In Connecticut, a defendant can wave a right to a jury trial in favor of a right to be tried by a three judge panel. The judge panel does not have to be unanimous, the jury does. During Covid, in order to get a speedy trial, a woman went with a three judge panel, but probably should not have. This is that case.

Interesting cases. I would think that if a three judge panel doesn't need to be unanimous, that would be made abundantly clear by defense attorneys and judges, alike. Thanks for your information and analysis. It was eye-opening.

What I heard was one specific phrase which convinces me that they didn't actually correctly explain to her about the three judge panel either. Immediately after discussing with her the way a jury trial would work, they then said that if she chooses the three judge panel, "three superior court judges will sit *as a jury."* 9:28 That wording would, I believe, communicate to a reasonable person without a great deal of knowledge of Connecticut law that those judges would be acting *the same way a jury would act.* That includes the requirement for juries to be unanimous. If they had just said that her case would be heard by judges if she waived the right to jury, I would've had a different reaction. Edit: I hadn't even reached the point yet when I wrote the above, where you caught the same words! I had only just seen them, and stopped the video to respond. I'm delighted to see now that you think I spotted the right clause. 😂

Splitting hairs, I think. I feel it was up to her lawyer to explain to her. She was asked several times, and her lawyer said she understood the difference. Did her lawyer swallow his sword and say that he didn't explain every single detail. Enjoyed your commentary and video as always. Thanks
