Correct me if I'm wrong Atty Trixie, what I heard was that they (France Castro and company/cohorts) were sentenced to an "indeterminate penalty of 4 years to 6 years imprisonment, including P10,000 as civil indemnity and P10,000 as moral damages", meaning that they were sentenced and/or remanded to serve out and if not ordered to go to jail in July of this year that's what I understand from the trial court judge's order or sentence to them and your explanation of what the court handed down as sentence, but I didn't hear if she was allowed or not to post bail is that why she's still out and still sitting in Congress.... If I understand correctly that sentence was final, so she should be in jail by now... In addition, if the case is being appealed, shouldn't she be appealing it while in jail, since she wasn't allowed to posted bail after sentencing... According to her the case isn't and/or that the sentence isn't final yet... Is that because she appealing it that's why she's free to go about in public and out in the open... If so, that's probably why most convicted felons are out and not in jail... Especially, those that are in public office, celebrities and prominent individuals, pardon the cliche "with money"... They're allowed to post bail, not serve their sentences first because their case and sentences are not final because it's being appealed right away after sentencing... Which to me, is that if the judge erred in sentencing they should go to jail first because that's what the judge ordered, appeal the case while serving out their sentences, make an appeal and if the appeals court doesn't agree with the lower court, it can set aside the lower court's decision and exonerate him/her order him released... And, if the Appeals Court agrees with the lower court's decision, then it's up to the individual to go to the Supreme Court... That's how I understand the court system and the criminal justice process (investigation, arrest, charging/indictment, initial hearing/arraignment, pretrial detention, bail, discovery, plea bargaining, trial, sentencing, appeals...
