I am siding with the judge on this one. First of all, you don't ever make an employee change clothes on the floor and examine how the clothes fit. You have the employee use the company bathroom and then ask him how they fit. You don't touch the employee at all without their consent. With or without sexual harassment as an intent, this business owner made a very costly mistake.

Judge believed and sided with him about the sexual harassment but 1000 out of 7500? Damages for emotional distress, pain and suffering, punitive damages, back pay, and only got 1000? Didn't even tell her she needed to take a course in to stop harassment? Pretty shady.

Even in the department store women sometimes work in the men's department and check for proper fit and size by touching the waistband. This judge was ridiculous to give more weight to the supposed sexual harassment than he did the real reason this kid sued his boss. He was angry that his cell phone charges came out of his pay. So he sues her for the wages she withheld and figures what does he have to lose by throwing in a sexual harassment claim too! I have never watched this judge before and after seeing his decision on this case I would not want to watch him again.
There are 2 reasons for why he won and should have won. The first is that this is civil court, in civil court you don't have to prove your case beyond a reasonable doubt in order to win. The plaintiff didn't come closer the money he was seeking because he could only prove part of his case. The second is the defendant admitted to touching his waist, which this judge found to be inappropriate. Had this been a young female employee with a male boss who touched her waist this could have been a $100,000 lawsuit.

I guess I feel male or female either one, It's cases like this that make me livid, because we have people that are really getting sexually molested out there and it gets overlooked because of shit like this. Professionals that work with polygraphs are working real cases where people are getting molested and abused, then you have the opposite extreme where some kid walks into a court room and says she tugged his waste band so he wants a thousand dollars. Look I'm not taking sides I just think it's awful. I'm recondite in the areas of court proceedings and law....but another thing is like you said, how sexism plays a role in law praxis. It's not right that a man could get sued for six figures because of something like this...but then again makes me wonder if six figures would come down on him if the Judge was a man? Not sure how much is weighed by either the judge's disposition/favoritism verses a standardized monetary system.

+QemeH This is in no way an actual depiction. Rather these shows define the difference between justice and entertainment. Some of these shows are more accurate than others but they all are intended to entertain. There is plenty of justice in the American court system. You can buy all you want.

It's a civil court, no proof needs to be provided. This is basically a battle of who can convince the judge that they are right a d usually when you are as calm and collected as the man was and your opponent is struggling with their words and is changing the subject... you will win. Another reason as to why no real proof is needed is because nobody is going to jail so no real charges were made.

I would've sought corroborating testimony from either co-worker or customer witnesses about how she made suggestive comments and touched him inappropriately. She only admits the uniform was snug, but, it sounds accidental, and also sounds like he didn't even wear it at work. He just tried it on once. And what's that weirdness about how; "she refused to leave the room" when he took off his pants? That's ridiculous to my ears. You know what? If someone refused to leave the room then I simply wouldn't remove my pants. That's just common sense, isn't it?

While I agree that male sexual harassment should be taken seriously, this guy had 0 evidence to prove that this was happening. The judge operated very unprofessional as well. You could see him smirking and most importantly you can't decide a verdict with your belief evidence needs to be presented.

This pisses me off so much. This judge clearly hates women. He never gave any proof of his claims (he could've brought the uniform or a recording of his attacks). The boss had evidence of hew claims against him which makes her a hell of a lot more credible than him. Hateful need to be seriously educated before this world turns into a shithole.
