What to Expect after Getting a Texas Assault Charge
If you are arrested on assault charges in Texas, it is important to understand the legal process that you will have to go through. This way, you’ll be more prepared at each step of the journey and give yourself a better chance of achieving a positive outcome.
Below, you’ll find a step-by-step walkthrough of the legal process following your arrest for assault.
Appearing before a judge
Within 48 hours of the arrest, you will appear before a magistrate, or judge, who will read you the charges and inform you of certain rights, such as your right to remain silent and your right to an attorney.
It is impossible to stress enough the importance of retaining experienced legal counsel as early on in the process. Ideally, your lawyer will appear at this meeting.
The judge will also inform you of your right to an examining trial, where reasons for the arrest or probable cause must be established by the prosecution.
Additionally, the judge will either set bail or order you to be released without bail. The judge has full discretion on your bail amount, though your attorney can request a bail reduction if you qualify.
Finally, the date for your next court appearance will be set.
Charges filed
The prosecution will file charges based on the level of your assault charge. The levels are as follows:
Class C misdemeanor: threatening bodily harm or causing offensive physical contact
Class B misdemeanor: assault on a sports participant related to a performance
Class A misdemeanor: causing bodily injury to someone, or causing offensive physical contact against an elderly person
Third degree felony: Assault on a family member, household member, dating partner, or other protected status individuals. Also applies to intoxicated assault, which is causing serious bodily injury to another while intoxicated.
Second degree felony: Assault on a family member, household member or dating partner, has a previous similar offense against the same person, or the offense involves choking
First degree felony: Aggravated assault against a domestic partner or other protected status individuals.
Aggravated assault charges will apply if it causes serious injury or a weapon is used during the offense.
Arraignment
This is the first court appearance after charges are filed. Your charges may be read in court, and you will have the opportunity to enter a plea of guilty or not guilty. Your attorney or the prosecution may ask for a continuance for further investigation into the case.
At this point, your attorney may negotiate a plea deal with the prosecutor for reduced charges and penalties. If a deal cannot be brokered, the case will proceed to trial.
Trial
A misdemeanor case will have six jurors and a felony case will have 12 jurors. The prosecution must prove you are guilty beyond a reasonable doubt, or the jury can find you not guilty.
If you are convicted for assault, the sentencing will fall along these lines:
Class C misdemeanor: Fine of up to $500.
Class B misdemeanor: Up to 180 days in jail and a fine of up to $2,000.
Class A misdemeanor: Up to one year in jail and a fine of up to $4,000.
Third degree felony: Up to 10 years in prison and a fine of up to $10,000
Second degree felony: Two to 20 years in prison and a fine of up to $10,000.
First-degree felony: Five years to life in prison, plus a fine set by the judge.

Can a Victim Obtain the Arrest report as well as an amended report because the PD chose to leave out information on Purpose from the Judge to be able to have the entire statement for the judge to have all the information to make their judgment ?? I am the victim- and ai demand to see the so called “correction” report to see if my statements where corrected and altho I saw the 1st wrong copy they will not release the 2nd so called corrected one. Are there any laws (policies from what I understand mot not trump laws) - however they are using the excuse to say its a report active in the courts and would need to redact information of others but these are all mu personal statements..//// its clear they messed up on the 1st report - i demand to know what they chose to write into the 2nd and getting no where…/ any insight ? Altho i am in CT

I got charged with assault bodily injury in texas. And it says "no affirmative finding of family violence. Defendant admonished of ineligibility to possess firearm or ammunition pursuant to federal law under 18 u.s.c. 922(G)(9) or 46.04(B), Texas penal code. Can you explain if i can buy a firearm? Please

Hello my son is 21 and has severe mental illness a friend came over and he thought he was the president and was telling her to leave and as she was leaving he pushed her shut the door and she stepped off the step wrong and fell cops was called the police took my son to the mental hospital and 2 weeks latter they show up with a warrant and took him to jail. After and before this incident the police was called almost every day for help to take him to the mental hospital but they would not. He was suicidal homicidal. But they would not take him until this incident. Now he is in jail and they want 1000$ for bond. Please help

What happens if you are in joint custody and the other party girlfriend and babydaddy jumps you around the kids? Can they lose custody after being arrested

I like you I wish that I lived in your county I was unfortunately involved in a family squabble was my sister and she didn't want me to visit my mother which my mother has Alzheimer's or dementia and I take care of her in the evenings while my sister happened to been there she was off of work she's a nurse and she wasn't scheduled to work I didn't know that but it doesn't matter you know if we run into each other you know we both don't really we love each other but we really don't get along so that evening just last Sunday on February the 5th I went to my mother's to cook the chicken that was in her refrigerator cuz it was going to go bad really simple My sister threw a fit and she got irate with me she didn't want me to start cooking and the one thing led to another next thing you know she's throwing my groceries down we struggle for the bag I grab her hand thinking that she was going to hit me but it's just she grabbed my wrist you know we were grabbing the bag That's what it was the grocery bag and she was trying to get them on the ground and I was trying to pick them up to start cooking cuz I was I was determined to cook that chicken anyway when I grabbed her hand she had something sharp in her hand oh and by the way when I got there there was a steak knife in the kitchen sink it is a kitchen knives belong in the kitchen right so it was already there they were eating and I don't think it's against the law for me to proceed on to cook a chicken so that's what I was going to do but the next thing you know like I say we were struggling for the bag and I grabbed her hand and I something sliced me she had either a fingernail or I don't think it was a nail it might have been her car keys she had something it would definitely wasn't a knife okay there was never a knife involved yet and so I believe very easily I'm a cancer survivor I don't know I have thin skin anorexic and I bleed very easily so I'm squirting blood everywhere in the kitchen floor and it got on her you know it got on her skin because she and now she thinks she's bleeding and she thinks I cut her when she doesn't have any bodily injury not one cut not one open wound on her body whatsoever yet she went off into a tangent saying you cut me you cut me and none of it was true that that could be in the furthest thing from the truth so I'm now going to jail for a bodily injury assault and it's a misdemeanor I think it's a classy I don't know I would think so if it's said bodily injury and I'm just and she she admits that it's a lie that she exaggerated I mean she wanted to get me in trouble she wanted to get me out of the houses what she wanted and I didn't leave and it didn't work but I stupidly stayed instead of leaving but I have nothing to hide and I did nothing of the sort that she was accusing me of so what do you think is I'm faced with and what's the best way to handle my case is what I'd like to know and if you can answer that question that would be greatly appreciated but thank you so much keep up the good videos

my wife slappt my son then her mom jumpt in and my wift was trying to get to my son to put clos back on him he was in the bath but her mom was thinking she cude hit him agen but she was just trying to get him in the bad room and why my wife was trying to grab him her mom was in the way and hert her arom cops come and take my wife to jeil she been in there for 12 days now i can't get her out 20.000$ ball on her i don't got 2k$ to get her out and her mom is 87 yrs old so she got Booking #: 201607732 Age: 36 Gender: F Race: W Arresting Agency: VBCSO Booking Date: 12-10-2022 - 6:57 pm Charges: BATTERY 2ND DOMPHYS INJURY Bond: $20,000.00 how much trubol is she really in?
