This week, we’re discussing Wyoming’s recent ban on conservation groups bidding on oil and gas leases on state land and how, by doing so, they might actually be hurting the school system that they’re obligated to fund.
A recently published study shows how human recreation and noise can negatively impact wildlife by displacing them and keeping them out of the area for extended periods.

What has happened elsewhere when open bidding takes place, anti hunting groups have been the high bidder. We loose again. I can understand wanting land conservation groups to be able to have a chance at the leases. Just be cautious of what we ask for.

It’s a problem with a solution. We as hunters have to work with organizations like RMEF that are dedicated to conservation not exploitation.

Good discussion. The land should have been removed from leasing. Most states look at oil/gas leasing as not just the upfront price. They’re also considering the royalties for production, which will be paid to the state schools. This is the major source of revenue here in NM. Conservation groups do not produce royalties.

While they may not produce royalties, they aid in producing revenue via huntable populations . It may not be as simple as cashing a check, but this revenue is more important then a royalty.

The hunting is a byproduct of the land, not the other way around. If the land isn’t utilized as intended, ONG production, then the schools will see the hit far more than the critters. “Conservation groups” have been going into states that have limited numbers of OTC tags and purchasing them with the express purpose of keeping hunters out. Not to mention that without the ONG exploration vast majority of the land is virtually unusable by hunters and other recreational activities. Let them bid but must have a requirement for exploration included. It’s like buying up all the food stocks then burning it, oh wait, the government already does this…

@@soonerfrac4611 I see as a supporter of oil and gas, you might think that if the area were to be used , all other ideas couldn’t be a beneficial? I think that there are areas that don’t need to be directly exploited. We don’t need to turn everything into a gas or oil field. I also believe that there needs to be reasonable debate and discussion. But when you limit who can or cannot participate we lose competition. In the end we all lose.

There should absolutely be debate, nobody is saying otherwise. However comma pause, this land was specifically set aside for the purpose of exploration to provide the state entities with income other than taxation. Allowing an organization to remove that land from production robs the state of those funds.

I agree that when the highest bidder is granted, a less desirable outcome can occur.As a resident of Wyoming it should be to benefit of the resource. Not just who will benefit from the use. Migration corridors should be protected. Without them, no game . No game no hunting. I would pay more in license fees to hunt these areas. Similar to Elk Management tags in Wyoming. Less Regulation= more freedom. But we also need to restrict our “Trustees” from handing over the keys to house so that their friends can do whatever. Limit the number of Conservation leases, hold them accountable to show a positive impact. Limit the number of energy leases and hold them accountable to not have a negative impact on the wildlife.

I wish more people heard this. Being in Utah which is full of greed really hurts land management and conservation. And totally agree free market out west is only liked when it benefits what groups want and they will stop anything that competes with that.

Good discussion. Here in Florida, our wildlife and wildlife habitat suffers from people building on every square inch of land they can find. It's not just a western issue; our entire country is being impacted. BTW, from one CPA to another, good explanation of the fiduciary duty of a trustee to a beneficiary.

Pretty sure the state wants oil & gas because of the potential for all of the tax income "if" the exploration turns into production. The real income for the state agencies, or any landowner with a mineral lease, is in production so they are going to try and protect that long term interest. Sadly, the initial lease is inconsequential financially. Not sure of laws in Wyoming but getting legislation passed that requires the initial exploration to be done in a short window could be helpful.

Most private leases in Tx have to be spud in within 90 days.

Yes do not understand how a mineral lease works. When you own the rights for the lease that gives you the right to explore for minerals. If minerals are discovered the lease payment will increase based on the value of the production on the mineral/Oil or gas. With that in mind it is in the states best interest to maximize their income to get the mineral lease into production. You are out in the weeds because you do not understand how the leases work. Step it up guys.

It to mention he oversimplified the analogy about leasing a building. If that building is then used as a business and the owner gets a portion of the profit, vs. the leasee leaving that building empty and unused. That negates any higher price paid the initial lease.

If a non-profit buys land then it takes the land out of the property tax base gentlemen. Not always but in most cases. Especially if it is a national conservation organization. I like wild life protection and am all for it but you boys need to get your info straight. Again on the lease issue. Find out how the leases really work before you knock the state boards. I hate using the term but you are putting out disinformation here. I also am not saying the protection of the area is not worth it.

A lease is a lease no matter who applies for it. You get this amount of time to conduct your business. State still retains ownership. These properties are not up for sale. I’d rather see a conservation group work to restore a migration route then another Gas well or wind farm. I work and live in Wyoming. State lands should never be sold but leased to bring the maximum benefit to our wildlife and our children’s children’s children’s future. Leave it better then we find it.

You are missing the entire point of the intended use of the land: providing for the schools and or state budget via the royalties and such. The initial lease price isn’t the issue, the millions of lost revenue from the actual exploration is.

I had a friend who leased state school land (3yr bid) he wanted for recreation (hunting). The oil/gas rights (mineral rights) were separate, so they came in and drilled on a portion of the land during his lease. He was compensated for the disruption as the lease holder but then after that the school earned both royalties and lease. Why would every school not set it up this way to maximize their earnings? If critical to migration or such, maybe a land swap could be arranged.

Much more money is made on the production royalties than the lease bid. I'd focus more on regulating the infrastructure and drilling methods rather than worrying about blocking development. It needs to be done to intentionally minimize impact to wildlife. Things such as directional drilling can place most of the impact in designated locations. Selling of public lands needs to be sent to the Supreme Court. That land was a public trust and should only be sold through voting, not by a few representatives.

To further explain my point. Government revenue is made on oil at the lease sell, then a royalty is paid for every barrel produced, then that oil is taxed again during transit, then again at the refinery as it is separated into the many different products, then once again in the retail phase of each of those products. That's not to mention the indirect revenue created due to the jobs created along the way associated with exploration, drilling, production, transport, refinement, and retail. Where the companies make their money is through volume of product and that volume is produced on thin profit margins. Last I saw it was around 10% a barrel. R&D takes up about 20-30% and the rest of dut to the government's cut. So 60-70% of what you pay for any petroleum product is directly due to the government's hands in the cookie jar. The reason they block non-producers from bidding/blocking the O&G companies is that. Rather than stop them, tap into the funds created to finance projects and install rules that minimize impact and ensure things are done responsibly.

Thoughts left out… The asset cost is only a portional amount. The drilling/ mining brings in multiples in regional growth and development. Mechanics Housing Food Drs Etc.. And these benefits are ongoing till they arent. The rising tide lifts all the boats. Lastly, the free market is at work trying to drive down costs for all. No different than a city/state/county incentivising local development… I think youre limiting thought and counterpoint…

you forgot to list - pollution - air, water, noise, etc loss of habitat loss of wildlife sorry but i choose the conservation groups taking the lease if they pay the highest price, I don't care about the reasons you listed. We all get an opinion in this country.

@@joshcc1974 , Glad you responded as debate is good. What I realized years back is that the THEY in the world is ME/WE… Look at your trash can every week. It is a depository of mined / drilled/harvested assets. We are it and there is NO eliminating it only lessening the impact. Those fields of oil/gas/mines etc are essential to OUR existence. Wildlife does matter but locking down an assest because it makes us feel good will create more issues just like not harvesting lumber and not managing forests.. Randy has filmed countless shows in and around gas/oil fields where in conjunction ACCESS/OPPORTUNITY/SUSTAINABILITY are in place… Animals are quite adept at survival. It’s not just the higher prices paid for the initial lease, there’s significant loss of revenue for the school because that land was specifically set aside to provide for the school. $22 for the initial lease, vs. thousands or more for a very small well. Especially a horizontal well. Want to know why California can afford to pay their teachers so well? The state has massive oil revenues, and it virtually all goes to the schools. I will vote for the kids before almost anything else.

We have a population problem in this country. Our way of life is being compromised by us. There are too many people here already. The resources demanded currently is damaging wilderness and wildlife. An increasing population equals higher demand for stuff meaning more loss of wilderness and wildlife. Look around.

I love Randy and the boys but he was being deceitful about the way the fiduciary duties are for a lease operator. Yes, if I lease a building for less than I currently and doing so then I am not following my fiduciary responsibilities. However, if other revenue streams are tied to the use of that property, i.e. a shave of the even generated, then that must be taken into account. If I know that the higher paying leasee is going to sit fallow and only give less return on the investment, then absolutely you should lower the cost of the lease.

If you are not from Wyoming you have no skin in the game. Its literally that simple. We have tons of public land out here and oil and gas exploration and extraction is a huge part of our economy. I say if you dont want us to explore and extract our resources then maybe we just keep tags for our wild game for residents only. Be careful what you ask for.

Have either of you actually lived in Wyoming? I have. And Wyoming does it better than most states. They aren't bought in most places by anti ranching organizations. They support their citizens and schools. My life course was changed because of how Wyoming funds their schools. Royalties are going to pay longer than a one time lease. Wyoming resident hunters fight for what they want and have stopped unnecessary and invasive energy exploits (wind energy for example) in places, while still working and living with oil and gas. I want conservation minded leaders in MT and WY , but we can't have it all one way. Not everyone can feed themselves by hunting, unfortunately, in this modern day world. We need domestic energy and we need balance for wildlife and for ranching. Yes, greed gets in the way, but so does narrow sited solutions. Side note , time will tell how much access APR leaves in MT. As someone with close friends who actually work the land in eastern MT, it's been a slippery slope for a lot of folks. APR is a "non- profit" so doesn't pay the same taxes as other large land owners in MT. That's not right considering how they use the land and how they plan to use the land.

The premise here is not always correct. Wife and i own land that is leased for oil and gas production in a number of wells. The wells are 2.3 and 3.9 miles from the land. At each location there are at least 8 wellheads. Otherwise, there is no surface activity. Our land is managed on the surface for the benefit of wildlife. Wetland, upland, forest, and field habitats are all included and managed. We have abundant wildlife. None of this happens without a lot of mental and physical effort - and many blessings from God. We are good stewards of God’s creation. And a lot of oil and gas is produced so you can go on all the hunting adventures that you produce.

Both of you need to look at how schools are funded in Wyoming. The money from leases of state land is very small compared to the funding that comes taxes paid by these oil and gas industries. The vast majority of school funding and the major reason Wyoming’s doesn’t have a state income tax is because of this. No easy solution but please research a little more.

I'm fully aware of that. The lease and the royalty are huge funding sources for the schools. The question is, should the state (schools) not get paid more for the lease, also? That is one of the values to the land that the market should compensate for. Or does the industry need the politicians to remove competition that helps bring full market value to the school.

No, not really. In fact, most “environmentalist groups” started as what most people would consider as conservationist groups. The Sierra Club is a prime example of what started as a wildlife conservation organization and morphed into an environmental organization that hates hunters.

Why cannt anybody bid on BLM or National Grasslands. Can only cattle and sheep grazing bid BLM? And why does the same outfit get first chance with no competition or competitive bid. why is it only a $1.35/cow calf pair minimum for the bid on BLM? State revenue would be higher whenever there is more wildlife. The west and Wyoming should not have cattle on them anyway when you see how poor the land is and how many acres it takes to run cow calf pairs. Its a waste o f habitat for a invasive specie like cattle, sheep, and horses.

Your understanding of socialism appears to be very incorrect. The state actually makes significantly more money if an energy company wins vs. a net loss if an environmental organization wins. They literally selected the option that was capitalism based vs. instead of the socialist based.
