It depends on the jurisdiction, but in most places you can be trespassed without entering a property. You cannot be CHARGED with the crime of trespass unless you have been given a notice of trespass. The notice can be given without the person ever having been on the property.

So you absolutely CAN issue a notice of trespass to anyone for any reason, or no reason at all.
