Barkha Dutt speaks to India’s legal luminary, Constitutional Jurist and Senior Advocate to the Supreme Court, Fali S Nariman, on the Supreme Court verdict on Article 370.
A 5-judge bench of the Supreme Court delivered verdict on a batch of petitions challenging the centre's decision to abrogate Article 370 in 2019.
While upholding the exercise of abrogating Article 370, the Supreme Court also directed the Centre to restore statehood to the Union territory of Jammu & Kashmir at the earliest.
The bench upheld the government's decision to carve out the union territory of Ladakh from the erstwhile state of Jammu & Kashmir.

Article 141 of the Indian Constitution advises that the law declared by the Supreme Court is binding on all courts in the territory of India. Article 144 says that all civil and judicial authorities must act in aid of the Supreme Court. Once the Supreme Court renders a verdict, regardless of controversy or matter, it is the constitutional obligation of every person and authority to accept the verdict rendered by it as binding. Article 370 was drafted under Part XXI of the Constitution titled as , TEMPORARY, TRANSITIONAL AND SPECIAL PROVISIONS,. So quibbling over the Apex Court's verdict is infructuous and pointless.

My father is 81 and suffers from Dementia. Looks like BOTH of the people on screen are also suffering from some type of a disorder. Anyways, just wanted to let them know that 2024 is going to be HISTORIC year AGAIN, starting with JANUARY 2024. JAI SHRI RAM! & BHARATH MATA KI JAI!!

When you are talking about constitutional matters this "Jai shree Ram" and other religious slogans are misplaced. Its merely a technical discussion and Fali Nariman is a renowned lawyer and constitutional expert and deserves to be heard. It is difficult to agree with him as SC has already given verdict in a different way..

cap, JnK became part of India because Indian army was deployed there before the armed tribal forces from other side of the border could takeover the Srinagar airport. And the orders to deploy army in JnK was not given by Nehru it was given by Sardar Vallabhbhai Patel to General Sam Manekshaw ( source - General Sam Manekshaw told this story himself in an interview to his grandson) . Same thing happened with Lakshdweep, Nehru lacked decisiveness and quick decision making, and Sardar Patel had to compensate for it. So the reason why JnK and Lakshdweep is part of India is coz of Sardar Patel not Nehru. pls come out of your delulu (ill)logical resoning.

@@xr55 wrong analogy bro. The point here is that Nehru was a very indecisive and incopetent leader. Thats why he lost the Congress internal election to Sardar Patel for becoming the PM, yet he became PM coz Gandhi again threatened a hunger strike if Nehru didn't become PM. Nehru wasn't nearly as fit or capable as Patel or Bose etc. But the same can't be said about Dr. Ambedkar, he was capable and itegral part infact president of Parliamentary committe.
