Technically, inside any part of an Open Prison is classed as 'within the prison'. HMP Hatfield is an open prison and Arthur Taylor and Marti Blagborough got in to serious trouble for filming there. So that would be one to ask a barrister or a solicitor about, as prisons are very shaky ground when it comes to filming, as I've found out.

I wasn't going to comment but this is really bugging me. As you enter into any HM Prison estate, there is a large blue and white sign with the name of the prison on it. It also informs you that you are now entering onto Crown property with no entrance to the general public unless they have a legal right to be there or words to that affect. I can see if I can get a pic sent to me for exact wording or if not, I can take a drive down to our local HMP next week & take a pic from the road. Either way, once you're past that sign, you're trespassing and if you don't leave when asked, those officers had every right to remove you as they did. I saw no use of force, no arm locks, no headlock, just a nice walk arm in arm to the barrier. You know as an ex con that you're not allowed to film on ANY prison property, Curtis. Is this what your problem is? Don't try to make out that Prison Officers are tyrants. Did they sometimes tell you no when you were inside? They go to work & very often get assaulted by the cons just because that bloke is having a bad day. Nice job isn't it? I wonder how many Officers you actually know outside of being locked up by them.

This time I think His Majesty's Prison Service were in the right. You were on prison grounds and was removed. Prisons, Military Bases, Intelligence Agencies, things of that nature, they have strict rules.

the police do have the power to take your phone off you under the terrorism act. they also can remove you from the private property and the laws you were quoting you do not understand them properly, it seems like you believe that inside means "inside a building" where in reality it just means inside the actual boundary of the private prison.

I have had experience of this place and have known a few people over the years who have unfortunately had been placed there and I do know how they treat the prisoners, now I can say not all guards are butt holes but there are some Hitlers there and have known an inmate get assaulted quite badly from prison staff and unfortunately they can't report it easily as the guard will make their life more hell than it is currently from threats to conveniently loosing paperwork and cutting their allowance of items and even silly things like making it hard for a visitor to see them "I had that experience" and only got 5 min at end because they caused all the issues yet I was the first person there waiting. To then see the person an old man with cuts on his face from where he was slammed down by a guard. After the old man was released he had soooo many stories of how they treat people there and things he had seen in general. He still has the scar from that assault by a guard to this day over a decade later. So in a nutshell yes they do treat the public sometimes very rudely as they think they are above you and the law. I always thought the idea of a prison was loss of liberty for a time not to be assaulted and have your rights removed because they think your a common dog!

You are 100% wrong. Even if there is an implied right of access once they verbally remove that access you have to leave otherwise you are trespassing. They have to give you a reasonable time to leave on your own accord after removing your implied right of access if you dint under common law they can use reasonable force to eject you. If you've been asked to leave a site by a member of staff, legally you have to leave as you're committing trespass. If you refuse it becomes aggravated and they can use reasonable force to remove you. If you know the law like you claim, you know you're BREAKING the law.

Crown property = criminal offence. You dont know the laws. Once youre asked to leave - which you were - and you refuse (obviously) they can escort you off. There is no criminal or civil claim. Just because the Council maintains a road it doesn't mean that it's council property / public property. For example, a council near me has an arrangement to maintain the local graveyard but it's still owned by the Church. The Council then invoices the Church for that service.

That's insane. 🙄 Their prison has a bad reputation, too. No wonder there's trouble and lots of drugs in there if this is how they treat prisoners. If you keep poking a bear, the bear will fight back... For anyone interested, not all prisoners in Cat D prisons get to go outside to work. It's more for prisoners on longer sentences to get them readjusted for release. Same goes for going home and returning. It's called ROTL (return on home leave). The first few times are with an officer but it has to be applied for inside the jail. You also have to be in your room by 8pm and can only leave to go to the toilet. Also, you can't just walk around or lay in bed. Cat D's are "working prisons", so if you don't have a job in there or refuse to work, you get shipped back to a Cat C or B. If you're walking around outside, you need a paper pass to say why you're not at work. It's not a holiday camp and there are more drugs in Cat D because it's easier to bring them inside and there are less officers.

I was in there years ago. Theres also Grendon which is a nut House prison. I only spent 1 month in spring Hill and there is a public footpath on the other side were prisoners walk and exercise

Prison officers in public are usually the worse. So used to bullying the inmates around they forget that out in public they have no power over free members of the public. That senior officer who turned up out of breath and psyched up was a real danger. Imagine getting hyped up into that state for a man in the car park.

Would like to know the outcome of this please keep us posted. If you would like to know what the actual law says on this please google Prison Act 1952 40D Other offences relating to prison security. As Curtis says, it clearly states 'inside a prison'. The question is where the boundary starts for 'inside'? I remember watching the Strangeways Prison riot in the 90's on MSM, they videoed the prisoners on the roof of the prison. Either way it was heavy handed.

They're allowed to use reasonable force under common law to remove a trespasser. You were a trespasser as you refused to leave. You seem to think you have some exemption from being removed from private property when you don't. What they did was lawful. And any civil claim would be laughed out of court.

The senior officer acted within law, he removed your implied right of access and removed you. I really do not care how they treat prisoners to be honest as they have broken the law. I usually support auditors but not on this occasion.
