FAMILY CODE OF THE PHILIPPINES
ABSOLUTE COMMUNITY OF PROPERTY
Section 4. Ownership, Administrative, Enjoyment and Disposition of the Community Property
Art. 96. The administration and enjoyment of the community property shall belong to both spouses jointly. In case of disagreement, the husband's decision shall prevail, subject to recourse to the court by the wife for proper remedy, which must be availed of within five years from the date of the contract implementing such decision.
In the event that one spouse is incapacitated or otherwise unable to participate in the administration of the common properties, the other spouse may assume sole powers of administration. These powers do not include disposition or encumbrance without authority of the court or the written consent of the other spouse. In the absence of such authority or consent, the disposition or encumbrance shall be void. However, the transaction shall be construed as a continuing offer on the part of the consenting spouse and the third person, and may be perfected as a binding contract upon the acceptance by the other spouse or authorization by the court before the offer is withdrawn by either or both offerors. (206a)
Art. 97. Either spouse may dispose by will of his or her interest in the community property. (n)
Art. 98. Neither spouse may donate any community property without the consent of the other. However, either spouse may, without the consent of the other, make moderate donations from the community property for charity or on occasions of family rejoicing or family distress. (n)
CONJUGAL PARTNERSHIP OF GAINS
Section 5. Administration of the Conjugal Partnership Property
Art. 124. The administration and enjoyment of the conjugal partnership shall belong to both spouses jointly. Art. 125. Neither spouse may donate any conjugal partnership property without the consent of the other. Hello po Atty. Pa advice naman po. The husband and wife are both dead with parcel of land and with 5 surviving heirs all are married. Nung ginawa po ang Extrajudicial settlement isa po sa heir ay namatay kaya ang pumirma bilang representative Ay yung asawa pong lalaki (ito po yung tapik). Kalaunan po namatay din po yung asawang lalaki, wala din po silang anak. Sino po yung magiging heir ng naiwan nilang share sa property? Thank you po Attorney.

Thank you po attorney for this information,may tanong lang po sana ako ,im ofw po and more than 9 years n kami na hiawalay ng x husband ko ,at may conjugal property po kami n bahay at lupa pero ako lang po ang nag pondar niyan at may na bili din po ako na lot thru my name ,at tanong ko po attorney kung pwd po ba ako mag pagawa or gagawa ng last Wili of testament ko n lahat n na pondar ko even yung house and lot ko ay ang mga anak ko lang ang may karapatan ? Atty. pwede po ba bilhin ni husband kay wife ang kanyang hati sa conjugal property ? (meron po sila deed of sale mag asawa)kung hiwalay na sila (not in good terms), at sya nalang ang pipirma sa deed of sale sa pagbebenta ?

Atty good day po pwede ba po ba tumawag syo sa number cp kung saan po kayo pwede kontakin, kasi po may konsulta lang po ako regarding po sa CLOA Title marami issue Dito Isa po Ang pagrelease ng titulo na Wala kaalam alam aang may Ari, iba Ang nag-claim ito po ba ay may paglabag sa batas at tsaka pagbabayad o pagtutubos ng titulo na Wala abiso sa may Ari. At alam ko mismo ang may ari Ang dapat kukuha sa Titulo.

Paano po kung naka pangalan pa din sa namatay na magulang ang lupa at may naiwan na 3 anak pano po hahatiin un. Pero po bago namatay ang matandang may ari ay may verbal agreement sa isang anak na sa kanya na pinapamana ang property. Ano po pwedeng gawin dun. Thank you po

Hindi po kasi tinatanggap sa batas yung verbal na pag-iiwan ng mana. Kailangan po yung last will and testament na nakasulat at may requirements din po ito to be valid. In the absence of a will, intestate succession po ang masusunod. Meaning, lahat ng qualified na legal heirs ay kasali sa pag-distribute ng mana.
