I did manage to remand my case back to state court after I amended my complaint, asserting only state law claims, seeking relief exclusively under only state law, new evidence appeared after some discovery can support a strong federal claim for ethnicity discrimination retaliation under section 1981. Can this claim service the issue precaution “ estoppel “ test ?!. the case is still in discovery, with no final ruling yet, still within the status of limitation for a section 1981 claim. I found that some federal courts did allow claims of retaliation under section 1981 while litigating discrimination claims
