Ben covers what the current laws are for riding motorised wheeled devices in New South Wales. He also highlights the implications the government's pending public scooter trial might have on responsible riders of privately owned devices.
Do you think data collected from a trial using scooter rental services will reflect the electric riding community as a whole? Have a watch and leave your thoughts in the comments.
As always, we encourage safe and sensible riding, as well as the use of protective gear.

My understanding is that overseas data demonstrates that personal e-scooters are more likely to replace car trips vs an shared scooter too, which is where the real benefits to society is. There is a cost both in terms of wear and tear on the roads, traffic and in terms of co2 of cars driving around to attend to the share scooters.

Was noted the other day for yet another trial only involving Beam Rental scooters. This trial will be held in Armidale. Just a total waste of time and delaying tactics form a backward thinking state government. The crazy thing is that if someone was to rent a scooter and take it to the University, would it still be there for the home journey? Are there going to be enough scooters for this trial. They should be using the trial for privately owned scooters, not rentals. Privately owned scooters are looked after by the owners. Rental scooters on the other hand are hired by people who walk out of a pub and see it as a convenient way home resulting in poor behavior's and bad decisions.

Owning and renting are way different things. You don't tend to just ride for the fun of it so much when you rent. Since I bought a scooter I have done 100s of kms in just a few weeks getting around Brissy which is great to ride around with all the bike/scooter lanes everywhere.

I think... "pedal assist" is the "technical term" - and yes limited to some piddly stupidly slow speed, legally. (Don't get mad), I think you can own a kick scooter, and ride it on the cyclepath, if the handlebars get removed, some people would say then it becomes dangerous (I do have a dirtsurfer I got 15 years ago, it has 15 inch wheels, a rear disk brake and a steering front wheel and no handlebars, it can be a lot of fun and with a set of skipoles is pretty easy up hills.). - throttle controlled e-bikes aren't allowed in pubic in "Australia" ( "I think" ) - as that would then be a motorbike... Personally I don't know why there aren't more "high power e-bikes" marketed as motorbikes for a reasonable price - get their speed up to 80kmph and provide 50km of range and that will suitmost people for their local travel.

We have the same issue in Adelaide. I totally agree that the data and the demographic of riders the SA government is gathering from rental scooters is not valid data. All of the issues that the public and media complain about with PEVs are addressed with privately owned personal electric vehicles. It’s criminal that councils can continue to benefit from the rental scooters companies but deny people the ability to buy and use their own. Thanks for the video! Let’s hope we get an Australia wide road policy for PEVs 🙏👍

I own an electric bike. I always have 'assistance' set to maximum, so when I'm 'pedalling' it is just for show. I am not putting any effort into the forward motion. This requirement of having pedals to make personal transportation 'legal' is ridiculous. Being able to pull a scooter out of your car boot or carrying one on the train would revolutionise everyday life. Maybe restrict the top speeds to improve safety. Have compulsory insurance?. Just my two cents.

The ebike limit needs to be 50kph. My bicycle can roll down a hill at 50. This would take a lot of cars off the road. Riders can do the speed limit and not cause issues with cars by being too slow.

The laws in QLD are still messed up though. We are in the same category as mobility scooters. 🤦‍♂ With a road marked as a 60 zone, I have to use the footpath and travel at 12 kph for my safety. While a 10 year old can legally ride on the road, because it's safer for pedestrians. I'm confused. We took bikes off the footpath, for the pedestrians safety, and made bike lanes for them, and the 1.5 m overtake rule for their (cyclists) safety. Why are we repeating this with escooters? Also bikes can travel at 60 kph while scooters are capped at 25 kph. Why? 25 kph feels so slow for experienced riders, which disincentivizes the use of a helmet. So imagine how 12 kph makes you feel. I'd like to see riders on the road with a minimum of 30 Kph (average bike speed) Also people can run faster than 25 kph and we don't make them wear a helmet for their safety in the case of a trip and fall. 🤷‍♂🤣 There will always be an idiot somewhere. RU-vid has whole channels, devoted to them behind the wheel of cars.

Hi Ben, I hope NSW comes on board soon. I'm in QLD and bought a onewheel from you almost 3 years back, I have now done over 10,000 km (really!) on it just riding aroung town, ie shops, gym, fun etc. This is serious transport for me. My town in QLD started hire scooters too, a bit over a year ago. There was some backlash at first and negativity, but it seems to have settled down now and I see people riding the hire scooters all over, politely and safely. I dont know their finances but I would say from public opinion and acceptance it seems a success. Also, since the hire scooters started the amount of private scooters and electric skateboards has gone beserk, I think the scooters on every street corner has really done a lot to popularise PEVs. When I started riding my onewheel around town there was only two other people riding electric, on eSkateboards, now I see tons of people commuting in their work clothes. The other night at 8pm in Coles I saw a 50 year old Coles employee woman putting on a helmet, and pulled an eScooter out from behind the cashier machines and rode home on it. 👍

Great advice Ben thanks. One thing I don't get about growing up in Oz all my 50+ years is why does every state need their own rules n regs when it's still Australia. It's not like you drive to QLD and it's suddenly the UK or USA. Politicians just wanna glorify their position in different states and make life difficult for all of us. I'm on the verge of buying an EV ride and this is pretty much stopping me form that step. After seeing on ACA a guy in Sydney getting fined $2500 for riding his Segway scooter on the road, including his unapproved helmut, all packaged deal from JB HiFi is confusing, distressing, annoying and off putting from buying a scooter now. I'm hesitant, confused and sitting back now until NSW wakes up.

regardless of the "unregistered vehicle" or "dangerous toy" - "I should expect" doesn't "wash".. However, the idiots in parliament / Legislative assembly, seem to think pushbikes travel slower than 23km/hr... NSW should bring in registration, wait for the whingers to arc up... Obviously I sit on bothsides of several fences in all this - there are different "discussions" and solutions no doubt.. PS Adults can't ride skateboards on footpaths legally in NSW anyhow. hmmm Statistics are, the general public gets hurt (self harm usually) any time they travel faster than walking pace. NB. call them mobility device, not vehicle. Vehicles end up being regulated and registered, access devices get permitted. *One costs more.

I second many comments. Rental scooter users are not representative of private users and frankly this flawed business model has done more harm than good. In SA we’ve had the Lime & Beam type scooter trial since Feb 2019. Incredible that with 3.5 years of data all SA politicians have done is expand the trial recently to a couple more suburbs. However, it’s still illegal for private escooter owners to ride on any public land in SA. Crazy that ebikes are legal but escooters are prohibited. There’s simply no justification for the discrimination.

Any considerations for improving controls around electric mobility need robust consultation with ALL key stakeholders. NOT engaging the end user is crazy! History tells that by doing this, we identify the wrong risks, therefore the wrong controls, destroying any chance of industry adoption and subsequent sustainability. Create an environment that supports risk taking with a proportionate level of due diligence.

Watched your vid and agree totally. I am an older guy from Wollongong riding an ebike and love it. But….as has been stated, it’s the minority stuffing things up. I saw a father and daughter team on two ebikes riding along a beachfront cycleway at about 30 to 35kph using pedestrians as their personal slalom. This was absolute beachfront with little toddlers, families and dogs and those palookas were tearing in and out. These were the large ebikes designed to look like motor cross bikes. They were scary. I also see young kids aged about 10 to 12 riding them through our beachfront car parks at speed without a thought for anyones safety. Kids just don’t think like that. I don’t think the answer is to ban anybody from riding but we have to find a way to educate the wombats. Scooters / skateboards aren’t my go but if it can be done safely then legalise it.

I work as an insurance investigator and while I haven’t investigated a bike / scooter I am aware that the insurance companies will be red hot on these scooters and bikes. Mine is legal and I can ride it anywhere. Have you thought of ditching the scooter and getting a bike? Mine had a range of a bit over 40k at normal use. Mine only cost $800 delivered from Kogan and is a fat tyre fold up thing that lives in my boot. Besides, bikes are more comfy than a scooter.
