This is why you don't move in right as others are moving out. Make the landlord clean the place and had she of done a walk through before moving in she would have been able to see the bugs and tell her no from the jump.
I am 48, and I have been watching this show since its inception, starting with Judge Joseph A. Wapner. One thing that has always made me laugh a little is the names the writers come up with for each case.

Plaintiff's mom looks fantastic! Also, on another note, I hated how the defendant's husband had his arms crossed and was mean mugging the plaintiff. JJ would NEVER allow. This Judge can be weak.

I am a property manager, theres ways to get them to talk. You just have the squash 20 million of there comrades in front of them. Or wait til a hoarder tenant moves out and you see the roaches and bed bugs........
The plaintiff just wants to live with her momma for the rest of their lives (cause her kids are there too) & momma was trying to help her daughter get extra money to get her out her house. The landlord was too nice letting them move in with no lease & didn’t countersued for that lost month.
When I was a kid my family spent all day moving. It was a nice area and place. We were all settling down watching TV, and a roach hopped across the floor. My mom called the landlord and my dad moved everything out the same night. It's something we joke about now. I couldn't ever live like that, I would be too worried.
Ridiculous to move out because of a single roach! I wouldn't live in a roach infested place, but one roach is not an infestation. A lot of work for something so silly!
@@MrCharlesEldredge Thinking about it now, I agree with your comment. When I see an ant or a spider, I don't freak out unless I see a few more and then do a treatment for it. People from different places might see a roach and to them its like seeing an ant or a spider. My parents just had never seen one and freaked out.

The judge is saying the landlord did what was necessary by having an exterminator come out right away. But the judge needs to understand that just because an exterminator comes out and does a treatment doesn't mean the problem is resolved. My mom use to help an elderly lady that had a bed bug problem, the landlord was notified, and it took so many months of treatment before the infestation had noticeably decreased but they never fully went away. Eventually, the lady had to be removed from the apartment because of this issue. So what judge Milian should have done was require proof that the bed bugs were gone after the landlord had the apartment treated. Not say oh the landlord hired an exterminator problem solved. Because it could not be resolved.
I think the judge was pretty clear. The landlord did something right away. If there is a need for more treatments you have to prove that and that the landlord did something wrong like ignoring it.

I have to disagree. The judge is saying that there's no proof of where the bedbugs came from and since the landlord had an exterminator out to fix the problem immediately, that the plantiff basically shouldn't waited atleast until the they were done. It's no different than past cases where an apartment lost power and the tennant's bolted overnight despite the landlord hiring an electrician. The law generally requires that we allow the defendant to attempt to fix it once before the plantiff is allowed to leave. This is in place to prevent people from creating a situation to allow themselves to back out of a contract. Your solution also doesn't make any sense. The burdon of proof is on the plantiff, why should the defendant have to find a way to prove that the bedbugs were gone when if the plantiff had stayed for the initial extermination, they'd be able to see for themselves. If they had stayed with their mom then come back to check after the first attempt, that'd answer the question; if there were still bedbugs, that'd give them an option to break the lease and bolt. There's been dozens of cases like this and it's always the same "You have to give them an attempt to fix things".

You can’t just spray bed bugs away. Unfortunately I’ve had them before and they came form my neighbor I believe. It was horrible. Me and my husband moved and left everything except the clothes on our backs. We had to buy everything all over again. It was an expensive decision but we don’t have them in our new place
@@nikkibarnzable Had LONG TIME tenant just do this to me. But she had a couple of furnished houses (and the grime of a couple houses) crammed in that apt. We have a a regular exterminator, and have set off like 4 bug bombs and still its bad. They dont die.
Theyre both a hot mess. The landlord has a bed bug infested apartment( probably from the lowlifes she evicted)but she didn't even bother to get the lease signed! How could she countersue? The plaintiff better get herself together because when MOM doesn't want you in Her Home...that speaks Volumes...
Plaintiff says her daughter told her she has a bed bug in her arm.. switches it up and says I SAW A BED BUG IN HER ARM... then the plaintiffs own mom says,, here we go again.. like if she already knew about the bud bugs... PLAINTIFF GOT LUCKY 100%
I literally thought the same thing but then realized it was her saying here we go again because she was coming BACK to her moms. Her mom was so relieved for just a minute but knew her daughter had nowhere else to go so that’s why she said “but come on anyway” after she said here we go again lol
What to learn for this case 1. Never movie in or let people move in to a place without a lease. 2. Have the previous people move all the way out ( with there stuff) Do a walk through and put everything in writing and take vido/pictures before moving in. The last thing the mom, daughter combo seems like nightmare tenets that defendant is lucky they where only there for 24 hours
This is a tricky one! I wouldn't want to live in a house that has bed bugs even after it was sprayed. I would need the entire house fumigated by the government. White coveralls and helmets...get in there boys and do your thing! Yes...as a matter of fact, I do watch a lot of true crime shows. 🤣🤣🤣
She didn't want to move out of her mom's house and her mom is falling for the bs. I don't think there was bed bugs... she just needed a good enough reason for her and her kids to keep mooching off of the mom
The landlord called the exterminator the very next day. I would have countersued! I understand not wanting to deal with bed bugs however that'll be an L I have to take. Not the landlords fault unless they don't take action.
My little sister lived in an upper for 2 months, then the bottom was rented out to some horrible people. The hallway stunk so bad we would cover our faces and run, my sister ended up getting bed bugs, she called an exterminator after seeing one and he went into the downstairs apartment and said it was infested and they just let it go and never told anyone. I swear on my soul it gave my sister PTSD. She had just bought 1800$ in new beds to move in and had to throw them out. All the LL did was give her her last months rent back
She had a great case. It really suck when others cost you more money than you was willing to let go for your items. She had to rebuy beds so it technically cost her double for her beds smh😢
She should had never settled with them but since it was short while she bought the beds before moving in that a big price tag people usually keep around I wish she had taken it to court and should had renters insurance if they cover stuff like this

Exactly! The landlord was on it the very next day having the play sprayed. I just think she doesn't want to be independent, live with her mama and needs her mama to do everything for her. She's lucky like for judge said that she didn't get sued for March rent for not giving notice.
The only problem is bedbugs are EXTREMELY hard to get rid of. She more than likely would have had to live with them for a while as they did multiple treatments. No way.
@@traceyaz125 they are hard to get rid of, but not even giving the landlord one chance to treat them before moving out and wanting to get all her money back is unacceptable. She wouldn’t have had to live with them for an extended period of time but if she had at least given the landlord, let’s say a month to treat it if it hadn’t been cleared up, she could’ve easily moved out and not had to pay anything else and gotten her full security back with most likely no 30 day notice

I have never moved in any rental without looking at it first. Ive lived in plenty of rentals in 3 states, and never encountered bed bugs. You can get rid of them if treated properly, it takes a little work but you dont have to get rid of everything.
Judge Milian never asked if the daughter was keeping her furniture in storage before moving it or was it at her mom's house this whole time. I think it's relevant....

In my head I was thinking what difference does it make whether or not she got the oil or they were damages the plaintiff didn't give adequate notice she literally left within 24 hours but then I hear the judge say that the defendant didn't counterclaim smdh! Why in the heck did she not counterclaim for the deposit for inadequate notice? I really wish she had because the plaintiff shouldn't have got back a dime!
Also let me just say I don't blame the plaintiff for moving out immediately if she truly found bed bugs I would have done the same but that doesn't always fall on the landlord that falls on you if you don't follow the proper steps and do what you're supposed to do before you move out.
Once a bed bug infestation starts, it s almost near impossible to get rid of them if you don't nip those little suckers in the bud. Once a bed bug infestation starts, primarily in the mattress is that you burn it. You can bring bed bugs home with you and not know it if you go on vacation and the hotel room has them and they hitch a ride back to your house. Just like roaches do. Also when bed bugs bite you, you will see three little bumps in a row.
Her mother I'm sure just wants her house back and daughter on her own. But what makes you think the lady wants the Four seasons? She wants a safe and clean place to live like everyone else. Would you want to live with bugs? The landlord should have had the apartment cleaned and inspected from the evicted tenant that moved out before renting to a new tenant. By deductive reasoning the tenant moved from her mom’s house where there was no bedbugs to the new place where there was. Pearly the prior tenant had them. Money makes people forget to be human. I get that business is important, but it was within 24 hrs they were out because of a nasty problem. Even without the counter claim she isn't entitled to her deposit back there was no notice given. The landlord shouldn't have to file also to keep money that is on her side already.
I will never understand or wrap my head around the fact that the landlord is responsible for the extermination of bedbugs into tenancy when it's clear that the tenant bought them in. I understand other pests that are common in that area and you have the responsibility to maintain the home. But something that' is clearly due to individual actions, is wrong!
The lady came from her mother's house which didn't have bugs. They moved into the apartment as the evicted tenants are leaving. The landlord should have never allowed them to move in until the unit was cleaned and inspected from the previous tenant. So how can you say they brought the bugs with them when they left the same night they moved in because of seeing bugs🤔
