In this episode of The Lallantop Show, we are discussing The Supreme Court MP MLA Bribery case verdict. SC has overturned its own judgment of 1998 that granted legislators immunity from bribery charges related to their speech, queries, or votes in Parliament and Legislative Assemblies. What is the history of this case? How Narsimha Rao govt and later Manmohan Singh govt faced the allegations of note for vote. What comments did the Supreme Court make during this verdict and also back in 1998? What is parliamentary immunity, and what could change now?
We are also discussing the cases where justices of HC or SC left the judiciary to join politics immediately after quitting their jobs. It is in the backdrop of West Bengal HC Judge Abhijeet Gangopadhyay, who is set to leave the job and join politics soon. Similar cases have happened in 1967 and 1983. Who were those judges? We will let you know in this video.
In other news, SC harsh comments on Udhayanidhi Stalin for his controversial remarks on Sanatan Dharam. The Parivar war between BJP and INDIA alliance after which BJP leaders are adding ‘Modi ka parivar’ in their social media bio. Then comes the news from Barabanki, where BJP MP Upendra Rawat has quit as Lok Sabha candidate from the same seat after his alleged private video has leaked.

मैं एक बैंक से रिटायर्ड अधिकारी हूं। मेरे बैंक में एक प्रक्रिया थी कि जब कोई अधिकारी बैंक से रिटायर होने को होता था तो, तो रिटायरमेंट से तीन माह पूर्व उसे किसी ऐसे पद पर तैनात किया जाता था जहां उसे कोई वित्तीय निर्णय लेने की जरूरत नहीं पड़ती थी। दूसरा, उस अधिकारी के सम्पूर्ण कार्यकाल का एक स्पेशल ऑडिट कराया जाता था। उसमें प्राप्त त्रुटियों का सुधार उसे सेवानिवृति से पूर्व करना पड़ता था और यदि बैंक को कोई आर्थिक हानि की संभावना होती थी तो, उसकी वसूली उससे की जाती रही है। यह उत्तरदायित्व निर्धारित करने का बस एक उदाहरण है।

भाई biased हैं, बिल्कुल हैं, पढ़े लिखे लोग biased hain, दलित लोग biased हैं, मुसलमान biased हैं, और सबके अपने अपने कारण हैं, पढ़ा लिखा व्यक्ति समाजवादी क्यों है, बड़ा प्रश्न है, कारण है, "पढ़ लिख कर तुम बड़े आदमी बनोगे" का नैरेटिव जो कांग्रेस की देन है। पढ़ लिख कर जब कोई बड़ा आदमी नहीं बन पाता तो हड़ताल करता है, और समाजवादी विचारधारा के प्रभाव में आ जाता है, क्योंकि ये लोग हर क्षेत्र में यूनियन बनाकर बैठे हैं। गरीब क्यों बायस्ड है? आदत लगा दी मुफ्तखोरी की, अब मुफ्त में तो जिंदगी काटी जा सकती है, अब ये चाहते हैं कि मुफ्त में मौज करवाओ। संभव न है। मुसलमान धार्मिक कट्टरता और पिछड़ेपन के कारण biased है। बाकी राजनीतिक पार्टियां नैरेटिव चलाती हैं।

The decision may be correct but this is final who can guarantee it. Why the first decision taken and then why the second decision overturned it. And who can vouch that it will not be overturned once again in due course. It was mentioned that CBI director can not be removed before his time even if he is caught with hands in the till. सवाल है कि पहले अधिवक्ताऔं को राजनीति से परे होना चाहिए। सुप्रीम कोर्ट में सारे अधिवक्ता राजनीतिक पक्ष से जुड़े हैं, पहले यह व्यवस्था बने कि हाईकोर्ट और सुप्रीम कोर्ट में राजनीतिक पक्ष से संबंधित वकीलो को प्रेक्टीस करने से रोका जाए उसके बाद जजो को राजनीति से रोका जा सकता है।

From next time onwards nobody will display bribe. Atleast person has guts to display what he was offered. It will discourage them. Have enquiry and trial on who gave them. This will create fear. Not happy with this judgement in my opinion. Now they will accept and keep tight lip. No purpose solved.

एक अर्थहीन फैसला है क्योंकि संविधान में संशोधन हो सकता है। इन लोगो पर कारवाई के लिए, लोकसभा के अध्यक्ष की मंजूरी की व्यवस्था हो जायेगी, या ऐसी व्यवस्था बनेगी कि संसद के द्वारा पहले जांच होगी उसके लोकसभा या राज्यसभा के अध्यक्ष की मंजूरी अनिवार्य कर दिया जायेगा।
