Pertinent Provisions of the Civil Code of the Philippines:
“Article 1868. By the contract of agency a person binds himself to render some service or to do something in representation or on behalf of another, with the consent or authority of the latter. (1709a)”
“Article 1878. Special powers of attorney are necessary in the following cases:
(1) To make such payments as are not usually considered as acts of administration;
(2) To effect novations which put an end to obligations already in existence at the time the agency was constituted;
(3) To compromise, to submit questions to arbitration, to renounce the right to appeal from a judgment, to waive objections to the venue of an action or to abandon a prescription already acquired;
(4) To waive any obligation gratuitously;
(5) To enter into any contract by which the ownership of an immovable is transmitted or acquired either gratuitously or for a valuable consideration;
(6) To make gifts, except customary ones for charity or those made to employees in the business managed by the agent;
(7) To loan or borrow money, unless the latter act be urgent and indispensable for the preservation of the things which are under administration;
(8) To lease any real property to another person for more than one year;
(9) To bind the principal to render some service without compensation;
(10) To bind the principal in a contract of partnership;
(11) To obligate the principal as a guarantor or surety;
(12) To create or convey real rights over immovable property;
(13) To accept or repudiate an inheritance;
(14) To ratify or recognize obligations contracted before the agency;
(15) Any other act of strict dominion. (n)”

Warning. Do not buy or sell property or land using Terence and Beth Martin from A Foreigner in the Philippines youtube channel or Brian and Marcel Smith from A foreigner farming in the Philippines you tube channel. You will regret it. Buy or sell from a reputable, licensed real estate broker only.

Sir more or less 40 yrs tenant paeent ko sa more than 1 has. at dna nila kya magsaka kya binigyan sila ng 2.500 sq mtrs ng may ari ng lupa. Ang lupa na binigay ay 3 magkakapatid ang may ari at abyarin daw po namin sa DAR at pinababayaran po sa amin ang 3 titulo ng lupa nila bgo nila pirmahan ang deeds of donation. Tama po b na kami ang mag abyad at magbayad ng mga titulo ng lupa nila?

Attorney, my question is pertaining to the sale of a condominium unit. I purchased a unit in San Juan, Philippines. As I get older and family concerns change, I can longer pursue my original plan into my retirement. The unit is fully paid and a Deed of Absolute Sale is being processed. Should I decide to sell the property in the future, how will the capital gain tax be calculated? Here in the US, the tax is calculated on the difference between the original purchase price and the actual selling price. Can you shed light in this matter. Thank you

The capital gains tax in the Philippines is computed on the basis of whichever is the highest of the following: 1. Zonal Value 2. Assessed Value 3. Selling Price Multiplied by 6% = Capital Gains Tax Multiplied by 1.5% = Doc Stamp Tax

hello atty..my sister in law (filipina) but she now a german citizen..may real property siya dito sa pinas..noong dalaga pa siya..gusto niyang ibenta..tapos iyong kapatid niyang lalaki asawa ko...inutosan niyang ibenta ang kanta mga ari arian...pwede ba gagawa kami ng SPA dito sa pinas at ipapadala sa kanya ug mapirmahan niya ang SPA..saka ibalik niya ito sa kanyang kapatid?? thank you so much..

Attorney meron po bahay at lupa na nabili ang family ko na nka pangalan sa cousin ko pero wla pa po titulo nsa developer pa po sya at gusto po ng cousin ko ilipat sa name ko yung pngalanng property. How do we process po? Kasi babayran plang po nmin ang titulo ng bahay pero nkapngalan pa sknya ang cousin ko po ay nsa US na ngaun

Good day Atty. Ask ko lang po kasi meron po kaming land title transfer sa Negros oriental, yun heirs po na pipirma sa affidavit of heirship nakatira na sa US. Sino po ang mag nonotarize ng affidavit? Pwede po ba notarist sa Philippine embasy, or a peacticing lawyer in the US recognized by the Philippine Bar? Thank you very much po sa sagot.

Atty pwde po bang macancel ang CLT?... Kasi po binenta ng land owner yung lupa na sakahan sbi ng land owner nacancel na dw ang CLT nun..Ngaun po sinurrender na ng tenant yung sakahan pero kapit nun binigyan xia ng lupa.. pwde po bang ibenta ng land onwer yung sakahan?

@@bjpmd2006 You will need to report it for tax purposes in the US. But you can avail of the benefits under the Phil-US tax treaty, provided that you submit proof of your tax payments in the Philippines.
