@@soulextracter Maybe you saw some edited videos. A lot of his testimonies were "he said, she said" to make claims. Not all of those were hearsay, but most of them were.

@@pikekeke Only if what "they" said was evidence, and not if you are using third person's statements as factual truths. You can testify that someone said something, but you cannot testify that something is true because you heard because someone else said it.

It just shows the lawyers knows what they're doing they don't want the witness to get on a roll and explain everything they want to break up that flow get the witness to stumble on their stories but it doesn't make any sense to do it when you're direct examining or cross examining a witness

much better, cuz direct knowledge is knowledge acquired through first hand experience. But I really don't follow the case since direct knowledge also implies there is immediate or other circumstance such that 3rd party is by time or nature of event is impossible to exist. (not sure this small part even matters these days) But your question probably is the most succinct way to fix it. Basically if the answer can, and has be "yes" or "no", it at least won't be an ambiguous question. it might still have many other possible issues that can lead to valid objection. It's just a high stress, fast paced situation. The lawyer should asked for "withdraw of question", then rephrase, instead of "objection". (assuming the answer is bad for his side, otherwise he would just shut up and the other side would object) Since witness already started answering and he would interrupt, that is what legal eagle means by request a motion to strike that exchange using hearsay as the ground.

Objection, Hearsay became a catchphrase for them. Hell, Johnny even reminded the Lawyer to say it during his questioning. I've seen a couple court cases, and they weren't doing that good a job when their opposition could predict another "Objection!".

If it helps any, I use a method inside my head to help remember words and their proper spelling. In formal speaking, I would say "eh-licit" for elicit, but when I try to spell it, I make myself say, "EE-licit" and "ILL-licit" to break words, so they stand further apart. I also do it with, "Champ Pag Knee" for champagne, and "Con Science" for conscience.

This specific example is probably not hearsay because no one is disputing that Depp had an injury to his hand and the only thing the witness said was that the doctor said Depp had an injury on his hand. He didn't speculate as to what caused the injury. The lawyer was probably just premature with his objection because he thought the witness was going to say something like "the doctor said the injury was likely caused by a glass bottle" or something similar. Since he basically objected to a statement equivalent to "the sky is blue" though, he looked like an idiot.

@@TabithaStabitha It becomes hearsay when a witness is giving an account of what happened through the perspective of what they were told by a third party. Nobody is objecting to the doctors ability to assess the injury. I can’t be a witness to a murder if my testimony would be that I was told by my neighbor who the person was who committed the murder. That is hearsay, because I did not witness the murder first hand, but instead am just testifying about a rumor I heard essentially.

My favorite was when Heard's attorney was saying things twice to make himself clearly understood, and then Depp asked "Could you repeat that please?" to mock him...yes, I understand that as a lawyer you have to move at a quick pace and all, but if you're not 125% on your game when you have someone on the stand, you're coming out looking like your client hired some guy from Taco Bell to represent them.

that lawyer is smarter than 99.99% of people laughing at him. The thing is lawyers make mistakes ALL the time, at way smaller cases. (in this case he should go for "withdraw question", instead of "objection". But it's a fast paced, trial of the decade situation with 100 cameras and a shitty losing position. Still funny, but not as ridiculous or incompetent as people make him out to be.

I'm not totally sure of that even bad lawyers can pass the bar on the first time and good ones failed he might be a bit of a jerk though as he likes to cut people off as they give a answer that to the witness they don't see it as just a yes or no and I kinda see that as bullying maybe? And I find it funny that it matches up to how I see amber heard and some statements made in trial that she never let Johnny get a word in during couples therapy

The lawyer in this case reminds me of the guy Charles Manson hired to defend him - whose strategy was basically to object to everything and anything and just try to stall as much as possible...I guess until the jury got bored or something.

I think maybe at least part of the strategy was to object to things JD said as a witness in an attempt to make him angry to get him to have an outburst in court. It’s not a nice move on a human level but professionally it makes sense. If it had worked things would have looked much worse for JD since he’s essentially trying to prove that he’s not prone to violent outbursts.

If you don't object to something in court at the time, you can't try an appeal on that matter at a later date. They're carpet-bombing objections so they have more ground for an appeal should the verdict go against them. That's lawyering, but to most other people it's a scummy tactic that may mean appeals and counter-appeals could take years. The attorneys don't care, they just get retained for longer.

@@kunilsen2519 yeah, especially in a jury trial, it's bad strategy to object constantly. It pisses off the jury. Really, in a case this deposition and discovery intensive, you should have a general idea of all of the evidence that's going to come out ahead of time. Every witness has already been interviewed at length, reports and exhibits have been exchanged, etc. So you should already know what your possible appealable issues are and what objections you truly want to make. Objecting just for the sake of it is amateur lawyering and just annoys the jury.

This trial is incredibly consequential for the millions of people everyday who are abused and then gaslit by powerful people and their entourage of enablers around them. On the contrary, the outcome of this trial is incredibly significant. If Johnny loses, it will signal a sea change among the general public (through the jury) not to side with powerful men against the women who challenge their authority. That has huge consequences for just about every person alive.

@@alanhersch4617 one of her other lawyers did make a pretty big blunder as she was questioning a phycologists and one of her questions was about if its true that abusers will sometimes falsely accuse their partner of abuse(not a lawyer but my guess is she was trying to discredit Depp's accusation) and the phycologists(psychiatrist? wasn't sure) answered yes but its usually when its a female abuser against a man(which obviously does the exact opposite of what her lawyer would want) and also kept asking is it correct questions when reading the report and often she would respond no it isnt correct) as for that lawyer he did ask Depp the same question repeatedly(the question was answered not a lawyer but my guess is it was trying to make Depp angry so they could use that as evidence of sorts but it failed and might have just irritated the jury(assuming there is one as I havent really paid that much attention just things like that)

The Reason it makes him look really bad is because he's been objecting to everything Depp has said that it became habit. It's a foolish move for this lawyer because Depp is very charismatic and the more you try to gag him the more the jury will despise u. They needed a different strategy for this particular person.

Boy..... the embarrassment lawyers must feel in moments like this, especially the first few times when they're new and not as experienced. It is very human, though, and we all do some form of this occasionally, including in arguments/debates/discussions. Still pretty awkward and embarrassing, though, especially in court and in such a high profile and infamous case. And I can't exactly blame someone for having their brain fry a little trying to work such a case..... it's so insane and hard to really make anything out of.

This is just a classic case of attempting a character assassination. He's trying to make the witness's testimony untrustworthy by asking ambiguous questions, and objecting to the answer, which can trick the jury into believing the witness testimony is flawed and irrelevant, or just straight up lies.
