Hello! Last August 2023, I submitted i-130 application for my married sister, her husband, and their child. Just last week sept 12, USCIS granted approval, and today sept 18 we received the welcome letter from NVC regarding the payment of fees. Once we settle the fees, should we expect her interview to be scheduled relatively soon, or could it potentially take 10-15 years? Additionally, my sister is expecting a baby. Would it be advisable to delay the payment until after the baby is born so I can include the baby’s documentation as well?

I have a question. I've been in the US since 2006 along with my sister. I recently received my lawful entry with DACA through advanced Parole. I have a Social Security and a work permit all valid along being in university as well. Will it still take that long even though I've been in the US the entire time other than when i traveled abroad with advanced parole?
Unfortunately under the current laws (March 2022) you are not able to get a green card through your sister, as you are not in a lawful nonimmigrant status. DACA is deferred action, it is not considered a status by USCIS. Congress may change this so definitely watch the news.
My sister filed for my brother in Jamaica. The priority date is 10/2010. She moved and didn’t update her address right away. We went online and discovered that the petition was approved 10/2014. Her address is now updated with uscis. Is it really necessary to get an i824
Not really as long as you checked the box requesting consular processing. Just keep up with the priority date and make sure that NVC activates your case when it is available.

I have a question. My Aunt filed i-130 for my Mom in 2009. In 2019, we got a E2 visa and it got approved. Currently we are living in United States since last 3 years and are just waiting for our i-130 form to be approved so we can be a permanent resident. I see the wait time is now 15 years which means we have to wait until 2025. We also can’t go anywhere outside United States because we got our business visa from here and if we go back to our country, we have to file the process again. My question is that is there any way to expedite this process or adjust our status because our whole family is already in United States on a valid visa.

My Sister is American and she is about to sponsor me. I am 52 years. Lived in NY and went to school in da Bronx from 1982 - 1988. I have a valid US SocSec, worked for a couple US companies, paid taxes, etc. Does any of those things enhance the I-130 application? Waiting 15 years seems like cruel and unusual punishment.
@@AudraDoyleImmigrationLawyer Yes, I understand, but you can't get closer than blood, unless you're adopted. In that case, makes sense. If a direct blood relationship is evident, and you're employable, then I see no valid reason why you should have to wait 15 long grueling years. In 2022, information age, you should have to wait no more than 6 months to 3 years. It appears you are being unjustly penalized for following the letter of the law, when in point of fact, you should be thanked and rewarded for your compliance. Are they bonding the processing fee's and 15 years is when the bonds mature? I have to ask silly questions like that because the law is silly and it goes against the spirit and everything the Statue of Liberty represents. She's not on her knee's, so why should we be?
@north blue. Going through the same process. Get yourself a good lawyer, if you were here prior to 2001, did not commit any crimes, maintained legal status during that time, you may qualify for adjustment under the INA 245 (i) law. It may help to speed up your case. Not a promise but look into it.

So it's been about what, 20 years now, apart from visiting the US every now and again, so I don't think INA 245 will apply in my case. For I 130 petition I understand the required document is both of our birth certificate showing parents. Also, do I need to submit his marriage certificate and his spouse's brith certificate as well? You can sponor your siblings. Your parents can also sponsor them if they are unmarried (F2A). They do not have to be U.S. citizens in that circumstance.

Your sibling can sponsor you but you are not eligible for adjustment of status through him/her, unfortunately, because you are out of status. I have never seen the I-864 be waived.

I have question. my mom who is currently here in the US, my aunty who is the US citizen, she's sponsor my mother to get the green card. she applied form -130 then the USCIS accept her case, but form I-485 got rejected. I was looking for visa bulletin for F4 and it said march 7/22. My mom just refiling the form again and they rejected again, so what does she do ? waiting until the date become current or she has to go back to her country ? she already overstay for 3 months here while she's waiting for her adjustment of status ? thanks
Hi! Unfortunately I think you are looking at the wrong line. Worldwide the Visa Bulletin says cases filed on or before 2007 can be adjudicated now, not 2022. She will need to go back to her home country and the waiting time will be 15 years.

he can petition for you but your case will certainly not be completed in 18-24 months. It's more like 15 years. You would need to return to your home country and wait.

They told me that they are waiting until visa number available and I checked the Visa Bulletin under F-4 category they are still working on 22Mar2007 since I would say the start of Covid; My case priority date is 07Jul2007. Yes, you could sponsor him if you have a legitimate employment opportunity. Unfortunately the waiting time for EB-2 is still quite long, more than 10 years! The USCIS goes by country of birth, not country of citizenship. Please take a look at the Visa Bulletin.

You cannot file the I-485 for your brother until his priority date is available, and he is not eligible to adjust status in the U.S. at this time because he has overstayed his visa and is working without permission. I would consult a lawyer bout getting a waiver for him, or also investigate whether he is qualified for 245(i).

You won't be able to stay here for 15 years on a visitor's visa. You will need to have another status, and no nonimmigrant status will normally allow a 15 year stay.

It will take too long for that F-1 student to remain in status. You can sponsor them, but they are going to have to find a way to maintain their status after the F-1 is completed, or they will need to return to their home country to wait.

No you have to wait 15 years or more. There is no nonimmigrant status that would allow you to be here for that period of time. Therefore, you will need to wait for the approval outside of the U.S.

@Keeping it a buck Thanks for your reply, Yes I got a message on USCIS inquiry website saying the Post Office returned your document to us. We will hold your document for 180 days or until October 30, 2022. Please go to www.uscis.gov/e-request to request that we resend the document to you. If you do not submit an online request by October 30, 2022, we will destroy your document and you will need to file a new Form I-130, Petition for Alien Relative, with fee. The attorney said the document that was returned is your USCIS notice of approval, they sent it to your mother's address but she moved to a new house, he said I received this document and you should not worry about it.

Unfortunately it cannot be expedited. The visa bulletin says that cases filed on or before 2007 can now get immigrant visas. I am sorry to hear of your situation and hope that you find a different solution.

I’m in the same boat My mother has passed away recently and I have a dependent sister and father in India I’m a citizen but after consulting couple of attorneys found that once you start GC petition for sibling they may not be eligible for visitor visa , currently my sister has visitor visa which allows her to come over and stay with me at least for few months once that expires in next 2 years if I were to re apply visitor visa if I have GC petition they will deny the visa So it’s long wait for GC without having option for them to visit in the meantime That is my understanding Did you make any progress on ur Case? Yes you can. The problem is that your visitor's status will not last for 15 years. You will have to consular process and be out of the U.S. most of the time.

Yes it is, but I believe only 50% of the cases or less will be approved. They deny many of these applications because applicants cannot demonstrate that they plan to return to their home country.
Wow. I can't condone breaking the law. By law you must have permission to and be inspected to enter the U.S. There are a lot of proposals to eliminate the F-4 category.
