The Supreme Court heard oral arguments on Feb. 28, 2023 in two cases that will decide the fate of President Biden’s $400 billion student debt relief program.
In this excerpt from the proceedings, Justice Samuel Alito asks U.S. Solicitor General Elizabeth Prelogar to explain the "fairness" of debt relief.

And I’m not sure how fairness is a question…. The question is it legal or not? And if you read the act of Congress that they used to do this, they were completely within their legal rights. This type of action was authorized by Congress. And someone brought up. How is it fair to small businesses like say a lawn care business, well… or PPP loans being forgive fair to W-2 workers??

It's fair by being unfair. Why is it fair banks get a bail out but the people do not. Why is it fair that employers get 100ks of loans but people only got 2400. Why is it fair that someone qualify for x benefits but others don't.

She is as sharp as many other lawyers who argue before the court, and has to be otherwise she is not fit to be a solicitor and argue on behalf of the government. Good lawyers and advocates must be prepared to answer tough questions and they do research beforehand on them, and they have a team behind them assisting. In fact, she got really lucky to be appointed Solicitor. She has had the right connections and the democratic party has plans for her. All you need to see is to whom she had clerked for. However, having said that, she is not fit for the supreme Court yet. She has to become a judge in one of the circuits first, and build a reputation of being an independent judge.

​@@Lints77 Elena Kagan was never a judge before her appointment to the court. Instead, she served as the Solicitor General under the Obama administration. Therefore, I disagree with your suggestion that General Prelogar needs to be a judge first.

Why am I paying for social security I will probably never receive? Why should I pay the same property taxes if I don't have kids who go to school? Why did big businesses and big banks get bailed out when they never do that for anyone else? Why shouldn't all Americans be mandated to join the military to buy their right to enjoy freedoms and right to vote just like the men who fought before us that provided that for us today? It's never been fair. We evolve and things change. That's the way its always been.

The question of fairness is not even relevant regarding the legality of the executive order and the standing and merits of the case. What is going on with SCOTUS? What damages and injuries have the plaintiffs sustained bringing this case before the court? Let’s answer that.

justic your completly right, why was it fair for people to get snap benefits before there was such a a program, why was it fair to bail out wallstreet and the weathy in 2008, why is it fair to give the wealthy tax cuts tax loopholes and why is it fair for political leaders to work for the wealthy. when there mandate is to do right by the people they are meant to serve. Simply put programs have to start out someplace at some time, it is high time we act..... mic drop

@Denise Harris What's disgusting is the president doing an action he has no power to do. Also, I don't care about those people because they signed a contract and read those terms. People like you think money is free and continue to print it to make these fantasy changes without understanding how money works because you never had it. And suddenly cry about inflation or a recession. If you want this funded, so badly tell your democratic buddies to stop funding other countries and funding the war in Ukraine.

She was so patient, logical, and articulate in her responses. It must be very difficult for her not to be condescending in the face of such a dumb question delivered so inelegantly/rudely by a dawdling, old man probably seated in an adult diaper of his own filth. Prelogar is a better woman than I am. I admire her and I hope she is victorious.

Alito's argument is akin to why is it fair to those who were drafted that we stop implementing the draft. It's not fair, in the simple sense that some people won't have had the life benefit of not being drafted. But that doesn't mean that it's not fair to stop the draft. Just as much as many baby boomers have pension and social security, and unfairly, many people younger them have no access to pension and may not have access to social security in the future. By his logic, we should stop social security for current beneficiaries, because future ones may not have access, because it would be unfair to the future beneficiaries compared to the current. It makes no sense. The world changes. Just because you were abused doesn't mean we should abuse future generations.

@@x-men69-96 Nope, my point is the hypocrisy: PPP were meant as loans to keep America afloat, but a huge amount of it wasn't paid back. And who profited? Wealthy folks. And no complaints from the GOP. Now a smaller amount of money than the PPP program could benefit the American economy by putting it in tens of millions of regular folks' hands (and bear in mind, this IS affordable in the US budget), and the GOP is talking about how unfair this is. Many of whom personally benefitted from six-figure forgiveness of loans themselves. If this goes through, it's going to help speed up the economy the same way the GI Bill did in the '50s, by giving ordinary folks more money to spend in that economy.
