Good day, Atty! Another fruitful lesson! Here are my insight about this lesson. Lesson 24 What is complaint ? It is a sworn written statement charging a person with an offense subscribed by the offended party, any peace officer or other public officer charged with the enforcement of the law violated. What is an information? it is an accusation in writing charging a person with an offense subscribed by the prosecutor and filed with the court. When is a complaint or information sufficient? 1. Name of the accused; 2. Designation of the offense given by the statue, 3. Acts of omissions complained of as constituting the offense, 4. Name of the offended party; 5. Good day, Attorney. I appreciate you making this video. This lesson taught me the distinction between a complaint and information. A complaint is a sworn written statement charging a person with an offense, whereas an information is a written accusation charged with an offense subscribed by the prosecutor and filed with the court.

Goodmorning Atty! In this video lecture, I have learned the difference between Complaint and Information, In Complaint subscribed by the offended party or other public officer. lesson 15: Complaint vs Information Good Afternoon, Atty! Thank you for today's fantastic teachings, as we will learn more about Information and Complaint. Information vs. Complaint - is a sworn declaration charging a person with an infraction that is signed by the aggrieved party, any peace officer or public officer who can file a case against the persons who violated. While the Information is a formal criminal charge submitted by the public prosecutor or the fiscal against an accused individual, it is signed by the prosecutor and filed by the public prosecutor or the fiscal inside the court. The following should be stated in order for the complaint and information to be sufficient: - The accused's and the victim's or injured party's names -the place, date, and time when the offense was committed, as well as all relevant facts concerning the acts or commission of the offense, should be disclosed. When is a complaint or piece of information enough? -It is adequate if it mentions the following: a. the accused's name; b. The statute's designation of the offense; c. acts or omissions alleged to constitute the crime; d. the insulted party's name; e. the approximate date of the offense's commission; and f. the location where the offense was committed

Thank you attorney for discussing the difference between complaint and information. Complaint is defined as a sworn written statement subscribed by the offended party or any peace officer charging a person with an offense. A complaint can be filed from law enforcement pillar to the prosecution but based on the last videos that I have watched, you can file a complaint directly to the court if the case is punishable below 4 years, 2 months and 1 day (under Rule 110 Section 1, 2nd paragraph). On the other hand, information is the written accusation charging a person with an offense, unlike the complaint, information is subscribed by a prosecutor and filed with the court. From prosecution pillar, the information may now be directly filed in the court. Good day Atty! This video helped me identify the difference between Complaint and Information. A Complaint is a sworn written statement charging a person with a offense and it can be subscribed by the offended party, any peace officer or public officer who is charged with the enforcement of the law violated while Information is the accusation in writing charging a person with an offense and it is subscribed by the prosecutor and filed with the court. In other words, the complaint is filed by the offended party, peace officer or any public officer while Information is filed by the prosecutor in the court. Another thing is the sufficiency of a complaint or information. The complaint or information might be dismissed if it lacks on facts. Thank you Atty!

Ngunit sa Information naman ay ang maaring magsampa lamang ay ang Prosecutors, dahil diretso na itong ipapasa sa court. Complaint may directly to the office of the prosecutor or directly to the court. Information is subscribed by the public prosecutor only. Sa complaint ang pwede mag kaso is tatlo ang offended party, peace officer at publiic officer, tapos po sa information public, prosecutor lang as in wala ng iba. Good Day po! This short video lecture was already tackled last semester but you actually explain it clearly.This topic makes me understand the difference of complaint and information. The complaint is a sworn written statement charging a person with an offense signed either by offended party,any peace officer and public officer.While the information is an accusation in writing charging a person with an offese subscribed only by prosecutor. Lesson # 3. Good day, Atty!! I've learned that complaint is the sworn written statement charging a person with an offense, subscribed by the offended party, any peace officer, or public officer charged with the enforcement if the law violated while the information is the accusation in writing charging a person with an offense, subscribed by the public prosecutor and filed with the court. A complaint or information is sufficient when it states: (a) name of the accused; (b) designation of the offense given by the statute; (c) acts or omissions complained of as constituting the offense; (d) name of the offended party; (e) approximate date of the commission of the offense; and (f) place where the offense was committed. Also, it is necessary that all of the facts are complete in a complaint or information in order to be called it a sufficient document and be valid. Like in cooking a dish, all of the ingredients must be enough and complete for the taste to be delicious. Thank you for sharing this information with us ❤️

Good day Atty. I would like to thank you for your very clear and concise discussion for us to learn and easily comprehend every knowledge you imparted to us. In this lecture I learned about the difference of the complaint and information. I learned that complaint is a written statement charging a person with offense,subscribed by the offended party,any officer or other public officer charged with the enforcement of the law violated.Criminal cases are generally public crimes therefore a police can complaint eventhough he/she is not relative of the victim or the victim itself for the people of the Philippines. You can file it in the office of prosecution or direct tovthe court. Information is an accusation in writing charging a person with an offense subscribed by the prosecutor and filed with the court. A complaint or information should be completed, it is only sufficient when it states the name of the accused and offender/offended party, designation of the offense given by the statute, acts or ommission complained of as constituing the offense, approximate date of the commission of offense and lastly the place where the offense was commited.I have learned so much from you and I look forward to learning more. Good evening Atty. Today I learned about the complaint and information. Complaint is subscribed by the offended party, peace officer and other public officer. Complaint may directly to the office of the prosecutor or directly to the court. While information is subscribed by the prosecutor, information may directly to the court because after the prosecution pillar the next is court pillar. Information and complaint will be sufficient if the name of the acussed, designatuon of the offense, acts or omission, bame of the offended party, approximate date and time are stated. Subscribed by the offended party, any peace officer, or public officer charged with the enforcement of the law Who may file a Complaint? - May be filed by the offended party, any peace officer, or public officer charged with the enforcement of the law violated What is a information? - Basically, it's a document prepared by prosecutors upon which criminal charges are brought. Like a complaint in a civil case, an information must contain the pertinent details for a defendant to be able to understand what the charges are that are being brought against them When is a compliant or information sufficient? - Sec. 6. Sufficiency of complaint or information. - A complaint or information is sufficient if it states the name of the accused; the designation of the offense given by the statute; the acts or omissions complained of as constituting the offense; the name of the offended party; the approximate date of the commission of the offense; and the place where the offense was committed. When an offense is committed by more than one person, all of them shall be included in the complaint or information.
