PACE ACT regulations Powers of Arrest What is an arrest? An arrestable offence is an offence where the sentence is fixed by law, for example murder because this carries a fixed sentence of life imprisonment or any other offence for which the maximum sentence that could be given to an adult is at least five years. Who carries powers of arrest? Powers of arrest are obviously held by the police, but they are also held by private citizens. Police powers of arrest The police can make an arrest when they are authorised to do so by a warrant naming a person to be arrested and when there is a right of arrest for breach of the peace. The Police and Criminal Evidence Act (PACE) 1984 gives police the general rights to arrest during certain circumstances involving arrestable offences. Section 24 of PACE allows an arrest without a warrant in the following circumstances: Where the suspect has committed or is in the act of committing an arrestable offence Where an arrestable offence has been or is being committed and there are reasonable grounds for suspecting the person arrested (this applies even if it later proven that that person did not commit the offence) Where there are reasonable grounds for suspecting that an arrestable offence has been committed (again even if it later emerges that no crime was committed) and there are reasonable grounds for suspecting the person arrested. Where the suspect is about to commit an arrestable offence for example a burglary Where there are reasonable grounds for suspecting that the person arrested was about to commit an arrestable offence Section 25 of PACE Section 25 of PACE allows the police to arrest for any offence where: The name and address of the suspect cannot be obtained There are reasonable grounds for believing that the name and address given by the suspect are false There are reasonable grounds for believing that the suspect cause injury to themselves, other people or will cause damage to property. The arrest is reasonably believed to be necessary to protect a vulnerable person This means, if there is no arrestable offence, pace cant be applied.

I have to tell you, no matter the brand of car, but if I walked onto the premises of any company to be met with that roughty-toughty lot, there is no way I'd buy anything they were selling. This is a fine example of the public not knowing the law at all and thinking the police are there to deal with everything. The showroom guys understand they are on private property but don't know the law on trespass? That's no good is it? All they had to do was tell CJ he was trespassing and to leave, and then back that up with reasonable force to remove him if he didn't leave. It's no more complicated than that. In public or publicly accessible places,you create your own privacy. If ever stopped under terrorism act, for it to be lawful there must be a viable threat in place for the area your in and you or what your driving or using must be part of the alleged threat. You can ask the officer to verify this with the chief officer in charge at closest station. Otherwise police could stop anyone under the prevention of terrorism act..... These officers can learn a lesson if you pursue a civil action against all who were involved and the psni itself. Otherwise they learn no lessons as there is no repercussions against them. A small degree of legal knowledge and you can do the case yourself. Many solicitors will not help you even if your paying them for their time. But you can educate yourself legally. Over the years its how i have delt with them. Bringing them to court and getting to question them can be fantastic. They hate it and its under oath.. Police today still swear an oath to serve and this is important for them to carry out police work as its a code they must work under. You will never ever stop yourself from being arrested no matter what. You get your payback when you pull them into court and get them to pay out of their own pocket for all the losses you occur from that arrest.. your legally entitled to take civil action. Never ask an officer their name, just collar number and the station they work out of. I would also suggest never being aggressive or combative towards them, always refrain from swearing. As when your in court these things can an maybe used in your case to hurt your claims... i speak from experience sir. You can be cheeky and cocky, and swearing in public is not a public order offence. Ive some good legal information i will try to post up. This is the type of case id push and push because until its over you cant take legal actions against them. But you do have grounds for civil action.
