If an 'illegal' walks into a gun store, presents a drivers license (real or fake), and lays down cash to purchase a firearm, what would happen? Though in all probability the sale would be DELAYED because of a missing background check, the 'illegal' would still be able to obtain the firearm after 'x' number of days even if the background check had still not come back as approved. Right?

Is it something the gun show itself requires? Legally not all states require a person to have an FFL to sell guns at gun shows. My dad usually runs a table with his friend who has his FFL, but if he went one state over he wouldn't have to.

Yes, for the purpose of the gun show someone setting-up a table to sell firearms would need to register (with the gun show promoters) as a dealer, but that's not the same as registering with the ATF as a [business or commercial] dealer in firearms.

Only FFL dealers at gun shows did background check as required by their FFL license. Other 'dealers' that did not have an FFL also sold firearms without doing a background check, and in some cases, not even checking the purchasers ID even though these private 'dealers' were technically required to have a license because they sold firearms as a business.

It is true that private dealers routinely sold firearms at gun shows who did not do any form of background check, some including not even checking ID's, allowing the purchaser to walk out the door with their newly acquired firearm. So yes, the 'gun show loophole' did exist whether you believed it did or not.

It surely did because the “gunshot loophole” wasn’t just about sales at gunshows, even though that became the popular term. The actual term has been “private sale exemption.” It means any private seller may sell a firearm to any federally unlicensed resident of the state where they reside, as long as they do not know or have reasonable cause to believe that the person is prohibited from receiving or possessing firearms. Those sales occurred online, via ads, privately amongst friends, family or acquaintances, or a private individual selling at a gun show.

Actually there was a 'gun show loophole' and what that was about was non-licensed sellers of firearms claiming that because they are just doing private sales rather than for business, they don't need to do background checks or have an FFL. A lot of guns end up on the street through these PRIVATE sales that are actually being run as an 'under-the-table' firearms business - but let's all pretend it doesn't happen . . .

People register with the gun-show promoters, set up a table, and display their guns and accessories for sale all the time. They avoid the need for an FFL by presenting themselves as just selling privately instead of as a legitimate business. But you already know this even as you try to pretend that it doesn't happen. The ATF has been trying to clarify the difference between a PRIVATE seller vs a COMMERCIAL seller for years, always just 'kicking-the-can' down the road each time the anti-gun crowd rears it's ugly head about this 'gun show loophole' of selling guns without a background check. But again, you already know this. I'm not saying yay or nay, but simply stating what has happened, is happening, and will probably continue to happen- it's called Capitalism.

This will also get shot down in June, the ATF doesn't have the authority to make laws. They have been told this over amd over, time to abolish the ATF

The rule changes the definition of firearm sellers who are engaged in business and would therefore be required to obtain a federal firearms license(which requires the seller to conduct background checks)to include those selling guns at gun shows, flea markets and over the internet.

It's not a big of a win as you think. These loopholes were closed after the Las Vegas incident. I hold a FFL and did chain of custody transfer compliance for the ATF. The laws have been in place for over 10 years, he is trying to garner votes. If you came to me for a background check I could tell who lived with you, who in your family is a felon or mentaly ill. It even gives me names of your extended family and people with the same name that are felons. There are around 50 questions breaking this down, it's not quick. I'll give you an example, a young woman wanted to buy a .22, I put her info in, a black ball appeared next to her name with a number to call. When she was in her early 20s, he BF got busted for dealing cocaine. She didn't get charged, but stipulation was she can never own firearm. She had no idea so the cops didn't bust her just came to explain the situation to her. The government knows what is where and who got it.
