JM 1st class can only award one fourth of three year in case of default of payment of fine. Not 1/4 of total imprisonment mentioned in IPC. Please recheck.
Hello sir , aap ne jo section 65 of ipc bataya usme jo theft ki saja di 1 saal or fine nhi diya to kya sir 1 saal ki saza ke upper 9 months or jail me rehna padega means 1 saal or 9 mahine jail me rehna padega ?
sec 30 (2) clearly says that imprisonment in default of fine does not exceed one fourth which the magistrate is competent to inflict...that is in that 392 example the punishment of default of fine should be one fourth of 3 yr that is 9 months... not 3.5 years .....
