@William Gruff To be fair, police need to be paid well or corruption is inevitable, and in this case the police weren't willing to be the lackey's of the litter police, they won't actually arrest you, they've got better things to do.
if you look on the government website on enforcement offices issuing fines you will see they have to ask you to put the litter in the bin before issuing a fine

Something similar to this happened to me, Glasgow central train Station 2010, i was standing outside under the staions canopy having a cig before i went for my train. I finished the cig and drop it at my feet and stamped it out and walked inside, 20 seconds later i heard a voice shouting "excuse me sir", i turned round and there were 2 big guys dressed in hi-vis and looked a lot like police but they certainly were not police but acted as though they were. They told me they saw me drop a cig but on the ground and they had to issue me with a £25 spot fine. Almost the same arguement insued as in this clip for the next 20 minutes (and yes they made me miss my train). After 20 minutes of getting nowhere with them i had had enough of them trying to extract my name and address, so just to end the bullshit i gave them the name and address of my number one enemy (an enemy that had caused me grief in the past and he absolutely deserved everything bad he gets in life). They took down the details and gave me a receipt for the fine which had to be paid within 6 months of it being issued. Then i walked away giving them the middle finger and smiled and got the next train. If you are in a situation like this then my advice is give the name and address of your worst enemy.
As someone else said, a lot of people will do anything theyre told by anyone in uniform or a high vis jacket! Words can and are powerful, but only if you allow their words to have power over you! Take that power back, and fight back with the words that are needed and also the SILENCE that is much needed also! Great video Danny, keep them coming!
It's not a crime until you walk away... I've had it before in the past when I was waiting to meet someone. I was early, drinking a coffee and smoking a cigarette, when I noticed a police officer looking in my direction. I threw the butt to the ground, and stood on it. I waited there patiently for 20 minutes (my friend is always late) sipping my coffee. All the while the cop was just waiting to pounce as soon as I walked away. When my friend finally arrived, I opened my coffee cup, picked up the butt, and took it with me. Not forgetting to give a cheeky smile to the copper, knowing he had just wasted nearly 20 minutes of his time :D

The guy lost his argument by not making it clear to the officer, that this is a civil and not criminal matter. It is a civil matter between a private company and a private individual. You cannot arrest for a civil matter and the individual does not require to give their details.
WRONG. Littering is a criminal offence under S.87 Environmental Protection Act 1990. Failure to provide your name and address, to an authorised officer is a further criminal offence under S.88(8)(b) of the same Act. If you don't want to get in trouble, don't break the law.
@Britannia UK CASE LAW: Rice vs Connolly [1966] QB414 & [1966] 2 ALLER 649 clearly states when you are doing something legal, you have every right to remain silent & can not be arrested for exercising this right. Also refusing to give your name and address cannot amount to obstructing the police in the course of their duty under s89(2) of the Police Act 1996 but giving a false name and address can.

Surely the best course of action is to just walk away, ignore them and not talk to them. I had this problem in a shopping centre, with a security guard, and it was much more trivial than dropping litter. It was regarding how I was dressed.

The "Law" or questioning thereof, MUST be implemented with "complete dispassion" and without any inference of "moral or emotional disparity". Perhaps concentration should be on "the lawful validity of any contractual obligation" as "ignorance of" and "silence equals consent to" are "presumptions" of law(or more accurately; legislation) and come under the authorities obligation to provide proof ALL possible effort were made to supply & advise of his inalienable God given rights under "full disclosure". Failure to do so at any & all stages of "man made" legislation negate 'presumption of" becoming the "force of" and so legal enforcement of what are clearly "civil offences" require 'full & willing consent". Also the police(in any form) are acting in "dishonour" and breaking their "oath' as "peacekeeping constables" when attempting to enforce "civil legislation". They are nothing more than "corporate privateers" and guilty of extortion. This may not seem clear until one researches deeper. If one does so sticking to the premise: No victim(or injured party); No crime. You know some time ago I was parked on double yellow lines and a pco told me off I informed her I was waiting for my wife and had a disabled badge in the window she checked and told me It was displayed wrong (it was on the passenger dash board) I laughed at her and told her to stop wasting my time and turned my back to her. Then she carried on talking there crap so I turned around and told her to just go away. My wife then returned she got in the car I put to dog in the back then I got in the car a drove off. Most councils I know aren't what you'd call environmentally-aware. In my town, there are rows of blue recycling bins which the council hasn't emptied in over three years. They even put locks on them. I also used to work at a primary school that hadn't had its bins emptied in 11 months, creating an environmental hazard near an infants playground. It was only when a parent threatened to go to the press that the council finally got their arse in gear. Councils only give a shit about a cause when it brings in revenue.
Unbelievable the people having a go at the council guy. If this was not on camera and the council guy was not there the guy would have dropped the cigarette butt and left it. Its a disguating habit people dropping litter.
I got cautioned for a littering offence a few months ago...(It was actually for fly postering but they said it would be come under "littering"). The police man called a council lacky and he wanted to take my details as well. I told the council lacky to piss off as I was only obliged to give the copper my details. Well, he didn't like that and the copper just gave him my details anyway. They asked me who I was fly postering for and I refused to share with them who I was working for. They told me what I was doing was wrong and I disputed it telling them it was doing nobody any harm. They said it was bad for the environment so I told them that the posters were bio degradable. They didn't have an answer for that but told me to expect a court invite through the post. Nothing came of it.

***** I got caught again by the police and his little gestapo buddy from the council last night. The council guy showed me that he had pictures of me putting posters up on his council mobile phone, taken of me from a distance by a council photographer which has been zoomed in (and showed me quite clearly...that didn't fill me with joy tbh) and he reckons the local council are "after me" and asked me if I've received a letter in the post yet requiring me to attend an interview. Scare tactic perhaps... or serious? Who knows? But if I end up in court, I will be receiving a fine and a conviction apparently.

I've been doing it for a few years and they've probably figured out my work schedule pattern and had council cameramen waiting for me to appear in the street with the posters and then snapped me in the act. Also, I can't see that argument holding in court somehow, if I'm honest.
You need to ask them who do they think has been offended if an offence has been committed. It should stop there. The Government is a fiction so is the title that the human being enforcing the law, is hiding behind from. The human being will always be above the law and will have no rights (claiming rights is claiming that you know the rules of the game) where as the strawman must. The human being in my definition is the natural living breathing sentient being known as "human" or "humanoid". We are all playing a game where the rule makers have no stake in other than to keep us playing. You are completely right in saying that it should be about morals rather law. i was stopped on George Street in Edinburgh a few years ago. It was a blustery day as is the norm in Scotland. I had just deposited a wrapper into a bucket on the street...2 council goons approached me. asked me why i threw the wrapper onto the street. i didn't even notice it had blown past the bin.. i offered to pick it up and they said i was facing a penalty.. I proceeded to pick up the litter and put in bin.. They were ok with that. i apologised and walked off.. common sense at play here..

This clown has no powers to do anything and certainly not detained somebody, he should have immediately call the police over and had this man arrested for false imprisonment This police officer should never have got involved in a civil dispute, other than being impartial witness to keep the peace. Why is it when a corporation shout the police jump and say is that high enough, then he should have just walked off leaving them standing there, that would have put them into a quandary how do they act next?

Here in my City, the litter enforce pleds gave a eight year old a fine ticket, and it was outside the Town Hall, by luck a Councilor was outside.... arguments became and emergency Council meetings. The PFI enforcement contracting company was sacked and lost the contract within weeks.

Ahhhhhhh that's why the police took 2 hours to get to a home alleged armed robber of my friends family home with 2 kids there. They were helping enforce a bylaw instead of the actual law. Super, thank you police :)
