The plaintiff paid for the defendant's DJ services for his wedding. However, a hurricane had different ideas, and the wedding was canceled. The defendant agreed to refund the plaintiff but never did, so the plaintiff is suing. The defendant argues cancelations must be made 30 days before the event to get a refund, and the plaintiff canceled three days prior.

Defendant specifically DOES NOT want his surname used. Within the first 5 seconds, Plaintiff immediately uses Defendant's surname.

As a business owner myself, there often comes a point where morality should overtake "business". No way I could benefit from someone losing that much money just because my contract allows it.

Did you not listen to anything they said? They paid the remaining balance just before the hurricane, the contrast provided for ONLY rescheduling, not a refund.

Yeah honestly, as a small business owner myself, I take a deposit at the point where they decide to make the investment, and then the other half is due the day after the event, once the services have been rendered. That part didn't make sense.

I wouldn't sign that contract. A more fair resolution would be one of two things: either 1. Give plaintiff back $600 and let defendant keep $350 deposit or 2. Let defendant keep $950 and plaintiff can reschedule. $950 is a bit much for doing nothing.

I agree! If I were the defendant, I wouldn’t want to be bothered with a reschedule. Also, there is a moral issue but apparently they made sure that their feelings stayed out of the contract. 👩🏿‍⚖️

The plaintiff signed onto that contract. As crazy as the stipulations were, he did agree to them. So the defendant is correct.

Of course not. If the plaintiff had chosen, for whatever reason 90 or more days out to cancel, he would have gotten his money back. The only thing the hurricane did was force a reschedule and would also force the defendant to supply services on the rescheduled day.

He was betting on them not reading the contract. He did a really scummy thing and they were stupid for paying him in full before services were rendered. The fact that he wanted payment in full immediately was because he knew the wedding might be cancelled.

I would think that being they're Floridians that they would have a more in depth conversation pertaining to the weather and how it would affect the contract. He knew they planned their wedding during hurricane season 🤷🏾‍♀️ I don't live in Florida but I do live in the south and we know when hurricane season is

It amazes me the number of people that don’t have much common sense. I was taught at a early age the meaning of the word NO. I would have never signed the contract. Contracts are most of the time binding, unless misrepresented.

All of my customers got a refund. Morals. Also you just lost all future bookings with any of theirs and bad t.v. publicity. It's not good buissness. Whether you when in court or not. You should have refused at least half.Thr judge is correct but.,......I would have refunded at least half

A better question would be why would the defendant demand a payment in full 3 days before a hurricane? I live in South Louisiana, there's always false alarms when it comes to hurricanes. It could be headed here and disappear within hours. The defendant wanted to make sure he got paid even if he did nothing, they were just suckers to pay anything more than a deposit.

If I knew a hurricane was coming in 2 days why would you pay $600. He should have just ate the $350 deposit. All in all he signed a contract and agreed to the terms, the way he smiled why the defendant read the contract showed he may not have been fully aware.

Geeze, take a drink every time the plaintiff says "catastrophic hurricane." Also love how he tried to emphasize "It was so bad! People died!" Ok, your fiancee didn't die. Your wedding party didn't die. You don't have to exaggerate the fact that a hurricane delayed your wedding.

So instead of just refunding the money, the defendant spent time to go to court, the headache of dealing with upset customers, and he still has to perform at a party for them. Seems like a refund would have been a lot easier and less stress for him. I guess it’s more important for some people to be contractually correct.

Non-refundable deposit normally covers the fact that when you reserve, the client can't make up that time with any other customers if you cancel. In a case like this, ain't nobody going to be hiring him during a hurricane. I guess I just don't understand how somebody can make $1,000 in return for absolutely nothing. He did nothing, gave nothing, didn't have to work at all. He's not out anything because no one else was going to hire him during that time. But he gets to keep all that money for doing nothing. As a business owner or a human being, instead of throwing the contract out there, I would have been more reasonable.

He wants to get paid during a power outage but doesn't want to answer the phone, claiming no cell service, well if you can't be reached you're breached. I would have setup a generator and let him play into the air.

WHAT? The defendant broke the contract due to 'force majeur' (the hurricane) and without power he couldn't have performed any services anyway, so deposit or not, or whether it was in the contract that he had to reschedule, it wouldn't have been until the power was back on. But had the plaintiff not paid up in full, he would only have been out the deposit. At least he still has the possibility of rescheduling...

Sometimes compassion needs to overcome greed. This was a Cat. 4 hurricane. People lost their lives. You can't predict a hurricane. It can change course at anytime. If I lived in that area and saw this episode of The Peoples Court I would never use this DJ's services and I would remember his name and warn other people that's looking for a DJ. He has displayed very bad business practices. Absolutely heartless and greedy.

EXACTLY! But he also breached the contract. He was unreachable the day of the wedding, he wants to be paid for nothing, i would have set up a generator and let him play to nothing. Not being reachable the day of is a beach of contract and since he wanted to be a jerk about it I would have held him to that date, but he wouldn't answer the phone, even during a storm people still have access to communication, it's 2024 not 1994, eventually he got those messages and i doubt it was a day later than left.

I think legally the dj has the right to keep the money but morally he should have refunded it. Like maybe returned 750 of the 950 to compemsate for time he did invest unfortunate situation

In all fairness, most trips with large vendors won’t give you your money back from disasters, either. This is why you get trip insurance (I know this isn’t a trip but I’m giving an example). I’m just saying this isn’t uncommon.

Easy solution is reschedule for 4 months and cancel. According to his contract you can cancel up to 90 days before the date of the event. So trap him in his own contract. Reschedule for 4 months later then cancel before the 90s days and instant refund.

I think the defendant should’ve just refunded him. It reflects negatively on him even if he’s legally correct. But I also think the plaintiff should’ve just been open to rescheduling for their celebration instead since the defendant didn’t want to refund him which was his right under their contract. I wonder if the plaintiff just didn’t want to spend the money anymore.

That's what so many of these TV court cases are... People who sign a contract but think it doesn't apply to them because THEIR circumstances are special.

It was hurricane season. He should’ve clarified what happens if there’s a hurricane? It was clear in the contract, but if he didn’t understand the contract, he should’ve asked more questions and then made sure it was all in writing.

In comparison to cases involving blacks, Milian's amicable disposition stands out like a sore thumb. She's here all jovial, understanding, respectful, eagerly listening to both sides etc. Just smiling and laughing away. Giggling here as well. Shit makes me sick..
