Police department’s complaint system, internal review and investigation, district attorneys and lower courts have all become irrelevant. There is a conflict of interest there that if they rule in the favor of the complaining citizen then it gives evidence for the person to sue monetarily and expose their corruption. So automatically they’re always going to rule against the person and hope that stops them from going any further. You have to just assume that no matter what you’re going to have to go to a higher court that is hopefully not corrupt also.

Fantastic video that again shows the ignorance and arrogance of LE today in 2022. It typifies that LEO's will always fall back upon Qualified Immunity. Qualified immunity lets the police off the hook for misconduct and denies their victims compensation. Police unions claim that qualified immunity exists to protect police officers who play by the rules. But it does the exact opposite. Qualified immunity only protects officials who have broken the law.

@@Sweetyhide In states like California and Texas you must be arrested. You can be detained for reasonable articulable suspicion of a crime but do not have to identify. In some states it’s when you’re detained that you must id but they must have reasonable articulable suspicion of a crime to detain you in the first place.

@@nightcross1030 municipalities already pay the price. By tax funded lawsuit settlements. That needs to stop and let the officers pay for it out of pocket themselves. Or require them to carry liability insurance and when they get too expensive and get dropped they get desk duty only.

END QUALIFIED IMMUNITY IMMEDIATELY. We should be able to sue these cops personally. Start draining their pension when they violate our rights. Why should the taxpayers foot the bill for their inept policing. Colorado and a few other states ended qualified immunity. It’s time all 50 states to end it.

Qualified Immunity is not the main problem. Terry v. Ohio SCOTUS case is the main nullification cops use against citizens to fleece them daily. Qualified Immunity (when applicable) is an after thought. Reverse Terry v. Ohio and the excuse to begin thousands of interactions would disappear over night. Without Terry v. Ohio the "Officer Safety" excuse to nullify rights would cease to exist thus the police would not be able to interact unless they had "Probable Cause". Right now police will manufacture their reason under "suspicious behavior" and attempt to create the narrative of probable cause just like they did with this case. Let's not forget that this case passed through the lower courts showing that the criminal activities go from the officers in the field all the way up through the prosecutor and local magistrate (judge). Most would not have the ability to show this level of blatant impunity exists because the costs associated with hiring an attorney to navigate a case like this is almost 100K or more. This case is an absolute service to the public and the Pro Bono lawyer who helped is a legal hero!

Qualified immunity still exist in Colorado and New Mexico. There are two separate courts here, state and federal. Most civil rights suits are federal suits. The Colorado law for example doesn't exactly end QI it just changes it. In fact it works out good for the officer because his liability is limited to $25,000 the rest is on the city. The city can also indemnify the officer, assuming liability on behalf of the officer. Haven't looked into New Mexico. However I 100% agree with the prior comment regarding RAS as a more significant issue as it is what gives the officer the authority to violate rights as we so frequently see. QI doesn't apply to criminal charges and in fact once convicted QI is a much lower hurdle to overcome. One option we might consider is using grand juries to allow citizens to bring criminal complaint against public officials. An indictment would then mandate the state prosecute the crime. Why should we burden the individual to police the police by financial cost. Let's have the state use our taxes to police the police. An alternative would be to allow for a private or special prosecutor at state expense who would not have the same conflict of interest with a local police department. QI will always exist to some extent, it should never be what the courts have made it into but it will always exist. Just some thoughts

The court even shared an opinion that Stray was arrested because he was obnoxious. Essentially claiming that they arrested him because he didn't submit like a beaten dog to his masters with badges. Immunity should go out the window in this case.

It’s because of how police are trained. They’re trained to get all the info they need for their report. What information the report consists of varies from department to department. Here in America, we don’t train our police force to know the laws they swore to uphold, instead we train them how to fill out paperwork…

Yes, it seems like a fairly easy and open and shut case there was no reasonable articulable suspicion of a crime committed the officers didn't even make up a fake one and they had no right to check his ID, it was funny how the appeals court judge took what seemed like 10 seconds to reversely magistrate judges decision, this shows clear and present corruption amongst the Magistrate Court as well as the entire police department and police chief, he should be able to very easily Sue not only the Magister judge or magistrate court but as well the entire police department as well as the police chief they should all be stripped of their qualified immunity because they very clearly did not follow the law and negligence of the law is not a defense.... Tired of these damn feelings police

At this point, we're used to seeing vidoes about cops getting the law wrong, but when the courts get it wrong?? THAT is the real danger in this case. Charges should have been dropped as soon as a DA reviewed the case. The fact that it went to court and a judge upheld the charges is the disgusting part.

That magistrate judge should be removed from the bench, the guilty verdict he or she handed down was knowingly in contradiction to the law and constitution, and was only handed down to push an agenda. That is the most extreme kind of tyranny, a judge ruling against the law and constitution has no business being on the bench, they belong in jail.

Putting someone in cuffs and taking them away, without any reasonable suspicion that a crime actually has been committed, should be seen as a kidnapping. Adding charges afterwards should be seen as retaliation.

This is the worst part of this case. We've seen officers, mayor's, and prosecutors ignore the rights granted not just by the Constitution, but even past legal decisions. To rise high enough to become a judge and see that video and find the guy guilty over something as flimsy as suspicious circumstances, is awful. Whoever that judge was needs to get their brain checked.

They have to work with the police on a daily basis, so of course they side with the police, as a single policeman with a grudge can make a case so much more troublesome and timeconsuming. Now, here is what i really don´t understand. when you have policemen that are rotten to the core ( yes, shocking i know, but they do exist ), the police union is often there in a hurry to defend them tooth and nail. This lowers the publics trust in the police all over the country, and make the job harder for all good policemen and women out there. Is the police unions actions really in the police best interest, or do they just assume that most of them are rotten - and act accordingly ?

This is an older story, and I remember the judge give her ruling. It was awesome that she upheld the constitution and the auditor was cleared. What’s horrible is that the auditor had to go through years of litigation to clear himself! That goes against everything that country was founded on.

It's standard operating procedures. If Stray Dog had not been able to get good legal help, this case would have ended with a conviction for the auditor. So many cases like this go through the system, and are never challenged.

That ruling is caused by the same reason the police arrested him: corporate tax money. Both the local police and local courts are _heavily_ financed by this private entity - the largest refinery in New Mexico. They'll do whatever it takes to make sure their biggest -customer- provider is pleased with their "service" to the community.

Even the judge who finally corrected the previous judge snd the 2 incompetent officers still showed her lack of respect for his rights by saying he was abnoxious by sticking up for his rights which he certainly was not. You can still be polite when you stick up for your rights, and Stray Dog wasn't as polite as he could have been. Not that it matters in the long run, because as the appeals judge stated it's not a crime to be obnoxious anyway. So even if he was 100 times more obnoxious than he actually was, it wouldn't have justified any legal action against him. If that influenced their decisions in any way, that's a major failing of the police AND the original magistrate.

I think the male cop was just as bad if not worse. He was so adamant that he was correct. Which reflects either a terrible understanding of the law or even worse a blatant disregard for the public's rights. I'm not even American I am Australian and as the auditor stated to many people have died to protect those rights. Exactly, cops were given QUALIFIED immunity...this has spun into almost an ABSOLUTE immunity. Police should have personal liability insurance the same as doctors have. This would be a perfect solution for what the Supreme Court INTENDED with qualified immunity. If you are a public servant, you shouldn't have ANY type of immunity from your actions to the people you serve.

You'd think with all the incidents when cops failed by asking for ID without probable cause they'd retrain them or send out a memo or something to get the news out by now. But they continue to behave as per usual and no changes have been made thereby continuously violating citizens rights! It's ridiculous. THEY work FOR us! Not against us. Thanks for following up. This type of arrest is going to go to the USSC sometime as 4 circuits have not explicitly ruled filming police and filming in public to be legal.

Recently a case was brought to the USSC but they choose not to hear it. So they punted and all lower court rulings stand. So if people are in circuits where filming has been affirmed then they are still good to go. But the circuits that have not ruled or not ruled favorably leaves auditors and everyday citizens in those areas in jeopardy. And the biggest problem with that is people don’t realize that. They keep hearing "the Supreme Court has already ruled that filming the police and govt officials in the performance of their duties is legal as long as the filmer is somewhere they are allowed to be." I cringe when I see this happen by auditors, who are not helping others in those outlier circuits, when they don’t put up disclaimers that tell viewers to check their areas laws and applicable court rulings before trying this themselves because it’s actually not a Supreme Court ruling. Or just stop saying that altogether.

Stray may have been a 'slightly' antagonistic auditor, but he has been one of the most level headed auditors to flex his rights and voice them appropriately. I'm glad his charges were overturned to the proper ruling. Even if the appeal judge was harsher on his actions, he was within his rights to do all he did.

It’s crazy that law enforcement will post pictures right away of someone who was incarcerated, but will take ages to report someone missing! I’ve seen it first hand! Thank you for this!

The city prosecutor got Stray Dog to admit that the only reason he didn't provide ID was to stand up for his rights... as if that's a petty or frivolous reason! I think that salient fact completely makes Stray Dog's case. He didn't refuse to ID to avoid being identified for outstanding warrants or a prior crime. He did exactly what he repeatedly tried to explain to the cops who illegally arrested him. He refused to identify himself because he had committed no crime and they had no reasonable articulable suspicion.

It still never ceases to surprise me when watching cops insisting that citizens have to provide ID when they haven’t even committed a crime. It then makes me even more pi**ed off when the cops arrest a citizen for not producing ID with no crime, but then they make up bogus charges when they realise they’ve made a mistake (in order to justify their utter incompetence)☹

And the judge then says "guilty" and the man has to spend years of his life fighting the charges... No punishment for the officers involved or for the judge who sentenced him... The law doesn't work for us, it works for the companies paying their wages. We need a police service that protects against federal law, a people funded policing system that actually protects people. The funny thing is it would be deemed a terrorist act and labeled as a "mafia"... Actually protecting citizens is illegal in America.

Why oh why aren’t cops educated in the rights of citizens . The bill of rights state clearly what is our freedoms and cops should know this forward , backward , inside , outside and upside down . Qualified immunity is the go to card to protect the ignorance of the laws all LEOs have sworn an oath to uphold. I say do away with the oath altogether if it is forgotten as soon as recited . It means nothing apparently . Just ask any LEOs to recite their oath and wait for response. I wonder how many could recite the pledge of allegiance ?

You are 100% right once our government stop us from videoing, then that will give them a clear path to hide while they finish attacking our second amendment, and once that’s done, we will be at a Civil War, and remember “Shall not be infringed! “Our second amendment does not mean to have an national guard, especially since the government put National Guard at war overseas, However the Second Amendment was established just to fight our/a tyrannical government!!! Most of these problems started with the Supreme Court of 1967 granting “Qualified Immunity” thus the “lust for power” became protected, And if the democrats continue on their lust for power we will be in another Civil War!!! This time it will be”We The People” against government, police, judges, city officials, politicians, ATF, FBI, CIA, hell even IRS you do remember that IRS is buying millions of bullets an year and millions of AR-15 (I’m not sure if are AR-15 which are semi automatic, or the military style M-16, M-4 that have the capability of semi-automatic fire or full automatic fire! )thus anybody who can claims qualified immunity in any form and those who supported it will be on one side and then “We The People” will be on the side! No policeman will put on their uniform without fear running down their backs, knowing that someone out there might start paying them back for one of their children that was slaughtered or beat to death by cops! Since 2017 to March 2022 more than 4000 Americans have been killed, murdered by the police and that’s only the numbers that were reported from the police departments themselves with more than 30 to 40% of the police departments refused to report how many civilians they themselves have killed or murdered!!! Those cops had no clue what was going on, They were so bent on getting as ID it was like crack to them, I hope the judge does the right thing and disqualifies their immunity For the officers, They had no clue About the Constitution law when it comes to filming, Stray dog did a really great job and I'm looking forward to more of his audits

How did the first judge find guilt in ANYTHING he did? How did the judge not see that when the “failure to ID” charge didn’t stick, THEN they come up with all the other charges? Especially when it’s obvious to everyone else that those charges were strictly “cover your ass” charges. All of this could have been avoided had the cops that showed up knew the law…KNEW THEIR JOBS.
