Florida State was offered a do-over in their lawsuit against the ACC in Florida. Judge Cooper ordered FSU to amend their complaint, giving them a major opportunity to revise or even expand their arguments in their quest to break away from the ACC’s Grant of Rights. Will FSU add points from Clemson’s complaint in their new filing? They will have to submit their amended complaint in Leon County early next week. Or, could the ACC benefit from the case in Florida slowing down. If they get a favorable ruling in North Carolina first, it could force the Florida judge to fall in line.

The state of Florida sued the ACC today claiming failure to comply with state open record laws and they placed urgent status on the case. Heck, we already have a new judge for the case. Buckle up

You are missing some finesse in the Clemson arguement. The gor says the ACC is granted all rights needed to fulfill their contract with ESPN. The problem is ACC also said once a conference team leaves ESPN no longer has rheir rights. So, You can't say for sure without seeing that ESPN agreement, but it seems the gor means nothing once a team leaves.

The Clemson arguments basically says, because in the ESPN deal (apparently) says ESPN tells the ACC they have no responsibility to any team that leaves, Clemson is alleging that carries over to the individual teams that leave. But none of the teams in the ACC signed the ESPN deal but made the ACC their "Power of Attorney" to handle everything.

The GOR says it carries over because the right granted are those the ACC needs to meet their obligations to the ACC. That's the ACC's language in the GOR not Clemson's. Nowhere in the gor does it talk about giving the ACC all home games. It just talks about giving the ACC the games they need to fulfill their contract. So what games are those?

Firstly, it's the FSU argument. FSU had that language in it's lawsuit. Clemson later used some of FSU's stronger arguments to narrow the focus of their lawsuit. Secondly, FSU and Clemson argue that the ESPN Agreement only applies to "Conference Institutions" as per the language within the ESPN Agreement. And the ACC attorney - in court in Florida - repeatedly said the exact same thing. So there's really no dispute over this fact. BOTH the ACC and FSU/Clemson agree: once a "Conference Institution" withdraws from the ACC, ESPN no longer has any right to broadcast that institution's games. Lastly, the dispute between the ACC and FSU/Clemson rests solely on if the ACC still retains a school's (i.e., "Member Institution") future rights after they withdraw from the ACC, or if the school retains those rights. The ACC GoR plainly states: "Each of the Member Institutions hereby ... grants to the Conference ... all rights (the "Rights") necessary ... to perform the contractual obligations of the Conference expressly set forth in the ESPN Agreement". If the ACC's own attorney acknowledges in court that the ESPN Agreement has no obligations to air the games of a Conference/Member Institution once they withdraw from the ACC, and the ACC GoR states the ACC only retains the rights "necessary to perform the contractual obligations expressly set forth in the ESPN Agreement", then FSU and Clemson are getting out of the GoR scot free. The ACC will argue that the GoR language "doesn't mean what it says" and that the "ACC should be allowed to interpret the language how they want". But the ACC's GoR reads *VERY DIFFERENTLY* than the former Pac 12's GoR, which said: "each member hereby transfers and assigns to the the Conference any and all of its rights to the commercial exploitation of all audio and all video transmission or dissemination by any and all means ..., now known or hereafter existing...". The Pac 12 GoR was *NOT* tied to a single, specific media rights deal, but the ACC's is. Good luck with that, ACC. You are toast. And it's entirely because they and ESPN left a massive loophole in their contracts. "The ACC signed the contract!" The ACC and all the non-FSU/Clemson leftover schools' (aka, "dregs") attorneys absolutely screwed the contracts up, Kenton.

The answer to that is no. This judgement has come from Leon County (Tallahassee), FSU's home county. This is the same way Michigan faltered against the Big Ten. Michigan has a judge from its own county. The Big Ten brought in the evidence and Michigan still got suspended and the NCAA is investigating. What we're seeing in both cases is that there's a difference in competency level between university lawyer vs conference president lawyer.

Allegedly Clemson’s entire case is based on this paragraph. It is either real or it isn’t “Without limiting the forgoing effective (date) and continuing for so long as the institution is a member of the ACC, the institution agrees and confirms that the ACC shall control and have exclusive right to exercise or license all media rights owned or controlled by the institution related to video/ audio-visual coverage for any game or practice for any of the institutions’s athletic teams that participate in any sport that is a conference sponsored sport including without limitation all media rights for any such game or practice of the institution occurring on the institution’s campus or any stadium or arena that is the traditional home stadium or arena for one of the institution’s athletic teams.”

Am I the only one who feels like this channel has turned into Locked on CSI FSU? Can we try to talk some actual football please? I know it’s off-season, but I’d like some analysis about not only how my team has done in the portal and Spring Game, but also some of the teams we will face this year. Every video is court proceedings or stuff about teams from Florida. Can we at least move the court stuff to the last block of the videos each time? Please & thank you. This break up of the ACC is already depressing enough to those of us about to be orphaned. I’d appreciate a welcome distraction to prepare me for what could end up being our last season in the P4. 🫠
