Asking questions during oral arguments is part of a Supreme Court justice’s job. But, beginning in 2006, Clarence Thomas went a decade without asking a single one. Due in part to changes made during the pandemic to how oral arguments are conducted, Thomas became one of the court’s most active questioners. In this video, we look at the purpose of questions during oral arguments and why, after so many years of being silent, Justice Thomas found his voice.
Video features:
- Paul Clement, former US Solicitor General and partner at Clement & Murphy
- Sarah Harris, a former law clerk to Justice Thomas and a partner at Williams & Connolly
(Produced by Macarena Carrizosa; Senior Producer: Andrew Satter; Executive Producer: Josh Block)

I think some degree of reserve and silence is necessary for the attorneys to state their case properly and as intended. However I can't deny the benefit in allowing the Justices questioning freely and espousing their opinion, as it give the public a clear view on their reasoning behind their opinion.

One of the only times Justice Thomas asked a question was when the law banned domestic abusers from buying guns. He asked why a misdemeanor should prohibited gun ownership. Sadly the solicitor did not reply that misdemeanor canabis possession also bans gun ownership.

The saying something like, " you don't know who a wise man is when all are quiet, but you know who the wise man isn't when he opens his mouth", or something like.
