I think the idea of "justice" isn't as important to Equestrian culture, but feelings and emotions are far more important. After all in Equestria, friendship actually IS magic, the most powerful thing in the universe is powered by an emotion. So I think the way Equestrian law works is actually based on the emotional effects of things. Discrimination and bullying are hard to catch (Diamond Tiara and Silver Spoon have never really been caught), but I imagine if they were caught they'd be treated far more seriously than they would on Earth. On the other hand, no pony really cares about property damage, they're probably not even that worried about fraud or theft, because unless something seriously hurts another pony or animal, it's not that big a deal. That would explain why in the show all the property damage pretty much gets ignored. It's only when something like enslavement or starvation is threatened by the major villains that they actually get punished for it. I think crimes against animals and pollution of the environment is VERY severely punished in Equestria. Why? A few reasons. First of all, we've never seen polluting factories, oil spills or even a hint of animal abuse in Equestria (except by dragons, who pony law probably doesn't apply to) - this implies something is stopping ponies from harming the environment - probably the law. And second, ponies show a lot more respect for animals than humans, they care for them, they walk like them, heck a lot of the time they talk to them - so I think animals would be treated a lot like ponies by law. One more thing is worth mentioning for this conversation, and that is I think Equestria is a land of common sense. What I mean by that is they don't worry about all our stupid imaginary Earth problems like "money" and "justice" and "administration". They still happen in Equestria, but they take a back seat to real emotions, real lives and the real environment. Given a choice, a pony would give up all the money in the world to save the climate, or to save other ponies from starvation - while humans refuse to give up even a tiny bit more in tax money to do those things. So I think that comes into pony law as well, common sense and real concerns override rigid rules and imaginary structures.

***** Oh yeah, we didn't see it happen except for when FRIENDSHIP WAS LITERALLY CONVERTED INTO A RAINBOW RAY OF AWESOMENESS THAT SEND TIREK AWAY XDD Justice wasn't the reason for that. They didn't want to "punish" Discord, they simply wanted to keep him away from Equestria so ponies would be safe. Celestia has always preferred mercy when possible.

TheNerdyGeek Maybe 'Property Damage' isn't a big deal in MLPfim because property isn't that expensive. We *think* the destruction of the weather factory cost hundreds of thousands of bits to repair, but that's just an assumption. Maybe those machines are basically tinfoil and Styrofoam and it's MAGIC that makes them functional. So... a day or so of labor (There's where the damage has been done!) and they're in operation again.

Pretty good topic you two. While our world and Equestria are different in terms of law, I think the important thing to consider is the intentions of the individual. If someone broke your window by accident they can do the right thing and pay for the damages which shows they had no ill intentions behind their actions. But if they broke the window and don't intend to take responsibility for their actions then their intentions come off as irresponsible. the difference is morality.

As for RD, she didn't get punished because she probably didn't technically do anything illegal, due to her job. She is the weather manager and would be expected to deal with various weather-related things, like with the snow and clouds. So, it's probably like, (the human-world possibility), dumpster-diving out of the company dumpster to get an important tool out for your job, with your company. It's not necessary illegal, but can be immoral. As for how to get away with crimes, Puzzlebrony, the way how to is very simple. I don't recommend committing any types of crimes, but the basic general steps you should know are below. 1) Know the law itself. 2) Befriend law enforcement/security. This way if you get caught by law enforcement, than you can lie and say you didn't realize you were committing any sort of crime, make up an excuse, and maybe let off scotch-free. 3) Plan ahead. 4) Only commit crimes that are small but worthwhile (human-world example for some states: dumpster-diving at a clothing store's dumpster to get free clothes). 5) Always have a back-up plan or three (different times and locations). 6) Take complete advantage of legal grey areas and loopholes, (human-world example: getting something cheap at a garage sale instead of stealing something from that same garage sale), before committing a crime. 7) My personal favorite step: always have an escape plan and means of escape, in your case, memorize multiple teleportation spells, ASAP.

My head canon is the punishment system is so lax because of Celestia herself. Celestia is a very forgiving kind of pony and I honestly think she cannot see the dark side of ponies. Her lenient attitude is reflected in the rest of equestria for better and worse. On one hand it encourages friendship and forgivness. On the other it means some crimes, like Rainbow sabotaging the weather machine or Fluttershy attacking fellow ponies, go unpunished.

Actually, that could be the REAL reason that spell exists (remember Starlight said she LEARNED it, she didn't CREATE it herself) What happens in Equestria if it turns out your cutie mark "knack" IS for something illegal (say you have a talent for stealing things, or the right mentality to become a perfect serial killer.) When trying to work out how Ponyville handles crime, we also have to try and work out how it handles the criminally INSANE. And that could be where the spell comes in. Under correctly authorized use, it could "strip" the talent out of a pony and then they could be trained in what their second best talent was. (there may be a more refined method of use than what Starlight did, one that ONLY takes away the primary talent, as opposed to ALL of them.)

Most punishment in Equestria seems to be doled out by divine or semidivine sources, and be based on nature in certain ways. For example, I am not of the opinion that anypony *except* Luna is capable of being sent to the Moon, and my theory on Discord is that the Elements of Harmony wiped out his Chaos, depleting all his energy to a point that he was instantly petrified, so no pony else can be turned to stone, either. I also remind you that as members of the Council of Friendship, the Mane Six are probably Ranked just under the Princesses in terms of Political Power, so there are very few individuals who would dare try to punish them.

Kirsten Nylander don't forget babs got away with ill intended vandlization and theft of property and didn't get so much as a slap on the hoof, you can tell there is no punishment in equetria for those crime when you would spend a least amonth in jail in our world.

The best explanation I can put forward to rationalize the Equestrian legal system's apparent non-existence is that they focus more on corrections than they do either punishment or deterrence. Basically, keeping someone in prison longer than the time it takes to convince them not to repeat their infraction is counterproductive and wasteful. This makes sense given that ponies seem far more willing than one would imagine most humans being to admit/acknowledge their wrongdoings and reform themselves. Troubleshoes may not even be the best example because it can easily be argued that he was being detained until the charge could be investigated rather than actually having been sentenced to jail time(basically keeping a suspected filly-knapper off the street and from running rather than suggesting guilt). So, to sum up, the ponies have realized that keeping someone locked up past the point where they altered their behavior for the better serves no one's interests. Discord is an excellent example of this mentality, where once Celestia seemed confident of the possibility of Discord's reform, neither concerns about deterring future misbehavior nor simply punishing him mattered in her decision to release him. While it's true the ability to re-imprison him was an important piece of leverage, it wasn't punishment for punishment's sake, but instead meant to further the main goal of reformation.

Yeah, this made me instantly think of how crime and justice is handled in Chengar Qordath's Winningverse. Basically, the crime system is fairly medieval, but also just (with the occasional banishments by Celestia), except that magic also comes into play. Dark magic is defined clearly and is something that is dealt with seriously to the point of warlocks being executed and unicorns losing their horn. Since you mentioned mind control that is something that is considered to be dark magic in the Winningverse and thus punished severely. I don't know how it would really be handled in Equestria, it really depends on how cynical or gritty you're trying to be. The Winningverse presents just one possibility. Celestia is kind and lenient, but even she has her limits.

Lets just look at Fiendship is Magic #5. Changelings gotta eat right? And as far as we can tell, draining a pony's "love" isn't fatal and is potentially recoverable over time, much like draining a large portion of their bodily fluids. But what happens to these non-pony changelings who are simply following their base instincts and need to survive? Well on two occasions when they're caught through the comic, they are immediately incarcerated with an indeterminate life sentence... without food. Ponies are fucked up passive aggressors if I've ever seen any. Locking up a defeated foe without food is pretty much akin to a death sentence via concentration camp, let alone in an active volcano. That's right, I just compared Princess Celestia to Hitler. So much for your fair and benevolent shining goddess, am I right? Same kind of thing happened to Luna/Nightmare Moon. She was incarcerated on the moon for a thousand years without sustenance as far as Fiendship is Magic #4 shows, but maybe Alicorns are different, maybe they don't need to eat and simply eat food on occasion as an indulgence of the senses? Additionally there's Friends Forever Issue 14 which shows dragons living in Fillydelphia in the aptly named "Dragon Town", and obvious reference to China Towns, dragons that are apparently blamed for a rash of recent fires despite their being only circumstantial evidence at the scene, namely that the fire supposedly started in a line. Despite the fact that there is an apparently known and named species of Fire Snails, which left large slime tracks at the site of the most recent fire, and thus presumably every fire. But instead of doing their jobs and thus researching the innumerable potential ways a fire could start either magically or mundanely, these inept speciesist pony cops blame innocent dragons for crimes committed by another species entirely, dragons who even go out of their way at the end of the story to save dozens of ponies from a fire in fact. Either way, Crime and Punishment in Equestria seems to unfairly favor ponies over non-ponies. Bunch of speciesist bastards.

Something to note with this topic is that looking at the show overall, how few MUNDANE violent crime have we seen from someone who's not an Arc Villain? We've never seen someone get mugged, we've never seen an attempted murder by another pony (except Sombra and the Yaks, but in the latter case the Yaks had a bit of Diplomatic Immunity), and we rarely see any serious theft or other serious crime, and as shown with Trouble Shoes, crimes such as kidnapping are taken quite seriously. I imagine that Starlight has wanted posters hanging up of her because of HER crimes. Really, it seems that outside some occasional minor crimes were the punishment normally seems to be 'clean up your own mess', and crimes like Trixie and Rarity when corrupted by evil artifacts which are understandably pardoned, Equestria actually has a surprising low crime rate. Heck, it's clear that in general ponies feel their foals are safe to play around town without fear. The Flim Flams get off most of the time...but it's clear they both know that when their jig is up, they're going to be arrested if they don't get the buck out. In the comics, Trixie and the Manehatten PD DID set up a police sting to catch Rough Diamonds, which was very competent and only failed because Rough Diamond was THAT good of a Phantom Thief. I think Equestria's legal system is probably relatively successful at dealing with normal level criminals who don't have world threatening superpowers. And in those cases, the imprisonment normally lasts about 1,000 years and is NOT a cardboard prison, and most of them only escaped due to very specific circumstances. While we've seen two escapees from Tartarus, which given how it's described is Equestria's most maximum security prison, that's two in over a thousand years of opperation, and one of those was the VERY cunning Lord Tirek who was able to outsmart Discord, and even then it took him a millennia to escape. I think Equestria is generally very good at law enforcement, but as you said is a bit more lenient than OURS when it comes to accidents, genuine regret and remorse, and other factors.

I gotta agree since I just started watching MLP had this show been a well G possibly even a higher rating most of the villains like Discord, Sombra and maybe just maybe even Nightmare Moon would have definitely faced a classic punishment or death sentence. Especially when you consider the facts for Discord and Sombra, where Discord does it simply because he can and just wants to mess with people. And Sombra does it plainly out of being a megalomaniac. In all honesty I have to agree that the punishments given to Nightmare, Discord and Sombra are all just since all of theirs involved world domination of some sort. However committing a smaller crime like theft could be taken care of with community service.

Well, just to say something that I think others have missed, it's just that Dash was never caught doing that whole destruction thing. I never saw anypony except her friends see what she had done. And as for punishment in Equestria, well, they do live in a magic filled and especially mythical creature filled world so they probably see some destruction as pretty normal or some magic spells are just accidents, as long as the damage can be repair and no pony becomes killed by it. At least that's how I've seen it.

An other reviewer pointed out, that Celestia might not punish Ponies, when the punishment would not make the lesson the Pony already learned stronger. Examples: Wanted Need Spell - Twilight already understood her wrong doing. A punishment would not have helped to learn her. Different example: Starlight Glimmer. Once she understood her wrong doing, Twilight left her without punishment. Offcourse, no punishment does not mean no consequences. I would have liked to see Rainbow Dash helping to fix the weather factory or trouble shoe fixing/preparing the rodeo. Undoing the damage isn´t a punishment, but helps to learn the moral.

The reason why RD is getting away with all of her crimes is because she's best friends with one of the princesses. It makes sense, if she ever did get arrested Twilight can just bust her out, even when she was a unicorn, Twilight was Celestia's student meaning that she could always just ask Celestia to bail RD. Rainbow Dash has lots of important connections and on top of that she's also an Element of Harmony.

There's also the issue of just whats on Equstrian books as crimes. Especially if you look to the comics there are multiple acts that would be felonies according to our laws that are apparently not illegal (based on the actions of various law enforcement officials and dialogue) in Equstria. So: what exactly is IN the Equstrian Criminal Code?

A lot of the hate Starlight got in early season 6 was because she wasn't punished for her crimes. The reason she wasn't is quite obvious: Twilight is royalty, she pardoned Starlight (and probably Trixie's use of the Alicorn Amulet too)

I think that if the perpetrator/s do/es not make amends on their own iniative, s/he/they should certainly face a punishment equal to the crime. That said, I don't think Celestia knew she could banish Nightmare Moon to the moon for 1,000 years with the Elements, and I'm not sure Celestia and Luna knew they could petrify Discord. The Mane6 knew because it had been done before, but the Elements themselves seem strangely versatile in their effect: purification, banishment, petrification, and release all with about the same amount of effort? Not to mention the second stoning of Discord was accompanied by a reversion wave that turned everything back to normal. The only thing more impressive is when the Mane6 used the Rainbow Power to (1) completely de-rank and re-level Tirek, (2) restore all the stolen magic to the correct ponies without mixing them up, and (3) banish Tirek to Tartarus, and imprison him there in a cage we can only assume he can't break. Strong punishment there. Other than Rainbow Dash getting away with industrial sabotage and probably causing a drought, the crime-punishment cycles that bother me most are the Flim-Flam Brothers and Diamond Tiara and Silver Spoon, because they always seem to become Karma Houdinis. Tiara and Spoon never seem to get punished for bullying the other foals, including the CMC, and that's not right at all, especially when they're seen in the act by adults like Cheerilee. Those two would probably get light punishments, being foals, but then there's Flim and Flam. In their first appearance, Flim and Flam tried to trick the Apples out of business and steal their farm from them. Yes, they tried to con them out of Sweet Apple Acres, because the contest was only over the rights to sell apple cider in Ponyville. Applejack and the others only assume they won't have enough business without the cider sales to survive, but Flim and Flam plan on demolishing the farm buildings and replacing the farm's sign, as though the contest was over the farm itself -- and nopony stops them in this. In the process of the contest, they also uproot and completely pulp dozens of trees from the Apples' south fields -- trees which cannot be replaced because they've been destroyed in the SSCS-6000. That's something for which the brothers should have repaid the Apples, regardless of how badly chewing up rocks and trees might have damaged the SSCS. Oh yeah, and they kept knocking over that one post. And yet they just leave town, to return with yet another con -- one that does not rely on a mechanism that actually works. Rest assured, no one gets away with crime in my fanfic series. For Flim and Flam in particular, Celestia orders them to repay the Apples. She also confiscates the SSCS, which got damaged enough to become non-functional anyway. Thirdly, they had to serve time before Celestia would release them. There's one final point I would like to touch upon in regards to crime and punishment: Luna. A thousand years of banishment and solitary confinement is a very stiff penalty for _attempted_ regicide/coup. Despite this, Luna herself is clearly the last to forgive herself, whether you're watching 'Do Princesses Dream of Magic Sheep,' or reading the 'Nightmare Rarity Arc' of the comics. In the comics her reluctance to forgive herself is what keeps her powers restrained, and her form as we see her in season 1, post-purification. When she comes to realize that the others have already forgiven her, and that they need her strength, she changes to her normal appearance and is able to fight back. In the show, Luna had punished herself further, certainly ever since her purification and maybe even since she turned into Nightmare Moon, by creating the Tantabus to turn her every dream into a nightmare -- a nightmare where she, as Nightmare Moon, defeated Celestia and came to rule over an Equestria stuck in eternal night. I think the fact that Luna did not feel that her banishment was enough says a lot about her, and about her guilt over what she nearly did. But I also think she's confusing what we saw in the season 4 premiere with her nightmare, because Nightmare Moon barely managed to do anything before Celestia had to banish her. Which means that the punishment was heavy indeed.

About Rainbow Dash, technically she was never caught. No live ponies were on the scene, and no (visible) security cameras around. Even if there were, the explosion would likely have damaged them beyond repair.

Easy! How do you know if there was magic involved in the crime? More magic! Think about it, what if magic left a trace on whatever object it touched, and it was sort of the equivalent of human fingerprints? And what if, in the Equestrian Legal System, there are ponies whose jobs/destinies are to catch criminals and/or detect magic? pretty cool, right?

In a world of magic justice is so much easier. Think back to the episode discord became friends with fluttershy and celestia said at the end "I can already SENSE a big change in him"! With magic you can see if someone did it on purpose or not and if his intentions are evil or good. Usually you use punishment to let somebody learn but if he or she already learend there is no need of punishment. In the real world of course it is impossible to know if someone learned or reget something but with magic it's no big deal.

I have a question, When the attack on Pearl Harbor happened it was tragic, but many historians quote it as being important for the united states getting involved in the war, and the allies winning. if punishment is based of of damage there, than what if something terrible happened like pearl harbor, but it also had major positive effects in the long-run, would it still be punished?

Well if you want to get away with a crime you commited then there has to be a couple ways since there are different types of ponies. For a unicorn you could use an invisibility spell so you are not able to be seen and that's only one way. You could also use a disguise spell...If you are a Pegasus than you could fly away quickly like RD or you ould where a cape/cloak/disguise to get away with it. For an earth pony than its pretty much the same for the disguises.

Well it does seem if someone holds the title of "hero", they can get away with much more than someone called "villain". Just look at the typical property damage in a super hero battle. The hero can claim it was an accident, were under someone else's control or simply had to do it to vanquish the villain. It does help that the hero at least will go out of their way to protect innocents from being harmed from their accidents. But at times it does feel like a double standard.

Firstly; this show is aimed to young kids. They don't really have the comprehension of you did something bad and now you're going to timeout (i.e. jail) for years. And for the kiddies with family incarnation, I'm sure Hasbro doesn't want to ruffle any feathers. So with that in mind, I'm not surprised that punishments are fairly mild for what the crime was.

Considering the changelings and ponies were at war... I don't think they would have... That severe of punishment. Perhaps just imprisonment until surrender or something. I don't believe the ponies would execute another leader, because the ponies need the "friends"/allies. Just like discord... They imprisoned him to later reform him. Same with Luna in a way... Perhaps the same would have happened with Chrysalis and here changelings in some form? I don't know... Just a thought.

I have a new theory: In the trailer for the new equestria girls movie, I noticed that human twilight was with the shadowbolts, the same team of flyers in one of the first episodes of mlp, where they manipulated Rainbow Dash. So, does equestria girls take place where instead of twilight going to ponyville, she stayed in Canterlot? And in equestria girls, does this mean Canterlot= Shadowbolts Ponyville= Wondercolts? I'm confused...

I think if you have saved Equestria a few times, things can be excused, kinda like with celebrities. They get off of things all the time because they have the right people and enough money to pull them through. I think because RD has been an instrument to saving the world many times, it has given her a good reputation with both the people and Celestia. I also believe crime is measured differently, based on what part of Equestria you are in. Kinda like how the U.S. states do it.
