The cop will change his story that Jeff was detained for "pan handling", but the video recording clearly shows that the cop detained Jeff, just to get Jeff's identification. CHECKMATE! Jeff wins.

Watching this video, AFTER watching the internal affairs interviews after the PD realized this cop clearly violated Jeff’s civil rights, was interesting. As expected, rather than admit he violated Jeff’s rights out of ignorance of the law and plain laziness, Officer Gault and the union thug assisting him rolled out the typical excuses, including the “he baited us” argument, which is nothing short of embarrassing. I guess expecting the police to follow the law and do their job professionally and ethically is “baiting”. Rather than express remorse or regret for overstepping his authority and violating Jeff’s rights, Gault had the audacity to claim “ he is one the most professional officers in this department”. Wow, what arrogance and hubris and incompetence. Hopefully Gault learned his lesson and will do better………..but I seriously doubt it.
The phone call at the end is the best part. Seemed like his boss even said panhandling wasn't a crime but "we do it to the people on the bridge all the time" then he continues to lie instead of just saying that he just violated someones rights.

It is scary, even the first cop couldn't even remember the 5 words on the sign. He said his "God bless America sign" and the bar ding bat said "or whatever he was spouting." They didn't do any investigation first. Also, the way the cop retold the story made it seem like Jeff was making a threat "He said he had a firearm in his pocket.". When in reality he only said that after the incompetent false memory cop moved to pat him down and ask if anything will poke him in his pockets......... That cop is dangerous.
I've wondered many times how challenging it must be for prosecutors when their entire case relies only on testimony of a cop. With all these thousands of videos showing cops as habitual liars will eventually mean that some fraction of the jury pool won't trust the cop's testimony. All it takes is 1 out of 12 with that view and conviction is impossible.

It’s not a bug, it’s a feature. They intentionally ignore training on the laws and legality of what they do. They don’t protect civil rights, they train on how to get you to give them up or take advantage of the public’s ignorance. The first cop had already investigated, and based on what the bar owner said, there had not been a crime committed. So the first cop calls the second cop, perhaps because the second cop is more senior to him, or maybe because he is more aggressive, or smarter than the first cop ( ok, maybe not smarter, but more “coy” ). So the first cop fails to relay all of what he had been told to second cop. That right there should be the end of qualified immunity. He did this knowingly.
It is amazing how the first officer was basically taking his orders from the business owner. What we see here is a common goal with the police (get people to move along to end the call) and they use common tactics to get this. Intimating arrest and harassment until they get their way. And “the ride” is being used as harassment. Make up a charge that doesn’t apply and has no elements to the situation but creates a penalty for not allowing them to violate rights.
Only law abiding citizens are allowed to have a "Concealed Weapon or Firearm License" in the State of Florida. This fact alone should conveyed to the Officers that he was a law abiding citizen. Jeff should sue the Bar as well as the Police.

They're trained to write reports and give testimony that will secure a conviction at trial. That means they can't stray TOO far from the facts (especially if cameras are running), but they will definitely spin every little thing they can in whatever way looks best for them and worst for the person they're accusing.

I live in just north of this and I cannot believe what happened. I have watched Jeff have his civil rights violated so many times it makes me sorry to be an American. I love my country but I hate my government. Especially when you hear someone say that they are a veteran and still violate your civil rights. According to Florida ccw law, there is no need to disclose your weapon or your ccw license to a police officer unless directly asked about them. In which you must disclose both on demand to police. Now it gets weird, did the police have a valid reason to make contact with Jeff? Apparently not, if he was turned loose., the investigation. This was a false report by the establishment, therefore this issue is why the establishment didn’t get cited. Personally I hope he sues the crap out of that bar and the individual manager.

They should have had that talk with the guy outside and with the proprietor BEFORE deciding to put someone in handcuffs and force them across the street. It's clear Jeff wasn't going to attack anyone or flee the scene, so there was no need for all that. They could have done that whole conversation with him standing right there, and it would've been a picture perfect investigation. But cops don't want to actually INVESTIGATE anything. They want to hem people up. They don't get promoted for investigating properly and determining no crime was committed. They get promoted for arrests and convictions. So that's all they want out of any interaction.

The officers were still wrong, and the manager was a lying jerk, but they investigated before and after the detention.
Jeff, when the cops are "just seeing what they are going to report", make sure to inform the cop that they will need to swear to that statement in court. Which means the business will be liable for that statement in the resulting civil suit.

At the end, in the car, on the phone, he tries to frame it as if he hadn't already detainted you and gone hands on at the point you revealed your CCW. He's trying to make it seem like you said you were armed and that's why they took action... But he still made it clear he'd carried out zero investigation prior to holding you as guilty. The phone call made by the public to 911 is not evidence of anything, it's just a way to measure the required response in terms of number of units, speed, level of risk justifiable in the process of getting there. Once on scene the investigation begins.

The liability lies with law enforcement. The business has absolutely no liability for New Smyrna police misinterpreting the laws or ordinances. The police are the only liable party PERIOD. It is their responsibility to govern laws equally to business owners and civilians.

This has always stood out to me as one of the strongest examples of police ignorance and misconduct. Nearly everything the cops said and did was the opposite of correct according to the law.

Would change their behavior to the better or that they would do anything. Including murder because they know there arent consequences? Now imagine if you decided the kids fate and you chose the middle of the road punishment. Losing their job or in jail for a month. Yet a private organization of your friends (the fraternal order of police) sues you and forces you to give the kid all the snacks and release him. Or give him back his job even. Do you think you or that child would act like a normal person? Or do you think that kid would become an evil unaccountable snake biting anything he wants just for fun? Yeah, if people dont see this as a problem that will 100% get much worse. Then its the people that make those decisions that are the problem as well as the unaccountable cops.
He just detained him, not arrested him. And he obviously needs Jeff not to run off during the investigation. They haven't ID'd him yet and may need to if they determine he actually broke the law. Because they realized the manager was lying, he let Jeff go.
This is beyond civil rights violation. What business is it for the police officer to divulge that the guy is armed to the bar guy? Then he's got the ID out waiving it in front of the bar guy. Quite possible the bar guy could see his name address, date of birth and anything else on it including stated medical conditions. HIPPA violation. Get a good lawyer and take them to the cleaners.
This is the 1st time I saw this video I saw the officer under the IA officer what I just heard just now was this officer lying to the other officer on the phone about when he said he had a CCP. the officer is lying to his own people he needs to be terminated. RLEO
There should be a Pic of Jeff circulated to all law enforcement with the phrase: do not arrest or hassle this man; he knows more about the law than you do.
This business should be ashamed and held accountable for their actions. Clearly attempting to fish for something to throw you in jail simply because they don't want a perceived homeless person standing on public property in front of their business. Truly shameful on the business.
