Arrested in 10 seconds: The new police powers to stop Just Stop Oil | LBC explains

LBC's Fraser Knight has been following and reporting on the eco-activist group Just Stop Oil since they were formed just two years ago, and as their tactics have been forced to change to keep up with new laws, there’s a real question now of what they will do next.
The disruption caused by their road-blocking and slow-marching has led to some of the toughest restrictions on protest the UK has seen - and police are making the most of their new powers, diminishing the effectiveness of the demonstration.
Over the past two weeks, Fraser has witnessed warnings being issued by officers, under Section 7 of the newly updated Public Order Act, immediately as groups of protesters step onto the road.
On one occasion, I timed how long it would take for the street to be cleared.
10 seconds in, people were being put into handcuffs and within 90 seconds, the last of the activists was being carried onto the pavement.
It’s barely a protest anymore.
We’ve already seen tactics being switched - from people sitting, lying, or glueing themselves to the road, to now slow marching.
Even that isn’t working now.
Exploring the impact of the Public Order Act, the law has been described as ‘dangerous’, by one human rights law expert.
Jun Pang, from Liberty, said: “When you have broad, vague and severe laws on the statute book that clamp down on protest, they never only impact one protest group, their effect is always much wider and that is something that should concern any of us, given not only the importance of protest but the role protest plays in social change and our democracy.”
The government says the law is about making sure people can go about their daily lives without being disrupted, while balancing the right to protest.
While the police have said they also have to balance that right with the law - which now explicitly says it’s illegal to “do an act which interferes with the use or operation of any key national infrastructure in England and Wales” including roads.
So where does Just Stop Oil go next? Or have they now done all they can, legally, to shout about their cause?

Im perfectly happy with Just Stop Oil protesting quietly by the road. The second they step IN the road and try and block it, they SHOULD be arrested and thrown in jail.

I'm in Canada, the best protest I've ever seen was Native Canadians were blocking a non-major road, after I stopped they came to the car window, handed me a pamphlet and said "sorry we stopped you today but please read this to see why". I was so impressed I read the pamphlet and even went online to sign their petition.

Get arrested once for this , get a fine. Get arrested twice for this 7 days inside. Any further arrests for the same offence 6 months increasing by 12 months every offence after. Getting arrested 30+ times is a mockery.

they need a harsher punnish ment. the first couple times fair enough you hav emade your point. but after that it gets to a point where its stopping everyone from living. Not only is it a waste of time as many of their household items are made by oil, but the goverment are already making all vehicles produced from 2030 onwards electric. there is only so much you can do. This is the world we live in. If you can't take it then you should be punished like you was as children. Grounded. (AKA Prisonment for so many years)

Blocking a public road or highway is illegal unless you get prior permission from police. They don't ask for permission and they are disrupting and endangering lives by putting themselves in front of traffic so I'm glad the police are finally being allowed to do their jobs.

Noticeable that they aren't out protesting in the freezing weather in the UK. No doubt they are all home in the warmth, brought to them one way or another by oil and other fossil fuels. I wonder if the Getty woman and her relatives pay them for time off due to weather? Holiday pay, probably, or at least a retainer.

Each of those arrested should be charged with disruption of traffic, being a nuisance to society and fined an amout equal to the cost of having officers and support personnel there to remove them. Subsequent violations would see double, triple and quadruple the fine amount.

Who are these people that they don't need to work? Imagine being arrested 31 times for protesting. It makes me wonder if they are being paid by someone (Iran?) to sow hatred among Brits against other Brits. I also wonder why they are not getting jail sentences for three to six months. That would dampen the enthusiasm for most of them.

I believe giving them an option of walking to the police wagon or getting zapped with Mr. Sparky until they decide walking is a better option I'm thinking their legs and feet will respond in their best interest. Arrested 35 times, sounds like a typical US prosecutor and judicial system, hence applying the use of Mr. Sparky more frequently.

1st arrest, NO BAIL, one full day in Jail. Second arrest, one full week in jail. third arrest, one full month in jail, fourth arrest one year in jail, all of these to be served in cells with NO Oil based electric lighting, climate control, clothing, electronics, etc. If these people think they can live without oil, might as well start now! Let them prove their devotion to an oil free life!

You sound so sympathetic! Here in the USA you can only march down the road if you apply for a permit, I myself have participated in some. The police are there to safely divert traffic and you do your march and go home. These people along with the pro-Hamas people give no care whatsoever to the law or safety of others. The law as you explained just strengthen the police efforts to get them off the road which is already against the law. That man they intervened with seemingly had been given court provisions to stop playing the game.

I still find it pathetic. They get released the same day. The guy said he was arrested 4 times this week. What's the point. Keep them locked up for a few weeks and increase it everytime they do it again. and I garantee they'll soon stop.

Peaceful protests in public places where they are not causing any harm to anyone is okay. Disruptive protests of any kind is not okay and the laws should be changed so regular people are allowed to remove protesters from roads, entrances to buildings etc. And for the people that does not respect the laws and organize or participate in such illegal protests time after time. Give them a 1000£ fine and double it each time they repeat the same or a similar crime. Crime should have a reasonable punishment and then the problem would be solved by itself. Great work by the police in the video! But the punishment for repeated crime is obviously lacking when people can do the same crime many times a weak....

What’s the punishment after being arrested? That guy got arrested 31 times and he’s still turning up to cause more disruption!! He’s laughing!! Why aren’t they tossed in jail for increasing amounts of time?? How about this: 1st arrest: 1 day in prison 2nd arrest: 1 week 3rd arrest: 1 month Each subsequent arrest add one more month. For example, 4th arrest: 2 months in prison. 5th arrest: 3 months in prison. And so on. There will be few employers willing to wait on an arrested employee after a month. If these eco-terrorists keep getting arrested they’ll also have to lose their jobs.

Since green energy is not going to even come close to supplying all the UK's power for a long time yet, oil is going to be required for a long time. The protests are only about stopping the UK producing oil (be interesting to see them fly out to Saudi and try sitting in the middle of the road!) so the countries requirement would have to be imported instead, none of them seem to be able to explain why oil imported from abroad is so much better than oil produced in the UK.

I've said this before - give the police the necessary powers to deal with these incidents and they will do the job. The next problem is the courts - they could remand in custody on the basis that they are likely to commit further offences .... but they don't. They admit them to bail and, not unexpectedly, they commit further offences. The ball is now in the court's jurisdiction.

yes, let's drive to the protest site using a car that uses oil directly or indirectly while wearing clothes made with oil, so that we can hold signs written with oil about how using gas/oil is bad for the environment. and once we're done, we go back to our AC home which uses gas. makes perfect sense.

It's about time. 1st offense should be a fine. 2nd offense 5x the fine. 3rd offense 3 months in jail plus the fine. 4th offense 6 months behind bars with 3 additional months added for each subsequent arrest. Gotta nip these losers and their stupidity in the bud.

The police have always had the power to request anyone stationary on the public highway, including the pavement, to move on or risk arrest but this man appears to have been moving until the police stopped him. This reminds me of the miners' strike when the police stopped vehicles with a northern number plate getting to the colliery in Kent; at that time, I wondered if we had become the USSR where people needed a visa to travel within the country.

Section 137 of the highways act states it is an offence to willfully obstruct the highway. The draconian measures have been put in place because idiots attenpt to obfuscate the right to protest legally with acts of civil disobedience. Under s24 PACE an officer may make an arrest if they suspect a person to be "involved" with an offence. The term "involvement" legally covers anyone "who is about to commit an offence or is in the act of committing an offence", amongst other things. The protestors intention was clear. The officer reasonably believed the protestors were about to become involved in/commit a public order/highways offence. A warning was issued and an arrest made. The arrest was necessary to 1) prevent the unlawful obstruction of a highway and 2) effect a prompt and effective investigation. Wilfully obstructing a highway is an older offence, and would seemingly have to be balanced against the right to protest in some cases. The new public order laws make it clear that highways are specifically entirely off limits for protests and enable the police to take swift and effective action without the 5 steps previously required to prove the obstruction was "wilful". Not saying I agree with the new laws necessarily as they slowly erode our ability to be democratic and protest, but the disruption to the public was becoming insane so they've ruined it for us all. If it had been a few one-off protests, the government wouldn't have felt the need to amend the laws so drastically.

This is just cleaning the trash off the road. Make the fines hurt so it will stop this nonsense. Police should drag them off not carry them. In a modern democracy, a minority which has not managed to get majority support has the right to speak and lawfully protest in order to try to persuade others to their cause - that's a part of our broader concept of democracy. They do not have the right to try to impose their will on the majority through coercive tactics, even non-violently. (Blocking a roadway and not allowing traffic through is coercive, not persuasive). The alternative is chaos, with every minority trying to coerce the society in support of their cause.

This Chinese Lady would be better off trying to do something about repressive behaviour in he r own country, except she realises that she’d end up being re processed. Better to be here, and cause irritation safely. As it happens, I’d imagine that the majority of U.K. Nationals think that the action of the Police is relatively kindly compared to the Chinese Authorities, and timely. We all recall the perpetual irritation caused by these protestors, so this is a step in the right direction. The streets are for cars and vehicles going about their lawful business, and on the pavements, one moves along. when asked.
