In this video I go over three ways foreigners can buy/aquire land in Thailand, the risks and possible ways to mitigate those risks.
I also show you the piece of land that we purchased in North-east Thailand, in the province of Nong Bua Lam Phu.

About me:
My name is Klaus (also go by Freddy), a former bean counter making up for lost time.
In 2018 I left the nine to five world to chase new experiences at home and abroad.
March 2020 comes along and the world stops, so did the ability to travel.
The global situation meant that I was to be separated from the mrs and little one for the next 12 months.
I came back to Thailand in March 2021 with the intention to join my little family.
Originally I started this channel because I thought I would need something to keep me occupied while living in Thailand, something to keep me out of trouble ..
With a young daughter you quickly learn that spare time is a thing of the past :)
If I can add a few videos here and there just for the memories, ill be happy :)

could you help me please. I am new about companies and ownership. How do you buy as a foreigner, do you buy outright or there is a way to borrow from the bank in Thailand or your home country? I live in UK, but I am not rich or anything. I am married to Thai woman for 10 years, we would like to move to Thailand in the future, but I am confused. Do you renew Thai married visa every year or you did something else to settle in Thailand? Could you please answer. Thank you!

Enjoyed the video and wish you all the best. Another option is to do a combination of 2 of your options. You could buy the land in your wifes name as you have done, then do a 30 yr legal lease of the land from your wife to you with the price you paid for the land being rent paid in advance for 30yrs. With this lease being more than 5 or 7 yrs you can attend your local land office and place an enforstract on the Chanote in your name as the legal tenant of the land. Further to this if you build on the land you have legal ownership of the building via yellow book etc.

@@freddyjingjo In that case, why didn’t you create a trust in your daughter’s name, with you as the director of the trust, and the. place the land in the trust?

A yellow book is proof of address and confers no ownership or other rights whatsoever.

As a foreigner you can own a house, yellow book is NOT ownership it is adress where you reside, house ownersip is not issied by Landoffice or Amphur or Tetsabaan, it is another office that I forgot the name of.

I have bought my daughter 2 plots of land in Petchabon province where our house is I love the village life and the neighbors are like family My daughter can run around and not worry about getting hit by a car or truck I trust my wife and my Thai family 100% or I never would of got married in the first place There is risk in everything you do but even if it doesn’t work out at least my daughter has something I don’t understand all these guys are so worried about their wife’s stealing everything….why would you marry someone like that? WOW ! ! ! ! That price makes me feel FANTASIC right now ! I bought two pieces of property just outside of Korat in a "village" of about 300 too. 18m × 54m each. 36m × 54m total. About 0.5 acres or 1.25 Rai. I got each for 200,000 Baht/$6,000 Usd..... total $12,000. They are adjacent to her property 18m × 54m. Combine??? 0.75 acres or 1.8 Rai.... I went with #2 also. The swimming pond, car port, patio with roof, a 2023 Isuzu V-Cross, braces for her daughter and both nieces, private school, and of course her mom..... are all way more expensive than a plot, or two. I'm 58. I've never had more fun SPENDING money in all my life. I hope your happiness continues. Thank you for the clip.... If you want swimming pond ideas. No chlorine ! ! !. Just let me know. It's CHEAP. Teaching a child to swim is IMPORTANT. All three (daughter and two cousins) are swimming like PLA (fish). Thanks again.

Hi Freddy! Thanks for your overview of the how to buy land in Thailand issue. I live in Chiang Mai and married my Thai wife 2014. I bought land on the name of my wife in the village where she was living with her mother. My lawyer recommend me to sign an Usus Fructus - contract which would give me the right to live in my house till I die. Even if my wife wanted to sell the house, I have to live in it or rent it for my own benefit. After 9 years my wife declared that she will leave me. By the law the Thai wife gets 50% of the selling prize. If I want to stay in my house then I have to give her 50% of the value of the house which I don't have. Besides that the house would still be on her name, which is a strange situation, when you once designed and build a house for the common purposes. So I have to sell my house and decide whether I buy a condo, rent a house or go back to Europe. But for same cases it may be interesting to know about this Usus-Fructus-contract: Use of the fruits, which we know as well in Europe.

Hi Rainer, thank you for sharing your story and sorry to hear about your situation. Sounds like the usufruct was a good choice. In my case the land is a gift to my daughter. No plans to build there, we live 10 hours away in Pattaya. Nowadays vacant/unused land is being taxed at a premium in Thailand so we’ve asked the family to figure out something in terms of using the land to avoid the extra tax. Am posting a follow up to this video soon. Thanks again 🙏

​@@freddyjingjo Unused plots in Pattaya usually have some kind of small farm, like 10-12 papaya trees. Previously, the plots simply stood empty, but in 3-4 years, small gardens, or farms, were planted on almost all of them. I think they do it just to avoid taxes.

Fructus is the best way as far as I know .. for me 🤔 it’s not a crazy amount of money and its a gift to my daughter. Ppl will always hate but its a gift i don’t need or want oversight over a gift 👀

Sorry, am confused. Did you end up with a usufruct agreement? I have one but tessabaan would not allow me to own the house regardless whether others have done or not!

@anthony7091 Usufruct is a good option if you as the foreigner plans to live on the property. This land is in my wifes name and will be transferred to our daughter when she becomes an adult (its a gift).

I have a usufruct agreement on both of our properties and enjoy life in Isaan. I admire thailand for protecting their country, Australia, Canada etc should have done the same a long time ago

Wow, I am a Thai person and always like to buy land and I was thinking your decision is awesome to buy for future of your family and the price absolutely will increase in double within 5-10 years as the land located on the village and close to 2 sides of concrete road especially one side is main road. 😃

Nice work mate. My mrs and I bought a 800sqm block in home town in 2018. It’s in her name. We’re both living in Australia. One day will build retirement home and do 6 months there/6 here. Basic principles when buying land, due diligence make sure no finance owing, Chanote at land office is witnessed, a clear sales contract written up from buyers solicitor for seller. In process now looking at 2 properties next to ours and acquiring them. Unfortunately have the negative comment people don’t have a clue.. except google.

I live in Nong Bua Lamphu also in a village called Hin Lap Nong Sawan. I think the village you are referring to is called Ban Phan Don the road 228 a very busy road heads towards Si Bun Rueang from Nong Bua Lamphu. I'm of the age were I like peace and quiet so have retired here now 6 years, away from tourist destinations. Liked your blog.

To midigate risk with company ownership.... Start a (holding) company, buys land with a morgage stamped in the charnot where you privately is the lender. Start a second company (diffent directors) that leases the land from the first company and pays some rent yearly. You might want to do stuff while living in Thailand.... the second company can be set up to operate/run any type of business. And if you wish to buy some other property or "flipp" you already have your "holding" company for that.

Brilliant block of land and consideration for your daughters future… A corner block on the highway opens up a multitude of business opportunities from beverage stop to hamburger barn…trust me, I’m Greek Australian and I know. I’m looking at retiring in Isaan and renting my home in Australia in order to live like a king 👑 in my twilight years 😊😊

Thank you for discussing this important topic. If it were me, I might have had my Thai attorney create a trust to benefit my daughter, which I would control until my daughter turns 18. The trust would hold title to the land. I would also execute a loan agreement with the trust, and lend the trust the money to buy the land. You can always forgive the loan and interest or any portion thereof. I would execute a 30 year lease of the land with the trust. Finally, I would obtain a usufruct for the house. Most kids aren’t mature enough to handle money at 18 anyway.

Just looking that the land you are showing has . 1. Blacktop hard top road access. 2 Poled power access. I hope you may also have water ? A well if needed is not that expensive! Walls establish land markers! Check that they are in the place as per the land office drawings! Thai's do tend to build walls over the demarked lines. Wall could end up being on the neighbors land! Good luck! * I think my kids had to be 18 to get ownership of the house ? I will check that out!

Yes, if you buy land in Thailand, don't buy anything less than a Nor Sor Saam deed. Make sure you can get electricity and water, some local planning or council rules may prevent you from obtaining those necessities.

The price is surprising to me for it being so rural. I paid about the same for my slightly smaller piece of land in rural Japan where the cost of living is much higher. It's at the edge of a city of 500,000 but countryside. We can buy huge plots of land (4 rai or more) in the real countryside but along roads for about 1/4 the price but in Japan convenience is the cost. Since you aren't planning to build the land will definitely increase in value at its location.

A few misinformed people say the price you paid was high. I beg to differ because a block that size would cost one million in the back streets. But as your block of land has prime position on a main highway and you could open a shop or store the price goes up. Just my unqualified opinion.( Position, Position )

Good video, thanks. Just wondering if there would be a price difference between freehold and the 30 year leasehold? Also how about the second 30 years, how would that be priced? Could you use your 1.8m piece of land as an example? Many thanks

Thanks for watching 🙏 The main reason why a foreigner would choose a 30 year lease over buying in the name of a thai person is that its the closest a foreigner can come to actually owning or having exclusive possession over the property for agreed period of 30 years. Im not sure there is a set way of calculating the lease cost. Ive heard of people paying the whole 30 year lease upfront (usually the value of the property, and slightly discounted?), I would imagine most agreements involve paying month to month over 30 years. Its really up to what the lessee and lessor agree upon. With the 2nd 30 year lease, Real estate agents will tell you that the renewal clause in the contract ensures a smooth transition to a 2nd 30 year lease .. but at the end of the day the owner has to come with you to the land office to register the new 30 year lease. There is nothing in the contract that can force them to renew if they change their mind or choose not to (This is Thailand).

You bought this land at the suburb areas. A land at the village will be much cheaper if one intended to buy. I bought a piece, an area of a tennis court in Laem Thong, Nakhon Phanom for my god son whom I help to care for him since he was born. I also sponsor in his university education in BK now & he will be graduating at the end of this year, 2022. I knew his dad 30yrs ago when he was working as a construction worker in Singapore. p.s. That was interesting about buying a land in Thailand, but my situation is definitely different I myself was born in Thailand and only being a Thai citizen for 20 years then became the US citizen for more than 50 years actually I was born in Bangkok both of my parents are dead and left us some land for all of us myself and my siblings, I myself Almost 75 years old would love to retire and die where I was born. I enjoyed your story about buying a land in Thailand absolutely very interesting to learn all about a foreigns cannot buy a land in Thailand.

In Malaysia..a Foreigner can own land in his/her name depending on the title. Anybody can own a CL title land (Country Lease) but not an NT (Native Title). However CL lands are way more expensive than NT lands. Mainly bcos banks prefer to finance CL lands with higher margin. The reason is, incase of foreclosure, there's more market for CL.

All three of your options hold no ground for you as a foreigner in any way or other in Thailand. It does not matter if you are the majority shareholder or not, which in your case it is not. The only time you own something in Thailand is when your money stays in your offshore banking account. You as a foreigner have zero rights. It does not matter if you have the best lawyer in the land. Renting on a signed agreement and a six-month up payment system is your best bet. No other deal will get you more satisfaction and better results than that. Have a good relationship with your land owner and you are in pound seats. All changes/improvements whatsoever you want to do, consult them and if permission is granted put it on paper and signed at a Police Station. Each person has a copy and everybody is happy. There might be a fee involved but much less than what you stand to lose in total.

I can fully understand buying near family especially with a young daughter. Same situation as us with a 4 year old we have 4 rai and built a nice modern house on it for well under 2m baht total. A bit amazed at you paying 2m for land alone but hard to judge location etc from a RU-vid video.

Mate wish you all the best with the land. There's one other way to tie up the land with a 30 year lease. It's called a Usufruct which is when at the time of setting up the 30 year lease the Usufruct and 30 year lease is noted on the back of the official land paper at the local land office. This then means that that piece of land cannot be borrowed against ( something that Thais do a lot and quite often loose to the local loan sharks ) or sold for the duration. You didn't buy land in Thailand you paid for it mate.

Anyway it doesn’t matter as he clearly says he bought for his daughter and has no intentions of living there! If l could turn back, l would do the same. Land on a main road here in Thailand attracts a premium price.

@14:30 If you have a lease, aren't you safe for at least the term of the lease (30 years in this case)? Even if the original owner dies and the new owner doesn't want you on their property, there is nothing they can do about it because you have a lease. Are you saying the new owner can cancel the lease?

Sorry just a question. When you said the leasehold option, if the Thai owner of the land passes away…. You didn’t mean that the relatives can take the land back within the 30 year agreed lease ? Do you mean at the end of the lease ? Surely if you’re 10 years in and your landowner dies they can’t just break contract once they have inherited it. I get they can stop agree to not renew it after 30 but can you just clarify this

The contract is a contract, but yes once the lease is over they as owners can take back the land. These things are all theory based because 30 years is a long time.. not sure how many cases (good or bad) are documented :)

I worked out a better way to own land as a farang.my wife's sister found 4 Rai, with full Chinote, just before the Ko Lanta ferry for 2m., I made a legal loan to her for half the land(1m.), I then made a legal lease agreement for 25years, that way I get the land and retain control of the 1m., if she tries to sell the land I can recall the loan and get my money back. We have built an Ayutthaya wooden house on the land and I have got the Tabien Baan(yellow book) in my name.

I was a bit disappointed when I saw all the draw backs, especially because his kids and ex-wife are super greedy and happy to take what they can for nothing. So, your way of doing it works for me. Thanks for sharing the important information. All these options are really risky if you have only limited money. If you are screwed then game over. Is there any way to come to Thailand and get the citizenship through the neutralisation process? I mean no marriage, no work visa. Maybe come as a tourist then extend the visa for 5 years. Then apply for the citizenship? Can you please advise on that? We are currently on turkey but willing to move.

Thanks for the information, I would love to buy a 3 bedroom property with pool and a bit of garden but I’m already married to a Vietnamese, I don’t want to lease for a 30 year period and setting up a company I would have to submit my accounts, hire an accountant and form a proper business. I don’t want to do any of former . It’s a shame the laws are so stringent as the property in Thailand is at least 3 or 4 times cheaper than it is in Vietnam. Anything you build on the land is yours. It’s possible to resell the house to someone else along with the lease (the land owner would have to be in agreement).

Different for us citizens.. Pursuant to the provisions of the U.S.-Thai Treaty of Amity, American citizens or American corporations can own entities here in Thailand in a manner substantially different from other foreign nationals. So notably, Americans can own a company or companies essentially a hundred percent.

My comment is how come ex pats buy land in northeast Thailand, because it is cheap. I saw on the map it is way up there near Laos. I surely would not want to live that far away. What you described about the village with a very small population, where do you buy all of your food stuff, and all other commodities. Which probably would be quite expensive. I know my title says Canadians(where I was born and raised) but I am American by (immigration). My American side of me goes back about 200 years. This is about all I have to say. When are you planning the construction of your home, I would to follow along on this process.

There's an arrogant foreigner here in Rayong that is known for boasting about what he has and what he has bought! I asked him, how can you call it 'Your land, your house'? He replied : 'Everything is in his wife's name. She was gambling and drinking and became 'unstable'. *( True) So, he says he went to a Thai lawyer and got all the land and properties signed over to him so she could not access any value! I replied then she is technically NOT the legal owner and you being a foreigner cannot own land! He replied: The Lawyer has all the paperwork and he is a good friend of his! There you go! Work that one out! When the 'wife's' family want money --the wife will have to obey! The arrogant foreigner will get a gun to his head! Thai company as in #1 must be 51% in Thai name(s). Max you may get is 49% --beware! You do not control the company and the signatories could be 'fixed'. #2 . You do not own the land. #3 Leasing for 30 years? I don't know of anyone who has done that has reached the 30 years as yet as this law hasn't been in place for 30 years at time of posting! Most want to 'sell out ' cheaply during the latter years of the lease! Serious loss of value! Beware the lease may NOT be re validated or re issued! Good luck with your venture and beware of who you deal with! I hope you can speak Thai!!
