This should be the end ot it bearing in mind that she was definitively convicted of the criminal defamation, on appeal, back in 2011 by the Italian Supreme Court. Let's be clear about the offence for which she was convicted. It was not simply slander but effectively perverting the course of justice. She accused Lumumba of the murder, effectively as a credible eye witness who was there at the time it happened. The offence, specifically, is laid out in Article 368 of the Italian Penal Code. The Article states that "anyone who with a denunciation, complaint demand or request, even anonymously or under a false name, directs a judicial authority or other authority with an obligation to report, to blame someone for a crime who he knows is innocent, that is he fabricates evidence against someone, shall be punished with imprisonment from two to six years". And that is what she did, 3 times - in two signed statements (made 4 hours apart from each other and during which time she was not questioned) and in her Memorial. Logically, had she been there at the time then obviously she knew Lumumba was not, and thus innocent. If she was not then obviously she knew she was fabricating evidence against him as the murderer. Guilty as charged either way. Knox told the Appeal Court that she had been coerced by the police into falsely accusing Lumumba of the murder. She had not said as much before. There was no evidence of coercion she had offered at her trial or even in her book. Her claim that she had been cuffed a couple of times was disputed by the 3 police officers and the interpreter present. She was not interrogated for hours on end. The genesis of the accusation appears to have been (according to her Memorial - written when she was not being questioned) flashes of blurred images in her head and an “idea”, or perhaps a flash of inspiration? And in the Memorial she said - “ And I stand by my statements that I made last night …..” The reason this has rumbled on for so long is because Knox will not let it lie. She went to the European Court of Human Rights alleging that her human rights had been violated. The ECHR ruled that she should have had a lawyer present with her during her interrogation ( a fact which the Italian Supreme Court had already accepted, taken into account, and ruled on, prior to the original trial ) and that the interpreter had been overly "familiar" with her. But the ECHR did not otherwise criticise the correctness of the already definitive verdict. The ECHR did not support her assertion ( at the Appeal Court) that she had been coerced into accusing Lumumba. However the Supreme Court decided, in the light of the ECHR decision, which awarded her a paltry 10,400 euos in damages, that an appeal court should reconsider the conviction specifically with regard to Italy's obligations under the Convention on Human Rights. The Appeal Court - as I have argued elsewhere - came to the correct decision on re-affirming the conviction. Knox remains a convicted felon. Oh, and she was not exonerated but, bizarrely, acquitted of the murder charge, despite the overwhelming evidence against her.
@treaclebuns
@treaclebuns Месяц назад
*Lies! Amanda was not convicted of defamation. Defamation is a completely different charge. In fact Lumumba himself defamed Amanda in the newspapers by making fantasy accusations against her that contradict what he said in court. Amanda was repeatedly defamed in court and in the newspapers throughout the trial and continues to be defamed to this day by people like you and your guru Quennell. It's far from "the end" as you put it. *You should know that the 1.45 as well as the 5.45 statements were deemed as expunged from the record as directed by the Supreme court to the Florence appeal court. Your reference to them is a complete waste of keystrokes. The only thing that was considered was the Nov 6th memoriale that was considered to be a retraction by the ECHR. *The Boninsegna motivation report acquitted Amanda of the slander of the cops you mention, so that's more wasted keystrokes. The ECHR judgement indicated that there was no investigation into the complaints Amanda had made about ill-treatment, so your comments about not having "said as much" is baloney. If there HAD been an investigation that found no wrongdoing then the poor slandered cops might have had a better chance of winning their case. They had the chance to appeal but neglected to do so. They only have themselves to blame. The irony is that the Boninsegna court cited Donnino thus: "In fact the witness confirmed that the phrase on record, see you later, should be understood as an invitation to a totally generic future meeting, equivalent to a presto [see you soon] or something similar, rather than to an imminent and certain invitation." Mama Mia! Why didn't she say that at the time? You cherry-pick the "stand by my statement" quote out of context in the same way as Harry Rag did, while neglecting the rest of the narrative where she refers to cop abuses as being the real reason behind her compliance with their insistance that Lumumba was involved. In fact the quote you cite refers to proceedings when the violations were actively taking place, and were expunged from the record. So yet again, you don't make any sense. In fact she said in her 1st memoriale that " Who is the REAL murder [sic]? This is particularly important because I don't feel I can be used as condemning testimone [sic] in this instance." Which looks to me like a withdrawal of her compliance. *There is no mention of the word "familiar" anywhere in the ECHR judgement so you are lying again. The judgement said that the cop Donnino had acted "a mediator and taking on a motherly attitude which was not called for in the circumstances" The judgement also concluded that Donnino's violations "compromised the fairness of the proceedings as a whole." The ECHR has no remit to evaluate the right or wrongness of domestic laws but to ascertain whether human rights have been violated. So more wasted keystokes. Yes the ECHR couldn't evaluate coercion or not but they did highlight the fact that no investigation took place to ascertain one way or the other. They also highlighted the fact (by citing Boninsegna) that: " it could be seen from the judgment of the Florence District Court of 14 January 2016 that Ms Knox’s statements of 6 November 2007 had been taken in an atmosphere of intense psychological pressure." The compensation Amanda received was "10,400 euros (EUR) in respect of non-pecuniary damage and EUR 8,000 for costs and expenses." That obviously doesn't include 4 years (3 for slander) of illegal imprisonment. *Yes, she remains convicted of calunnia but this will be appealled to the supreme court again. Even if they uphold the conviction it will still have to go past the ECHR committee of ministers to be acceptable. One thing the Florence court didn't do was to restore the proceedings "restitutio ad integrum" meaning that they should have redressed the events (as far as possible) to a point before the violations took place, i.e. before Donnino started acting beyond her remit. That didn't happen since the November 6th memoriale was written well AFTER the Donnino violations took place, and as a result of those violations. She also didn't have a lawyer to advise her on what to say in the memoriale, or even that she should make such a memoriale in the first place. Italy is a member state of the ECHR and has to comply with their judgement. The Florence court did the opposite. Your boat has sailed as far the main murder charge is concerned. Get over it. I'd stick to selling bugalows if I were you.

@@leesteal4458On her part, yes. I doubt you’ve done any research on the case. I mean, you don’t even know how to spell!

Amanda was totally innocent. This horrible murder was committed by a strong man. Well I know who it was but must not say this because then I will be called racist

No, not even. Rudy Guede, regardless of his color, was a thief. Now he's out and apparently he's not changed. He's under surveillance now because of abusing his girlfriend. He can't leave where he lives either.

There were 3 people involved. 2 men 1 woman. I think they could handle one woman

@@Morticia1313 no, not true. Both Amanda and Raffaele went to prison totally innocent. This is actually old news. Rudy killed Meredith but due to political agenda, they let him go, did not want a colored murderer. Italian police had their instructions. Rudy then left Italy

@@Morticia1313True. Even the Italian high court said as much. Funny how Knox isn't worried about the two who are still on the loose.

What did she say and under what interrogation.

As a result of coercion, AK signed some statements that the police wrote up stating that PL was there. She was deprived of food, water, sleep, breaks, yelled at, and hit in the course of the interrogation. When her mother called, they wouldn’t let her answer the phone. Apologies for saying this, but she said she had to go to the bathroom because she had a female issue. They wouldn’t let her.

I think this is a personal Vendetta. People there are many more universities you can go to. Don’t risk living in such a hateful place.

Nothing hateful. Italy was safe and wildly popular amoung US students till Knox destroyed the nice truth here. BTW Knox was not an exchange student. She did not enroll at the university. She was self-funded with drugs eating into her savings.

I believe this case was corrupt from beginning to end. Very sad for the victim and family. They probably have the right person in jail but Amanda should have never been convicted of anything.
