Attorney General Ken Paxton sues Dallas, State Fair of Texas over new gun policy

"Municipalities cannot nullify state law nor can they avoid accountability by contracting official functions to nominally third parties," said Paxton. "Neither the City of Dallas nor the State Fair of Texas can infringe on Texans' right to self-defense. I warned fifteen days ago that if they did not end their unlawful conduct I would see them in court, and now I will."

Doesn’t matter if they are a private entity or not. The city can NOT lease to any private entity that does not want to follow state law and and refuses to allow guns on public lands as required by state law. If the State fair takes issue with this. Then they need to move the state fair to PRIVATE OWNED land and stop leasing public lands. Period. The state law makers will make whatever necessary changes to the law as needed that will force the issue for next year, and change the law for the Zoos as well. Personally I don’t like private companies operating zoos or fairs on public lands in the first place. They need to buy the land and make it private property or the fairs and zoos need to be run by a government entity. No more third party contractors.put them out of business.

The state has laws. These laws have to be followed. State law allows firearms to be carried on government owned land unless it is an educational institute, polling place, court building. The State Fair sits on government owned land and is NOT and educational institute, polling place, or court building, therefore you can not ban firearms from the State Fair. The zoo went through this also because it sits on government owned land. It was able to ban firearms because it had enough educational requirements it was able to meet.

No. Learn the law. The law says private businesses can bar firearms, and no place hosting a sports event can you carry either. The state fair however is taking place on government owned property and therefore can’t bar guns because the law states you can’t ban guns on government property unless otherwise banned such as schools, courts, voting places etc.

The State Fair of Texas announced its new policy last week, prohibiting firearms from being carried in Fair Park by anyone other than active or retired police officers. That's a very smart policy by the State Fair of Texas, makes sense.

@@UltraMAGAandproudofitread the law…. Private business can only ban firearms on PRIVATELY owned land. By law no government entity can LEASE public land to a private entity if the private entity is going to ban firearms. Thus making any lease the City has with the state fair null and void. A private entity may only ban firearms on PRIVATELY held land. The State Fair grounds are publicly owned. It’s no different than the BLM leasing land to ranchers for their livestock, and the ranchers are required to let hikers, campers, hunters and others to access the land. However the BLM clearly spells this out in the lease though too as part of the lease agreement. City of Dallas failed to do this in the lease with the State fair of Texas. Thus making their lease in violation of the law and their fore making the lease bill and void.

@@brianmw8559 that is your opinion, but that doesn't make it a fact. People have been able to carry there legally for years with 0 incidents. Last years incident does not count because that was a felon that should not have had a firearm in the first place.

Good. UNALLIENABLE RIGHTS SHOULD NOT / NEVER SHOULD.BE INFRIDGE. Amendment Two to the Constitution was ratified on December 15, 1791. It protects the right for Americans to possess weapons for the protection of themselves, their rights, and their property.
