Half of Kashmir was lost due to negligence of Neheru, Neheru went to UN and made it an international dispute, Neheru did not change Article 370 neither Indira Gandhi did although she almost changed the entire constitution. Sibal wants 370 to stay not because it's abrogation he deem was unconstitutional but because there is no clarity on when and how a temporary provision became permanent. Looks like it became permanent on it's own without exercising 368 because no government said anything till date. I think such cases should be dismissed simply based on Article 1, 2 & 3 which gives centre enough power to parliament to reorganise or change the boundaries of any state without state's consent.

it feels so sad that we are hearing this kind cases being accepted in the courts of our country that challenges the authority of our country over our own state. Sibal is appearing for some anti-India client here, court shouldn't have accepted the Plea in the first place. It's a wastage of taxpayers hard earned money and resources. Moreover, it further raises question on the non-transparent model of working of the judiciary itself.

As a Kashmiri i have always rejoiced the 370 abrogation since it was nothing but a dead horse and most probably SC will uphold the abrogation as well. What i fail to understand is why is it irking so many people. The deliberations upon it in the highest court only reflects the true character of Indian democracy and the fact that arbitary legislations are liable to be struck down if passed in an illegitimate manner. If you ask me the proceedings itself is enhancing the democratic spirit of the country rather than doing any harm.

Whatever may be the arguments J&K is one state among the other states of India. There were Maharajas in all other states also. Democracy is now the King of India. J&K must be treated at par with all other states. It needs no special status. Hyderabad Nizam did not wanted to join Union of India. What was done then? Same applies to J&K also. Article 370 must end. This is the opinion of more than 80% of the people of India.

SC has made it clear in its famous judgement that parliament has the power to amend the constitution or enact laws without affecting the basic structure of the constitution. Then why can Art 370 not amended or abrogated or deleted by the parliament? Removal of Art 370 does not affect the basic structure of the constitution !

@@drsubashn4025 Sir,it was explicitly mentioned that the abrogation of article 370 can be held by the President but only on the advice of the Constituent Assembly of the J&K which Sibbal is arguing of.What the Union has done is through an implicit process,which is right in the sense and logic but a question on the process of abrogation of the article.

The recommendation to remove 370 should come from constituent assembly because at that time jnk Constitution was not in place. Then Constitution came and elections and constiruent assembly was dissolved. So arguably the recommendation should come from legislative Assembly which wasn't there because of President rule. This isbthe argument.

When J&K constituent assembly was dissolved and J&K constitution was replaced with Indian constitution , was the replacement not 100% ? How come some laws of Indian constitution were not accepted in to-to ? That's what one would expect. All provisions of Indian constitution were accepted and according to the same Indian constitution, govt of India and Indian parliament have the right and capacity amend any law without touching the basic tenets of the Indian constitution. I am not able to understand how some provisions were left out when J&K constitution was replaced with Indian constitution. . .

Had any one brought the plight of Hindus before Supreme Court for justice? If yes, rise up and shoutout. Unless you cry even mother won't feed you.Muslims are fighting for their right but Hindus had backtracked as I have seen in East Bengal it had been made East Pakistan. Why not North Pakistan or South Pakistan. I was a little boy but the plight of Hindus made me sad. Fight for your rights why leave East Bengal in name of Pakistan. I have studied in a government school of the district named Zilla school with only two hindu students. There used to be long Puja vaccination, Sarwasati Puja holiday but no function because of absence of number. Hindus are timid and never fought for their rights.

I had read Article 370 long time back and if I remember correctly it has mentioned in the definition of Art.370 that it's temporary. That word is there. So Hon.Sibbal saying it's not mentioned there in Art.370 isn't right. Although I respect Sibbals arguments here, he has made 1-2 very good points. Debates are welcome in democracy. But Kashmir was part of Bharat since Rishi Kashyap and it will be forever. Jai Hind!

6.38 _ CJI nails it. The 370 was a temporary provision brought in- the Constituent Assembly of J&K could have made it permanent. They didn't , while agreeing to acede to India. Assembly dissolved. 370 remains a TEMPORARY providion, NEVER made permanent. Case closed. Bye Sibal. Sibal has no case.

I really respect CJI who duely have opportunity to restarin and even with can make a joke using his power as CJI but still was in control to respect his senior as it was a court proceeding for the matter of fact...hats off to personality and emotional control of CJI... And I believe as citizen of India..that our constitution and judicial system may be attacked or poisoned by politics of the present situation but still it will stand for the conscience of Indian citizen his rights ...
