Very well done video. I’m a Part 107 remote pilot and think it would be fun to take the drone while traveling. In total, the requirements on pilots in Europe are less than in the US, but most people here don’t invest the time and money to get the Part 107 license and just fly under the recreation exception, which doesn’t apply to most RU-vid or real estate kind of flights. Anyway, well done and thanks for the info, and the bloopers at the end.

Is it hard to get Part 107? I have heard about it but not really looked into it as I have not planned travels to the US in the near future. But I am not sure if it really pays of because you can't fly in national parks and most of the cool spots are in national parks :) Yeah there were so many fails that I just had to make use of them ;)

@@t0mwhazzup For me, the Part 107 took about 3 weeks to do. I took a formal course that was about 15 hours of instruction, plus lots of short tests before a 2 hour FAA exam at a airplane pilot’s school. I’m a lawyer by training so learning about airspace and weather stuff was totally new to me. There are plenty of beautiful places to fly that aren’t in National Parks, you just have to get creative about the landscapes. I’m in the deserts of Arizona and have been finding all kinds of great locations.

For clarification: - You can fly within helipads, as long as you do it outside of their operating hours (most of the hospitals have 24/7, but some don’t). The AustroControls app doesn’t show the operating hours and it’s database isn’t always up to date in regard to operational helipads. Valid information is found in Austrias AIP. - In addition to that, you possibly could get a charged permit from the authority, if you need drone shots for business reasons within Viennas helipad zones. - Your also allowed to fly within the control zone of an airport (but not the inner safety strip). With a sub 250g drone up to 30m without permission. If you want to go higher, or if you have a heavier drone you can get a permission via phone from the respective tower controllers in charge.
@t0mwhazzup

Good additional infos, thank you. I have done some commercial work within the inner safety strip of military aerodromes where I had to get a permission of the ministry of defense. Hi Karin! Thanks for your nice feedback! Regarding Hallstatt, last time I checked you were generally allowed to fly there, but as you always have to consider privacy as well, I wouldn't fly directly through town, but rather fly along the outlines (shoreline etc.), which makes more sense image-wise anyways. In general, you always have to check separately before a flight whether you are allowed to fly there (there are apps and websites of each national aviation authority, in this case Austro Control with its DroneSpace map. I have another, more recent video with the new rules that apply from Jan 1st 2024, it is for whole Europe and has all the new rules. DJI Mini are not toy drones. Actual toys never have 14+ or 16+ markings and have CE marking for toys. Toys have their own rules and had those 30 m even when all other drones were banned.

@t0mwhazzup
@t0mwhazzup Год назад
Hi Gary, thank you very much for your feedback! Happy if it helps. According to my information, you don't need any permit to take photos or videos, you just have to register your drone. Of course, you have to adhere to privacy laws, but that has nothing to do with Austro Control (they are only responsible for airspace use/laws). I don't know privacy laws inside out - I'd just use common sense. I don't take photos or videos with people in it where you can clearly recognize them or make videos in detail of someone's garden/appartement/private space etc. Sorry that I cannot give you any more details on this aspect, but as long as you respect other people's privacy, you're good to go. And if you use it only for personal use and don't upload/publish your media, I wouldn't worry too much anyways :) I hope you're going to have a good time in Austria! Depends on what's in the footage/photos you have taken. You have to take care of people's privacy. If you don't upload videos of people or in any other way not publicly accessible places/things, I would not worry too much. @@t0mwhazzupIn Sweden we have to get all Photos reviewed by ”government” unless they are excused. The special occasions that DO NOT require approval are “if it does not contain the horizon” and some other special conditions. So e.g. if it is taking pictures of a ski slope with lifts and you see the sky, it must be sent for approval. Seems like it is easier in Austria based on your comment.

Hi! Can i use a racing fpv quadcopter? In the fields, for example, without insurance, documents, without anything to just go launch the drone and fly. Without licenses and the second. I am not from Austria, but I am interested in this.
@t0mwhazzup
@t0mwhazzup Год назад
Hi, unfortunately it's not legal. The same rules and requirements apply to FPV drones, and most probably (but not sure) you'd rather have to stick to open category A3 (far from people) independent of the quad's weight (because the higher speed has greater impact). But that's just speculation on my part. When you're from within the European Union and are registered in your home country, registration is also valid in Austria, and if you have insurance it might also cover flying in Austria. If not, registration is around EUR 32,- for 3 years and insurance you can get for around EUR 40-60,- per year. And when flying with goggles, you'd require another person to act as spotter. Hope that helps!

@t0mwhazzup Год назад
That's very kind of you, thank you! Happy if it helps. You do not need to register your drone. You just have to register yourself as drone operator to get an operator ID as long as your drone is lighter than 250 g and the top speed is lower than 19 m/s (= 68 km/h or 42 mph). I guess your FPV will be faster, so you have to complete online training and pass the exam. For that, check the chapter at 2:24 . When it comes to flight rules, for self-built drones, below 250 g and 19 m/s, you can fly in open category A1, otherwise you have to fly in category open A3. I hope that helps and I hope that you enjoy your stay here in Austria ☺️ If I can help with anything else, please let me know.

Hello Tom, I have a question? i did register my drone here in the Netherlands by the RDW, there i got a special number which I attached to my DJI Mini 2. So now i just need a liability insurance that is valid in Austria and then i am good to go, or do i still miss something? plus i will stick to the general rules. i am not really interested flying over urban areas. I like to use it during my hikes into the mountains to capture myself. So the 330 euros for filming myself isn't an issue anymore? another question, for the insurance i just tried it by air and more, but they only accept Austrian postcode, do you think i can use the adress of a guesthouse legally were i stay?
@t0mwhazzup
@t0mwhazzup Год назад
If the special number from the RDW is your Operator ID, you should be good to go. In general, Op IDs from a country within the European Union are valid in all EU countries :) There is no information about a filming fee on the Austro Control website anymore and I was in contact with them and they did not mention a word about that - this seems to be old information on drone laws website. Unfortunately they can't keep up to date with all country laws. Regarding air and more, I'd suggest you contact them yourself. I'd suppose that like with every insurance you need to give your real resident address. If they really don't accept customers from outside Austria, which I don't believe, I'd try to get a drone insurance in the Netherlands. Usually they are valid worldwide (like air and more, except US and Canada). Hope that helps! Let me know if you need any further help.

In Salzburg city you cannot fly, it is within the security zone of Salzburg airport and strictly forbidden. Hallstatt itself is a no drone zone, there are signs there. The residents don't want you to fly there because there are so many tourists and drone pilots so that can be pretty annoying for them, I imagine. As long as you don't conflict with privacy laws, you can fly there legally, but I'd advise you to do it in a way that does not annoy anyone. I have flewn over the lake to get a good shoreline view of Hallstatt, but not really over Hallstatt itself. Hello Tom, great video! Im planning a holiday and read some things about drone flying in Austria that where not mentioned in the video. I have read that you need to get a permit from Austro control when your drone Weight is above 250 gram (.55lbs) or if the drone is flown above 30 meters (89 feet). And you always need a permit, regardless of whether the videos/photos are for private or commercial use. If you dont have a permit you could get a fine of 22000 euro's. I dont know if this is still relevant (i assume it is), but maybe you can explain this. Greetings
@t0mwhazzup
@t0mwhazzup Год назад
Hi Marco, thank you! Happy to hear if it is of any help to you. Most probably you've read some old information. Generally in Europe, there have been some major changes since before 2021, where EASA guidelines came into force in Europe. I didn't mention all this in detail because I didn't want to make the video longer than necessary. The individual states can deviate from those EASA rules in certain points (which could make it potentially more complicated), but Austria applies the EASA rules mostly as they are (except from additions regarding national flight restriction zones etc.). The height limit is generally 120 m. There might be some restricted airspace that starts at an altitude below 120 m, which would mean that you would be allowed to fly only up to the altitude at where the restricted airspace starts. But I am not aware of any airspace like that. Always check the apps individually for the location you want to fly in. I prefer the Drohnen-Info app as it includes all possible restrictions (like national parks etc) while the Dronespace app considers restrictions of the airspace itself only. The Drohnen-Info app might be more confusing to people that don't speak German, but as I explained in the video, as long there are only two points mentioned in the selected location (one being the allowed flight altitude, the other one being whether you are allowed to fly over people or not - depending on the drone category you selected), you are allowed to fly. Additional points impose restrictions. You can send me the link where you've read about the 30 m altitude restriction and that you need a permit above 250 grams and I can check it for you if it has any validity. Of course, I cannot take liability to give you 100 % valid information, but I'd say I am quite up to date when it comes to the flight rules here and try to provide the best information I can. When it comes to commercial flying, I am not aware that there are any additional requirements like permits, at least not by the state of Austria. With private property, I'd assume you might have to check of course with the property owner if commercial filming is allowed. As I am a hobby flyer only, I cannot give you accurate information about that. What are you planning and what drone do you use? Greetings, Tom

@t0mwhazzup Год назад
Sorry I missed your comment. Maybe I can help, what exactly needs further explanation? If you go to map.dronespace.at make sure you select "en(glish)" in the upper right corner. And on the map itself, each colored area is an area in which you are not allowed to fly. In order to get more details, set a pin where you want to fly, and if there's an area restricting drone use, you get information on the left side. If there's more than one area at the site you put the pin on, you'll get a list of areas and you can click each to get further information. In general, wherever there is a colored area, you are not allowed to fly, BUT (opposing to the app) in the browser based map there are also areas that do not start from ground (e.g. the big yellow area northwest of Vienna starts at 2500 ft above ground). I don't know why they include such areas in the map as they are not relevant to drone pilots in the open category (up to 120 m / 400 ft above ground). So that makes it a little more confusing than the app. Did you look for the other app, Drohnen-Info? Is it available in the US? It might look a little bit more confusing but once you figure it out (check the video for that) it has complete information to offer (compared to Austrocontrol sources) as it also includes areas that restricted drone use not related to airspace structure (like national parks etc.). I hope I could clear things up. If not, let me know and I'll try to help. Cheers!

Unfortunately, at the time of producing this video, I was not aware of the fact that the apps mentioned are not available in many countries outside of Austria (which is very stupid in my opinion). There seems to be a web-based version of Drohnen-Info here: www.oeamtc.at/drohnen-karte/map It is really complicated with Naturschutzgebiete. Each county (we have 9 in Austria) is responsible for those laws and there might be differences - I have not found a definitive conclusion on this. You are allowed to fly in and around Hallstatt even though there might be some signs that say "No drone zone". They put those signs up just to prevent too many tourists to fly but there is no legislation to my knowledge that prevents you from flying there. BUT you are, depending on your drone classification, not allowed to fly over people or assemblies of people AND you have to respect the privacy, so be very considerate. I have only operated my drone along the shoreline of Hallstatt and above the church area when there were not many people around, so that should be fine. But be always prepared that somebody walks up to you, people are very sensitive there and even though there might be no legal basis for the "No drone zone" signs, I would still see it as a plea from the people of Hallstatt to respect that at least in a way to not obviously disturb the people there or intrude in their privacy.
