One of the smartest people in the law industry whom I can recognise. I can still remember some salient points of the articles he wrote decades ago. Good to see Mr Woon.
By showing his friendship with the tycoon, the Minister exerted indirect influence and, therefore, might have some effects on his subordinates' judgements and decisions. This indirect influence, in my view, was deliberately and subtly cultivated.
Prof Woon made his position clear without imposing his own views. Eugene Tan could take a lesson or two from him. Put an end to political correctness when there is an absolute need to speak your mind.
A typical Eugene Tan answer: The judge made the sentence, as it is the judge's job to make the sentence. The judge has to make his own judgement. The judge's judgement is different from that recommended by the prosecution and the defence because he disagreed with their views. he thinks that the offence is more severe than what either side deemed, and he could not accept their recommendation. This is an example of the judge making his own judgement. So Eugene what do you think of the judge giving a sentence that is heavier than what the prosecution recommended? Well the judge deemed the offence to be more severe than what the prosecution had recommended. He had a different interpretation of the severity of the offence. Therefore, he gave a sentence that heavier than what the prosecution recommended.
This wouldn’t have happened if he weren’t a minister. I’ve given my clients gifts far more valuable than the insignificant amounts he did. Likewise, we’ve received gifts in return. Singapore’s government aims to prevent business and politics from mixing, but they haven’t restricted business-to-business gifting. As I said, this only became an issue because he’s a minister. For the rest of us, this isn’t an issue unless it’s out to rig a contract.
So the charges were reduced to "receiving" gifts which I presume is less than "asking". So why OBS charged with "abetting" only? Should not the one "giving" be equally culpable. Who instigated the corruption?
I 'know' Walter Woon as, in my opinion, The Best Debater when I watch his debating skill 'demolished his opponents' ...hahhaa. Good to see him on youtube.
What ? Severity? 1 year jail for a sitting cabinet minister taking all those bribes, and you call the 1 year jail time severe .. ? OMG .. even before this comment by Prof Woon, the prosecutor mentioned they are going to press for a more severe sentencing of 6-7 months, I nearly fell off my chair when I read it in the news, was thinking if that was April fool joke.
@abirames8925 Sure, Mr Ong loves him so much, hence the so-called expensive gifts. If you read the news, Mr Ong past dealing in business which is well published in the news you may know deeper. Nevertheless, it's not a small amount, and that itself is already very serious
@@JJ-zu5cg yes definitely the fact it was quite high value makes it serious. I'm just saying technically it wouldn't be a bribe because he was not convicted of corruption. But yes of course a serious offence, especially considering how high his position was.
Just dont take anything from anyone you have dealings with. Even if they are your best friends. Thats the standard Singapore's civil servants must adhere to. Harsh? Yes but this is what makes us stand out from other countries.
You dont need clear evidence for this case. This will influence Singapore's reputation greatly as we showed the world our ministers are paid one of the highest to prevent corruption and yet this still happened. Iswaran needs to be set an example, declare bankruptcy and highest jail sentence!
If Mr. S.Iswaran appeals his prison sentence, he will be subjected by the prosecution to the full extent of the charges' penalty i.e. maximum sentence possible for the two charges, one under section 165 of the Penal Code and the other for the Obstruction of Justice, that when combined, leads to 2 years of imprisonment. Yet, if pleading for leniency through the appeals process, the Judge might reduce his prison sentence after taking other mitigating factors into consideration such as his age, health status, his wife's witness account statements, other witnesses' testimonials, his hard-earned Bachelor Degree from Adelaide, S.Australia (possibly funded via Govt PSC Scholarship), his Postgraduate studies Degree from Harvard for the required Masters in Public Administration (M.PA) ~ (Funded by scholarship???) and his more than 25 years long service as a MP as well as holding many high positions in the Public Service Commission.
Dear Iswaran sir, stay strong. 12 months is very short and will pass quickly. Singapore prison nowadays is very welfare, food is of course not what you're used to, but its basically like normal HDB cai fan. Just treat this 12 months as a extended holiday paid for by Singaporeans and if you have good behaviour, you might even be let off earlier. Stay Strong Sir! May God Bless you and your Family Abundantly! 🙂
Prof Woon was the chief defence counsel in the 3-judge hearing against Ms Lee Suet Fern...........although the court found Suet Fern not materially involved in the preparation of LKY's final 7th Will, which was like an earlier one, I think the 1st which was drafted by LKY's lawyer from Lee & Lee, the court nevertheless impose a ban on Suet Fern practising law in SGP. The UK pre-eminent lawyer, in administrative law, Timothy Dutton QC (new KC), CBE, said: “The Court's reasoning in its judgment is legally unsound and falls into serious error.” Prof Woon was also the Attorney-General previously and said that he felt that he was overstaying the position..............what does "overstaying" means in the context of being appointed to senior legal positions? For Prof Woon to support Vincent Hoong's "judgment" only camouflaged the reality. Incidentally, Prof Woon might like to recall what LKY had said about the justice system....(I dun want to be specific)
Question-du-jour: Was his hard-earned Bachelor Degree from Adelaide, S.Australia (possibly funded via government PSC Scholarship), his Postgraduate studies Degree from Harvard for the required Masters in Public Administration (M.PA) ~ (Funded by government scholarship???)... If so, please return the scholarship monies $$$ back to its issuer, i.e. the Ministry of Education (MOE) under the government, whether in the form of a penitent donation or not. Thank you!
Would love to hear Waltern Woon's opinion on the ridout case, esp on Shanmugam.. "Not only must they be clean, they must be seen to be clean, you don't want a situation where the boss's minions think "this is a friend of the boss, i've got to please him. I hear my master's voice even though my master's not spoken. Therefore I must do something to make this fella happy in case the boss gets angry"." Wow... in Shan's case, wasn't this as ridiculously blatant and egregious as it gets? OR did Iswaran simply forget to write in black and white that he "recuse" himself from all decisions relating to Lum Chang and Ong Beng Seng's companies? I guess "recuse himself" would have absolved him of all sins?
One very smart guy who preferred to avoid limelight + back to school, jus see how much he flourished 😅. Isw if smart will not appeal + obs shld had plead guilty, now he's in bigger trouble by claimin trial. Parallel live suit ongoin in taipei v KeP. 😂
