First one is better because second one is on a lower floor and the construction can be noisy and dusty. One concern with the first one is kitchen opposite bathroom, not good feng shui, fire facing water. Conflicts in household and possible stomach issues. Way to alleviate is to hang a long curtain on the bathroom door to block it.

One of the first things I'd check would be whether walls which separate the rooms were real walls, meaning; if they're solid brick/concrete or lame ass plywood. So many new "luxury" properties here in the US don't have real walls, therefore they suck in terms of noise insulation.

The appartment is rather small.. Does it really have to be divided in two floors? Makes no sense to me. Appartments like this should fit on a single floor imho.
