Thank you po for this Attorney! I also would like to add po na bawal din magvideo and picture sa hospital. Madami pa rin po kasi ata hindi nakakaalam kaya we always have to remind the patients especially the relatives about this, though usually may posters naman around the hospital as reminder, medyo marami pa rin po pasaway at nagvivideo or picture pa rin.

atty.wag mona sabihin na tingin ko puwede and dapat na sinabi mo , ay ganito Puwede i record ang isang individual kapag ang conversation ay nangyayari sa isang Public Concersation o Public Place at hindi kapag private conversation simple as that para naman maengganyo o hindi matakot ang mamamayan na mag record ng isang argumento sa isang pang Publikong Lugar o Pag uusap.

On the other hand, it may be considered public communication if the communication happens in a public place in the presence of bystanders. Paano po kung hindi public servant, paano po kung kapwa civilian pero nasa publikong lugar? Ano po ang limit sa legality?

Kung nangyari ang isang communication in the presence of bystanders sa isang publikong lugar, maituturing ito na "public communication". Ngunit best practice na tuwing kukuha ka ng video, karapat dapat na iyong ipaalam muna na kukuhanan mo siya ng video.

sir i have a follow up question, in the event a crime is commited within the home (ex, child abuse in a verbal manner) and you document the crime by recording it in attempt to get evidence, is that still a violation of the anti-wire tapping law?

Yes, the recording may fall within the scope of the Anti-Wiretapping Act if it is a private communication and the person being recorded does not to the recording. However, there may be consent when the perpetrator carries on with its acts despite being clearly informed that the incident is being recorded. Please know that video or audio that was recorded without consent cannot be used as evidence in court, according to the Anti Wiretapping Act. Magingat kayo, dahil di lang ito bawal, ito po ay krimen. Kung kailangan niyo ng ebidensya, sasapat na ang testimonya ng kung sino mang nakarinig o nakakita. Kung may tanong pa po kayo tungkol sa batas, kumonsulta sa ating Free Legal Helpdesk, kakampi! Atty. since eto na yung topic natin tanong lang po kasi may mga taong nagrerecord nang hindi alam ng iba tapos i uupload nila sa social media para pagtawanan, or maging kahiya hiya yung nasa video.anu ano po yung pwedeng maging kaso nang nag upload at magshashare ng mga nasabing video.

Depende sa sitwasyon. Kung ang isang private conversation ay nirecord ng walang consent, maaring sakop ito ng Anti-Wiretapping Act. Kung may paglalathala sa publiko (tulad ng post sa social media) ng mga sadyang malisyosong imputasyon o pahayag na nakakapanira ng puri, maaring ituring na libel o cyber libel ito. Kung may tanong pa po kayo tungkol sa batas, kumonsulta sa ating Free Legal Helpdesk, kakampi! Mag-message lang sa m.me/cheldiokno.

Ayon sa National Privacy Commission: “Whenever anyone is making an audio or video recording of you, or even just taking your pictures, you have a right to know, and you must always be given the chance to opt out when you don’t feel comfortable.” Best practice na tuwing kukuha ka ng video, karapat dapat na iyong ipaalam muna na kukuhanan mo siya ng video.
