Rule 25.56 of their constitution talks about Temporary Suspension meaning that they can at any stage prior to the commencement of disciplinary proceedings against a member summarily suspend the membership of that member in accordance with the provisions of this Rule. Also if you remember Fikile did mention that JZ suspended himself so they are actually trending carefully around this situation because they know by getting rid of JZ now during election season it will have an effect on votes. The Zuma faction within ANC is still very much alive and his supporters will easily jump ship by moving to MK should he formally be suspended. Why do you think Rama only responded by saying“We have noted everything” to the speech JZ made in December? Because JZ accused him of “Ramaphosa ANC” not being the real ANC. So they would be playing right into JZs hands should they make noise or suspend him. The headlines and attention would all be around JZ which will only make him more popular and the most talked about person during a crucial election time.
