Responsibilities between vessels (Form Rules 13, 18) To determine which vessel must give way in an approach situation, it is essential to know the hierarchy established. 1st- vessel not under command or vessel restricted in its ability to maneuver 3rd- any vessel being overtaken 4th- vessel engage in fishing 5th- vessel under sale 6th- Power driven vessel this commercial boat has the right of way it is your responsibility to know the rules. Vessels engaged in fishing means any vessel fishing with nets lines trolls or any other fishing apparatus which restrict their maneuverability but not you sir fishing on a kayak. Many years ago a buddy of mine and his dad were having boat issues. They were in an area where there were several shrimp boats. They were dead in the water and a shrimper was headed their way. They radioed to the captain and explained their situation and asked him to alter their course. The captain replied that it was tough sh** that they were having issues, he was on the water trying to make money and he would not alter his course. Long story short, the captain didn't and they just barely avoided the cables from the shrimpers nets. They avoided being swamped, and got back safely. The dad found out who the shrimper was, found out where the boat was docked and he and a couple of buddies paid the captain a visit. The captain decided to bow up to my buddies dad and friends and he and his two crew members discovered what the joys of reconstructive facial surgery were all about. It was so bad that there were no charges filed because the shrimp boat captain was scared that it would happen again. Sadly, you can't do it like that today. Don't worry, between the alcohol, cigarettes and meth, that captain will get his ass whipping.

I guess those crews were hurrying to get their work done so that can have another fix, be it dope or fentanyl. Commercial fishermen are some of the lowest scums and this has been proven again and again, no matter where they are. Report the boat and get their asses fined. Glad you are safe.
In the state of Florida non power vessel has the right a way. So to you thats a normal thing how he went about it? i was in his way... Do you think it could went down different if he blew horn. maybe i would of tried to move before my lines got caught.. Judging by his comments he doesn't have any regards to kayakers.
Pretty sure you should check your rule book again. A fishing vessel that is restricted in its ability to maneuver (like pulling traps) has the right of way over a vessel engaged in fishing. Clearly, you were looking for them to give way by your "holier than thou" attitude which is pretty tough talk for a guy out in the ocean in a kayak. If all you lost was a couple of lines I'd be grateful. Luckily it wasn't some inexperienced speed boat that ran you over, as kayaks are very difficult to see on the water. Should be a law against being that far out without some sort of flag. These guys are out there trying to make a living and have to deal with people like you all day, can you imagine how frustrating it is? It is your responsibility to know the laws before you get on the water, not theirs to teach you.
Engaged in fishing. Not non powered vessel? Please indulge me where it says over a non power vessel. FWC had already told me i had the right a way. My "holier than thou" attitude is what any fisherman would have said if their lines had gotten ran over. If there was simple horn/buzz to move im sure i would of move. I think its common courtesy. what he did was no regard to me. Not the first time ive heard they done this to boaters and kayakers alike and definitely not going to be the last! If inexperience speed boat were to hit me then they wasn't paying attention and if i survived id probably be a proud owner of a new speed boat! The way I see it , the pot's where already there . They had to pull the pots , ever one is always talking crap about commercial fisherman . You should had reeled in your line's until they got by you . They just trying to make a living .
I was in 120ft with no sign of buoys or any signs of markers nor did i know their was boat was behind me till they were 30yards away. They could have blew their horn if i was in their way or even educate me as they were going by. It was a straight up dick move.
@@YakNinja Dude you obviously don't know the navigation rules of the ocean. he is teathed to bottom, I have Hobies too and never saw you reach for your rudder on your port side. The commercial fisherman tethered to to bottom has the ultimate navigational rights. Nice kayak but you need to get a grip and learn more about navigational rights. You lost a few hundred feet of line and a couple of lures. He could of lost his catch and thousand of dollars of equipment.

Yak Ninja well my best advice is to be aware of all the boats around u maybe with all your gizmos there you can get a radar 😂, the man was on his set pulling pots not his Fault you aren’t aware of him until he’s 30 yards from you, when you got caught up why didn’t you brake off to be free instead of just sitting there like a googan 🤷🏼♂️ the man has the right his pots and he never caused you any real danger. And no I’ve never been a in kayak in the ocean Cuzz we fish more then 2 miles from the beach here, 5-20 miles for bottom fishing, 30 plus miles for tuna 60plus for billfish.. and I like coming home so I stick to big boats.... maybe get a boat or be more aware Cuzz all the man was trying to do was make a living and he doesn’t need another clueless kayak in his gear🤷🏼♂️

He was aware enough to know a boat was approaching him even though that is not his responsibility, and the onus is on the boat driver, not the kayak peddler, despite making his workday a measily 3 minutes longer.

You also have no experience dealing with traps. These guys were pulling a trawl. A trawl is a line of traps that connects underwater that can go on for miles. You just happen to be following their line. There is nothing they can do to change direction. Please understand you are out there for fun. They are out there trying to make a living. I will say the exchange was funny as hell. Also, FWC and the Marine Patrol will laugh if you show them this.

Anyways I spoke with 2 fwc officers they said i did nothing wrong and that i had the right away. If i had flip they would be in trouble instantly. So on my phone call with the 2nd fwc officer which saw this video says there's been on going investigation. Apparently theres a list of problems and complaints about the boat. He is very aware of the boat and that there mighy be some arrest. "Idk thats what he said." He ask if i can identify the captain if i was to be called in. Im very curious to see how this all plays out.
