don't like wasting their time with cases they will probably lose. So a defender usually stands little chance of getting his/her client from going to jail. It's usually more about damage control, getting the client a ten year sentence with a shot at parole instead of a 25 year sentence without parole.

You would remove something because it's out of style? That's just wrong. I could imagine removing carpets because they're messy and hard to clean, or popcorn finish because it's rough to touch and falls apart, but to remove wood panels cuz your neighbors think it's less modern than their walls is ridiculous.

Jones Crimson+ We're planning to remove our carpets and replacing it with wood flooring, otherwise selling our house would be far more difficult. So yes, when you try to get other people interested in something, style does matter. It's super annoying. But if you don't plan to sell any time soon, removing something you find to be "old fashioned" to make it look "better" is a matter of opinion, and not always based on how others might see it.

Since Public Defenders are paid by the state, private Lawfirms will always be able to pay better. So there will always be more private lawyers than public defenders. The only way to fix this issue of not enough Public defenders is to get people to stop committing crimes and suing each other for pretty much everything.

For anybody that doesn't know, if you're ever charged with a criminal act and can't afford a paid lawyer, your best bet is to try to plea the charges down and plead guilty to those even if you didn't do it. In most cases you don't even get to meet your public defender until the day of your court appearance so there's no real way to build a defense. You can try to get a new court date, but if you're sitting in jail it could be a year or more before you go to trial. That's a year or more of your life gone when depending on the charge you could have been out in a month or two. There's no incentive to try to prove your innocence if you're poor.

My state doesn't have private prisons, but our public defender system is so underfunded they often can't meet their legal duty and are in perpetual crisis mode and often are reduced to doing triage

And on top of everything said in this video, I remember listening on NPR that the public defendant situation was so bad that a few states had order a few private law firms to take on public defendant cases. They were ordered to take on pro bono work because of the shortage of overworked and over stretched public defenders.

Well most people become public defenders for 3 reasons. 1. They genuinely wanna help people 2. It looks good on your resume, especially if you have plans to become a Judge or run for office 3. You can't get another job. Of the three, 1. is obviously the rarest. Most people treat this office as a stepping stone.

I’m a private attorney. I know several PDs. Many of them are incompetent; and others are honestly the best attorneys I know. The system is built around plea deals. It’s basically taken to be a fact. The truth of the matter is that if all people took their cases to trial, the entire system would collapse. If all people pursued their due process rights to the fullest, everything would be backlogged for eternity. In other words, everyone CAN’T have full and vigorous representation in criminal court. If they did, no system would exist that even closely resembled the myth of Due Process. What you get is the choice of representation, which may or may not be good. But “justice” can’t wait for full and good representation of everyone. Some people benefit from The fact that others simply can’t afford “justice.”

Here's some things the video *doesn't* mention: - Private attorneys don't prosecute criminals cases. They can do criminal defense. So remember when the video mentions that public defenders take on over 80% of the criminal defense work? Assistant district attorneys have to prosecute 100% of criminal cases. If PD caseloads are enormous, it's even worse for ADAs. - Prosecution is generally funded more than public defenders. True enough. Bear in mind, prosecutors have to prove *every* case beyond *any reasonable doubt*. They shoulder the entire burden of a case. Defendants have a constitutional right not to have to do a damn thing... the case must be proven by the prosecutor. So, yes, they need more funding for investigations, hiring expert witnesses, etc. Oh yeah, and remember the caseload thing? Prosecutors have *way* more work to do per case due to the burden of proof. - If a public defender is somehow stretched too thin to provide a constitutionally adequate defense and a conviction is obtained thereby, the conviction can be set aside through an appeal alleging ineffective assistance of counsel--enough if the defendant is guilty as sin. If the claim of ineffective assistance is missed on appeal, the conviction can still be collaterally attacked through a habeas petition. The system bends over backwards for defendants, make no mistake. It's not perfect, but our laws ensure the Sixth Amendment is scrupulously honored. I could go on, but really, cry me a river. Prosecutors are also paid beans compared to private attorneys and they have to work harder than the defense side to do their jobs proficiently. It's a sacrifice for *both sides* to work in the public sector. The deck is *not* stacked against the defense as this video would have you believe.

as someone who has had experience in a public defender's office in california it is not that bad but we need more people. It largely political. DA's get bigger budgets because politicians want to be tough on crime and not to appear that they are helping criminals. As for the salary, it is not that bad. Not great like big law, but not bad in CA. However, in some states it is horrendous. I think in Oklahoma they start at 33k. Keep in mind most law students graduate with 100k plus debt. Going to back to big law vs. Public Defender, I have known quite a few attorneys who ended up coming to a public defender's office from a big law office because they hated big law so much. Think 80 hours weeks, only half of which may be billiable, and these billable hours are what will advance you in the firm. Additionally, most big law firms require 2000 billable hours minimum. Do the math. In terms of experience, public defenders are some of the best lawyers in the county, and we always try our best to represent out clients interests.

in this episode, adam said that in some states, jurors are paid as little as $4 an hour. I WISH! I was on a jury for 2 weeks, on a murder trial with 2 defendants with different charges and their own lawyers, and we got $12 a day. That's about $1.50 an hour, plus we had to pay $8 a day to park.

***** Perhaps a computer could make that piece of paper draft....but in practice a lease document have so many stuff that computer can't make. I had to design the draft, include variation of local laws, addendum, moral clause and stuff....then discuss with the landlord & tenant before the final draft, put legal stamp and stuff...but is not what I'm trying to point out. The point I'm trying to say is that the simple process of even a lease agreement took hours if not days to go through all the process---with or without modern technology....so if a lawyers have on average only 12 minutes per client, how could they ever do their job? My own personal experience, more or less support the point of this video that the public defender system is screwed up...it doesn't work.

If you're comparing the prosecution to the defender, the staffing gap is usually bigger than the wage gap. If you're comparing them to private firms, then yeah, wage gap, but a large portion of lawyers aren't even capable of getting jobs at major firms because the job market is too competitive and the firms are picky.

some lawyers do it at first to get experience so they can be hired by bigger law firms. others do it because of passion. it really depends on the individual person

Because it's an easy and secured job if you can't find employment at private firms. It's like how people with graduate degrees in physical sciences can at-least find a bunch of work being a High School science teacher since they're in such high demand, if they didn't find luck in getting a job in academia or research.

To be fair, public employees make less than their counterparts in pretty much every other industry. Workloads ARE typically lighter, standards are laxer, and job security is beyond compare. People willingly sacrifice higher pay for all these benefits, not just out of the kindness of their hearts. The majority of cases that pass through most courts in the US are relatively minor; traffic tickets, parole violations, misdemeanors, etc. It's not surprising that so many of these cases get so little attention, considering that ~90% of criminal cases in the US don't even go to court (the defendant pleads guilty/no contest).

I could be wrong but I think some states actually do require lawyers who've passed the bar to take at least one pro bono case per year.

seamorgh21​ well, lawyers are considered the best by their success rate, and the best get more money when they do get paying clients. It's not in their interest to flop on their free cases. And if they don't want to be working occasional free cases, they don't need to be lawyers. And of course cases should be assigned based on the type of lawyer. Thanks for recognizing my genius

For a criminal case, it is much easier to defend than it is in civil case as the jurors must declare that the defendant committed the crimes beyond REASONABLE DOUBT which is basically like a unanimous decision. If the state helped fund the defending side, we would be seeing a lot less defendants sentenced.

I don't know that prosecution and defense SHOULD have the same budget... I mean, think about it... They are not at all delivering the same product, nor do they have the same expenses.

I would say that the defense is in some ways more important. Prosecution has people gathering evidence for them, has authority figures that will testify for them, and should have strong case before charges are brought before the court. The defense's job is to make sure innocent people don't suffer needlessly.

Since I have been through the Justice System numerous times with a public defender, let me set this false video straight. Public Defenders work for the State, and will always try to get the minimum sentence possible, guilty. They will not try to get a not guilty plea. That's why it is screwed up. Truth 101.

you lie, public defenders are some of the most anti state people i know the job pays so badly that people who end up in public defense usually do it for ideological reasons, also know in law career as "believe in due process". in other country the public defense system works just fine with some of the best, better trained professionals among lawyers

AlabamaJRB tax payers and guess what, the state have no interest in arresting people, it is waste of money and prossecutor are not payed to lock people up, but to assure due process and to achieve "juridical truth" without public defense offered by the state, people would be thrown in prison for the lack of due process

Neither of those are true, Steve Jablonsky famously composes these songs and they are not royalty free, nor did a company like EA source royalty-free audio for their series of AAA video games. Either they're stealing from a source they assume nobody will notice or they've paid to use these tracks.

In the episode of Adam ruins guns, a defendant was given 20 years for killing her husband who was physically and mentally abusing her. Anyone who knows murder and voluntary manslaughter would have argued it's a classic case of loss of control which falls in the definition of voluntary manslaughter and based on first offence it could be 1-3 max(less if parole).As well it can even be reduced to self defence.
