*Important* *Notice* *for* *Chargebacks* When filing the chargeback, don't say the transaction was "fraudulent", that will get the chargeback denied immediately, because it technically was authorized by you. You have to say that you ordered [product name] on [date] and that you haven't and won't receive the product you ordered because the company ceased all operations. It's best to be as detailed as possible when doing chargebacks to get your money back.

unfortunately credit card companies are as weaselly as any others. They shouldn't abuse customers' use of the word "fraudulent", in a way that lets them squirm out of responsibility. Scammed people get angry and I'm sure many jump on that terminology just because it expresses their negative experience. Saying you didn't receive a product is factual, but doesn't express the scamminess of this situation. It's sad. 🤬

@@squirlmy fraudulent to Them means you lost your card and it's stolen so basically there expecting a police report and would disable the card. Here the company folded and stopped giving refunds. So you need to engage there item not received process that's part of the Visa /Mastercard contract.

The fact that this whole situation was salvageable and that this company was salvageable, yet the CEO took none of the correct steps to do so emphasizes how much this downfall alongside everyone losing their jobs is a fault entirely placed upon the CEO's shoulders.

There is a tax fraud investigation going on though, it looks like it was a rather credible charge too since they got to the point of actually freezing company assets. The fraudulent sweepstakes was likely little more than the final nail in the company's coffin. I do not doubt the quick closure was an attempt to stop or evade legal exposure on the fraud case.

Considering the company name is now registerable as far I can tell, that would actually work. That said, these guys deserve some stability and Linus and Steve and Jay have contacts at stable established companies that they've alerted to the potential hires who have good experience.

@@ssanc6 KristoferYee only said it was weird because Noah approached him about it when Kris responded to someone else in Noah's chat and Noah realized that Kris once did a video with Linus. Then proceeded to asked Kris, to hook him up with Linus, while he was still on stream instead of professionally in a video. This is after he talked mad sh*t about Kris because Kris got picked for a panel spot that Noah thought Kris didn't deserve to be in. Then there is Noah's whole comment that Artesian Builds is the pc company that Linus would've made if LMG was a pc company. Noah's exact words you can see a clip of it at the end of KristoferYee's video "How this gaming pc company destroyed itself in one night." Basically dude is arrogant to the 9th degree.

@@Athasin GamersNexus did a video on Artesian, then were in talks with Noah to do an interview to get his side. This was before it came out he fired everyone, BTW. Noah was extremely unprofessional in the emails, treating it more like an opportunity to hang out (he said he was a fan of the show) then an interview about _his company being in tatters_ , even when they explicitly said they wanted to keep it professional. Then it came out Noah had fired everyone, and I think it was when they confronted him with that he literally said "guess that gives you more content :(", frowny face and all. Nexus ultimately didn't go through with the interview because they felt it wouldn't be productive for anyone. They DID reach out to former employees of the east coast branch, who they found out use to work very close to them, and offered to help them find work (like their former employer should've done...) Fucking wild.

Most content creators in the tech sphere would love to be featured on LTT because this is one of the largest Tech channels, especially for people building a company around their content because in the tech industry Linus has been the most successful at doing such things

As one of the employees from Artesian, I can say there are no falsehoods in this video, and hope to find employment elsewhere soon. This was an unfortunate ending to a wonderful group of people working to make PCs for people, lead by someone we didnt realize would do this. Cant pull Noah off camera, he wouldnt do that, and since he was sole owner nobody could change it. He wouldnt do anything that he thought made him look bad, to the point of getting rid of us. it was 60+ employees

To the employees. The community is so strong at this point so just keep in mind that if you want to build up your own company with this as a backstory I'm sure that we would support you with watch time, engagement, and possibly purchases of your computers. See it as a subtle flipping the bird towards your former CEO.

@@Fallen7Pie Well, no. Im obviously not saying that anything can be used from the former company, A, its not theirs, B, even if it once was its now not even the property of the former rightful owner. And neither am I saying that that all 50 employees should jump on this, you would be utterly insane if you started up a new business on day one with that headcount. Hell, Im nervous of my nine people and Ive been in business for years. What Im saying is that if (made up Artesian employee Tina) decided to start up a new Twitch channel and was loud about it, Im sure it would get enough tracktion that James, Tony and Anna also could jump on and still have a success story almost guaranteed in the aftermatch of the Artesian scandal.

From what I've heard, I feel like the story here is that Noah's parents gave him the money to start the company. He hired enough good people to run the company while he played at being Twitch famous. Then the COO left and Noah was incapable of actually running the business. Then the stream started a domino effect that revealed how far the companies troubles went.

@@AbiiHelianthus I used to build gaming rigs in the 90's when profits were actually good. What kind of prices did you guys have to sell so many machines ? I mean did you give great warranties but cost was higher than normal, or bare bones service but price was good ? The problem I have found with gamers ( 2010's up ) is they all know the costs of parts and don't want to pay much extra for assembly and warranty. I closed my retail store in 2000 becasue I refused to be part of the race to the cost bottom. I am not sure how people do making 10% profit now. I gave 2 year warranties parts and labor but profit was the standard 30% of the time and my cost thru my wholesaler was cheaper than having to buy thru Amazon or Newegg now. I am just curious how you marketed your machines. I live in South Carolina.

True Story: I was hired and then abruptly fired from Artesian Builds because I “didn’t have a presence on social media.” I didn’t know you can rescind a job offer just because someone doesn’t have a Twitter or Instagram. Looks like I dodged a bullet… Oh and btw, believe it or not. Artesian Builds did a lot of business. Like way more than you would expect. 50 employees with 2 offices on both coasts. That requires a lot of PC’s to be built and sold…

a lot of companies have started doing this, it's because people have no filter when posting on their socials and have their privacy settings set to basically " no privacy" so employers can use your fb/twitter/insta to se if you are talking shit about the business or doing leisure stuff on your sick days and reprimand you for it and prune the work force so it's only loyal workers.

all they had to do was have the CEO publically state "oh damn i did not realize what an asshole move that was. I got caught up in the business thinking and the return of investment and did not think about the actual humans involved. kiapia will receive her computer if she will have it, other than that im gonna take a break from appearing in our streams" and shit would have been fine from a PR point of view. Not great, but it does not cost you anything to calm people down by admitting you were an asshole. Then quietly change who even is in the drawing and keep him off the stream for 3 months and everything is gucci. Its a fire-able mess up but as a CEO you kinda just have to eat crow

But with these guys in charge? You're always on the ropes trying to avoid the KO, and it can't last. Criteria for eligibility is fine, because, as Linus said, you need a return on your marketing investment. But the proper way to do it is 1. Make the eligibility requirements known BEFORE you start the drawing and don't change the rules at the last minute- this protects you from legal liability. and 2. Eliminate those ineligible from the pool of possible names drawn PRIOR to the drawing. I don't know how stupid you have to be to execute this in such a shitty manner. From an optics standpoint, it looked like Noah Katz just wanted to get off on ridiculing small streamers. I hope he is never in charge of another business again because he's screwed pretty much everyone he's surrounded himself with. Employees, business partners, creditors, etc.

He technically said at the start of the stream that the rules had changed BUT he didn’t tell anyone else this so I had been telling everyone it was panel only. As that’s what’s I knew the rules to be. But looking back at like 2 hours 18 when he actually came on stream he said the rules were changed. (I don’t condone what he did and he was told that before we were let go.) I’m also the one who gave him the list of names. So if he told me these changes I could have organised a list for him to use. It’s his own fault for not telling his staff anything.

They didn't shut down voluntarily. They lied in their email. I looked into it. Thousands of Twitch and Twitter users reported them for sweepstakes fraud. This got the attention of the feds and the state of California. Their businesses were suspended by California and their licenses were forfeited to the federal government for tax evasion. There's a real possibility that Noah could end up in a criminal trial with some possible prison time. He got all the wrong attention.

The company must have been on the ropes already when that happened. Bad PR doesn't kill a company in a matter of days. CEO probably took the opportunity to blame the end of operations on that single event to cut his losses/not have to admit that the business wasn't viable in the first place.

HoegLaw went over how that last stream, specifically, may have even violated US gambling laws. Changing giveaway rules midstream, and adding the 3rd component of Chance, Prize, and Consideration (some form of buy-in - insisting on a considerable benefit to Artesian provided by entrants, the part about how nobody using her referral link had bought a system and then directly stating out loud that entrants must be providing them a significant benefit) are huge no-nos. By having all 3 components, it's no longer a sweepstakes giveaway, it's a *lottery,* which in the US are only legal for the states to run.

You probably already know the following things, but for all people who are in the same situation: When filing the chargeback, don't say the transaction was "fraudulent", that will get the chargeback denied immediately, because it technically was authorized by you. You have to say that you ordered [product name] on [date] and that you haven't and won't receive the product you ordered because the company ceased all operations. It's best to be as detailed as possible when doing chargebacks.

I think the company would only come back if he wasn’t involved and the good people we had could continue good, honest business. But obviously it’s not easy to start a company. So likely that won’t happen. Would have been easier if he just left and let us run the company.

I had this exact thing happen while bidding on a house when I was younger. Auction was supposed to end at 12pm and I was the last bid. The auctioneer decided it wasn't enough money and said he'd try again in a few minutes. He just got dirty looks when he went back up and I ended up with it.

@@PiousSlayer tbf i think it was late payments of taxes. In the meaning that this is something that happens quite often and states have regulations for it. So just pay the fine and the necessary taxes and you are gucci again with the state. Business operation tax or something. So it is NOT something that would make your whole company illegal. Its often called tax fraud, however its not but it is similiar. Also this would not be a reason to shut down the company.

I bought a PC from Artesian last year. I loved the experience of being able to watch it being built and also being able to get input from the builder in chat on compatibility and upgrades. It was a great business model. Too bad the CEO was an ass hat....

I'm responding to your comment at 5:53 about having tiers. As far as I know in the US, If something is labeled as a giveaway, prizes can't be tiered according to any particular condition on the entrant's side. The entire game has to be operated by random chance without any other conditions or considerations, so in the case of a build, a "top-tier" streamer has to be as likely to win a $1000 computer as the 18-year-old who has a Twitch handle but no streaming activity. In fact, the giveaway can't even require an entrant to have any account on any online platform, for that matter. Source: I tried to set up a chance-game business in the past (personal research)

FYI, they did at some point try to give the computer to KiaPia once it started spiraling out of control, but she knocked them back a peg. Solid move on her part. Also, people are saying that this was salvageable. This specific circumstance was salvageable under otherwise perfect conditions, but the company collapsing was inevitable even if Katz had done a perfect job of damage control and contrition. He didn't get shut down because he's crap at PR and a pretentious git. He got shut down because his company was in serious breach of legal tax requirements. So this outcome was going to happen, regardless. I think this situation just put a spotlight on his company from various government and legal authorities, expediting his demise.

The one positive thing to come out of all this is that if any former employees of Artesian start their own SI service while learning from Katz' obvious mistakes, they'll have their hands on a rock-solid foundation for a partnership program. If you're looking to farm clout and goodwill, don't get picky with an ambassador's socials and *give them what they've won*. Any publicity is good publicity, no matter how great or small. It's that easy. It's almost like Katz thought he'd pull in someone like CohhCarnage or xQc by snubbing contributors where these things start - at the bottom. You can't just manifest ex nihilo as a business owner, somehow crush it in Twitch metrics, and jump off the starting block with big-coverage types or quasi-memeable builds. Goodwill is earned, not manifested out of whole cloth.

My friend got a pc from there just a week before things went south. He is missing half his ram from his build, was meant to be 64 but he only got 32 in. He is also missing an m.2 ssd which was meant to be the OS drive, so now his OS is on his hdd. I don’t know how all this managed to get past the checks but now that the company has fell apart he can’t get those parts now. Edit: the 64gb of ram was a meme upgrade. It was originally 32 but as people did subs and cheers it got upgraded to 64.

That was the whole point, he ran the company like it was a kid selling stolen lunches after 3pm - even though it DID have a leadership triangle and 50 employees (or more if what I hear is to be believed, more like 300 including contractors, leavers and part timers). So there were safeguards in place but NONE of them were adhered to - not a single person at that company did a damn thing and so that's how it happened. It wasn't just one dude failing, it was the entirety of upper level management including the employees at top level.

They'd honestly not be able to make a decent prebuilt PC that any of us could afford. It costs a fortune to be able to compete at that level of discount, I am talking you need an opening stock of a million units bought in cash to get the cost down enough. That's the reason they've not already done it if you ask me, the cost versus the return isn't worth it at the price level people can afford. It would triple the system price for what? Having been built in a place owned by Linus? Because he won't be doing it himself unless it's MORE than triple price profit because why would be now he's super rich and popular on here? Economies have to make sense and unfortunately the economy for budget computing is shockingly bad at the moment, before you consider the impact cost of a new GPU! I could outcompete Linus in that area because I have zero costs and he could never go back to that.

The company didn't die from the live stream failure it was just the final nail in the coffin. As for the giveaways, while this was a true giveaway the majority of the streams were assembling purchased PCs with viewers being able to use gift subs to upgrade components for the purchaser in question (a streamer). If the gift subs were plentiful enough the purchaser could opt to giveaway components or even a whole PC to anyone watching the stream. While the upgrade mechanic happened all the time to varying levels the surplus reaching the amounts to trigger a new giveaway was far rarer. I watched the Artesian streams in the beginning, it was interesting to see how the fans of a streamer could donate gift subs to upgrade their favorite streamer's PC sometimes to insane levels but Noah became increasingly arrogant and mean-spirited over time and I couldn't stand watching him anymore.
