Thanks for making this video. We have always been told chapter 7 is the worst and never to file 7 first. Your perspective was something new for me. I’m in Texas so I am not sure I’ll find a diamond in the ruff like you. Should you have any like minded attorney contacts you recommend, I would deeply appreciate that! Nonetheless, I’m going to look into 7 and pray I find someone who can also look objectively first.

I'm looking to file ch. 7. Currently paying 775 for a carnote plus insurance. My car was stolen 8 days ago and now I have to pay a 1k deductible to insurance. I'm already 4 months behind on my note. I want my car, but I can't afford to pay it with my rent increase. I'm thinking of just paying a bankruptcy lawyer instead of the bank and insurance company. Usually taxes and student loan debt is not discharged in a chapter 7 bankruptcy. However, if the tax debt is more than 3 years old, it might be. If you file a chapter 13 bankruptcy you will be required to pay back the tax debt over a 5 year period. Student loans will still not be discharged, but they will receive some funds during this time.
To determine if you qualify for a chapter 7 bankruptcy you need to look at your household income and number of people living in your home. You can see the income limits based on household size at the U.S. Trustee's webpage at www.justice.gov/ust/eo/bapcpa/20190501/bci_data/median_income_table.htm

Sorry to hear about your difficult situation. Chapter 7 bankruptcy may be the way to go. It is really helpful at stopping collections and eliminating credit card debt. It will not eliminate your car loan unless you decide to surrender your car back to the bank. I would recommend contacting a bankruptcy attorney in California.
