Question for you, not sure if it's already been covered. - I'm going through a contested DvRO request that my ex filed against me in August. She has constantly brought up any little thing she can at every hearing we have. Ultimately, wasting time and hearing is continued.... She hasn't filed a separate request for contempt but instead is submitting exhibits for her alleged violations. Shouldn't this be separate from the restraining order trial/hearing?
I have a question, with regards to insurance (health, Auto) there is nothing anywhere regarding ATROs violations of cancelling health and auto insurance. What do you do when your ex violates the summons ATROs by cancelling the health or auto insurance?
My ex withdrawal all our 401K Retirement Right away after I file divorce that was back on 2012 . my question is, how can I get half of it if I have a judgment for half of the 401(k) retirement? Also, he is contempt been spousal support for many years . I cannot afford to hire an attorney because I have disability and I am not working. Can a judge kick you out of a courtroom unjustly with no charges or no crime committed when you’re a parent who the court doesn’t want to talk because he could prove the kids innocence because the courts railroad him, and the Dad’s not having it for what reason would they be able to kick a parent out of the courtroom in juvenile case?
Yes, I believe so. A judge can ensure the orderly conduct of the proceedings and prevent disruption of the proceedings. Look at Code of Civil Procedure sections 128 and 1209.
