Kabir the portable alcohol testers can't be used in court for a reading. They can only be used to indicate whether or not the person had alcohol in their system. This is because the intoxylizer is calibrated and has to be recalibrated periodically.

Most police departments aren’t equipped to do a roadside BAC test, and when they are, it isn’t admissible in court. Your BAC will typically continue to rise, peaking about two hours after the last drink.

⁠@@TacomaGirl Varies greatly by state. Generally however from what I’ve seen you can refuse to take the FSTs but most states require you to take the breathalyzer at the station. Saw your name too, if you from Tacoma WA in our state you can refuse the sobriety tests but at the station you are required under implied consent laws to blow. If you refuse you get an automatic 2 year license suspension, and they may get a warrant to draw your blood. And the refusal can also be used against you in court. There is not really a reason in WA to refuse that test even if you are over the limit as the penalties are more than a first dui.

Here's a little something I learned in Citizen Police Academy - Tow truck operators spend the night driving around waiting for the police to call in a DUI or some other reason a car has to be towed. That's how they get places so quickly. One lady was stopped near my home late one night (noticed because of the blue lights flashing on walls of the house). Took about 30 minutes, but eventually she was arrested and the tow truck driver had towed the car before she and the officer ever left the scene. Did these people not learn "obey commands" like "Simon says?"

On average alcohol leaves your system at 0.08% BAC per hour, or about 80 minutes for 1 drink. Most people pulled over for OUI have had more than 1 drink, so even if they're tested 3 hours later they'll still be over the limit. The methods used at the stations are a lot more accurate than field tests.

Kabir, in most states the portable breathalyzer is not enough to charge someone. They have to take them back to the station and have them blow on a different machine that the courts will accept the results of. In some states, they also draw blood to test it. It’s not like in the UK, where they can make anyone blow at anytime.

The test they do at the jail is much more specific than the roadside test. It's a blood test and you can't sober up fast enough to escape that. It also holds up in court much better. That's what he should've done. He didn't even do a full DUI check. Ridiculous.

It make sense to you & me to use a breathalyser. As others have said breathalyser are not accurate & it invades their civil liberties. Where the rest of the world have been using them for 4 decades. However breathalysers are used as a base rate to see if they are over the limit. More accurate test is done back at the station. I'd say &/or have heard that as soon as they step outside of their vehicle, they are more likely to be hiding something in the car. That shouldn't be there like drugs.

Seriously though in several of the cities I’ve lived in there have been sprees of men pretending to be police and pulling over women driving alone. I’m not going to go into what they did but I’m sure you can imagine. I’m saying this because during those times women were instructed by the police departments to call 911 if you were getting pulled over in a secluded place to make sure it was a real officer

Kabir, There are reasons why the cop is talking to the boyfriend. The cops is filming everything and with each statement more info is being taped to help the cop's case against the woman. Finally, the cop cannot just take the woman to jail because he now has to wait for a tow truck to arrive and take the car. Sure, he could have the other cop stay and wait for the tow truck, but it is better for everyone if he stays with the car.

I’ll stfu but when I was around 19 my sister was engaged to a guy who was just starting the police academy and when he’d have a few days off he’d come over and practice the things they were learning. He used practically every pressure point hold and stuff like that. One day he gave me a sobriety test and I failed miserably even though I was stone cold sober but later after I’d been clubbing and was clearly drunk he performed the sobriety test and I passed with flying colors

As a paramedic I’ve worked very extensively with the police and I’ve seen it before, I almost guarantee you that she’s grinding her wrists in those cuffs to bruise her skin!

it takes about 45 min - 1 hour before your blood alcohol content can even be determined to be going down, and even then its by like barely 0.01% an hour. They had plenty of time. you may FEEL like you're sobering up, but a breath or blood test will not FEEL the same way. but if she was right on the edge of the limit, then MAYBE she could have passed a breath test. He did her a favor by not charging her with DUI based on that field sobriety test.

One problem I have with the finger test is my husband had one was not drinking at all but he has a lazy eye he had surgery on where they shortened his muscles behind his eye so looking at right side of head he has to move it due to the shorting of those muscles. Crazy thing though, the doctor that did his surgery is Bradley Schwartz. A guy who hired a hit man to kill his partner of their clinic and his wife.

She's not wrong. You don't have to the exercises. And roadside breathalyzer isn't admissible in court. All they are doing is gathering evidence for probable cause to either get a blood test or to have you take the breathalyzer test down at the station, which is admissible in court. When someone is being very uncooperative or belligerent, that is when they will just to you into custody and offer those tests in a secured facility, aka the police station.

10:50 this officer clearly had a stripe of some sort on his arm. I'm guessing he has been on for at least over 5 years. Definitely not a new officer. He doesn't want to pull an individual, who has already proved to him that they will not comply, back out of the car when they are already in cuffs and in the back. That's just asking for trouble and asking for the situation to escalate. It's better to test them 20-30 minutes later in a controlled environment where they cannot put up a fight. Blood alcohol levels do drop quickly, but the safety of the officers and public is a higher priority than gathering evidence for charging her with DUI. If she was totally compliant, then yes, the ideal place for a field sobriety test is at the stop, but that's not possible when a person already isn't compliant.

Actually don't think she was intoxicated ever. I think she was upset and she was distracted. But as a side note, in the States doing the breathalyzer on the side of the road is not admissible in court. It's just like the roadside FST they're not admissible in court either, they're just an indicator. They still have to do the one at the station. And they do take into consideration how long someone has been in custody before they do the breathalyzer. As long as something registers on the test they can make a measurement of the amount of time it took you to get there to see where you were at when you were arrested. In most states there is also a difference between driving while intoxicated when you're past legal limit and driving while intoxicated when you're under the legal limit. Technically either one are illegal to do. It's just one is aggravated and the other isn't. So if you're over the legal limit it's aggravated, if you're under it's not. But either way in most states driving intoxicated is considered illegal.

"I'm a mother of three," is not your Get Out of Jail Free card. Stop trying to use it as such. PS: "I'll blow for you," really doesn't sound good, given the circumstances. A respectable 'mother of three' wouldn't be offering services like that to random LEOs.
